Judge's Rejection of Compensation for the Management of Dowry Disputes (Analysis of Decision Number 262/Pdt.G/2022/Pa.Batg)
This study raises the case of a judge's rejection of a claim for
compensation for the management of a dowry dispute at the Bantaeng
Religious Court. The case involved a couple who separated after the
husband took back the land that had previously been used as dowry.
Although the judge decided to return the land to the wife, the judge
rejected the wife's claim for compensation for the management of the
land. In this context, the rule of Al'adatu Muhakkamah is one of the
principles used in determining the law when there is no shar'i evidence
that explicitly explains it. This study aims to analyze the judge's decision
to refuse compensation for the results of the management of the dowry
dispute and analyze the use of the Al'adatul Muhakkamah rule in the
decision. The research method used is normative legal research method
with a qualitative approach. The qualitative approach was chosen to
describe the research results with sentences that categorize the data
according to certain categories. With this approach, the research can
provide in-depth conclusions about the application of the Al'adatu
Muhakkamah rule in the judge's decision. The research findings show
that the judge should have granted the compensation claim based on the
analysis of the al-'adatul muhakkamah rule. Islamic law aims to realize
human welfare, including by recognizing that customs that are still valid
for generations have a significant influence in determining legal
decisions. However, the main principle of sharia must still be the top
priority, especially if there is a conflict between custom and Islamic Law
AN ANALYSIS OF MAQ??ID AL-SHAR??AH IN THE PRACTICE OF ANGKAP MARRIAGE AMONG THE GAYO ETHNIC GROUP
This study aims to examine the practice of angkap marriage in the Gayo traditional community through the Maqashid Syariah perspective, especially in the aspect of safeguarding property (hifzh al-mal). angkap marriage is a form of social adaptation that arises as a solution to the problem of the absence of sons in a family, as well as the economic obstacles experienced by the male party in carrying out marriage, especially in terms of fulfilling the dowry or edet. This research uses a normative juridical method with a statute approach, namely by analyzing written legal norms and related maqashid sharia principles. The analysis technique used is qualitative. The results show that angkap marriage provides a practical solution in maintaining the continuity of family property through the appointment of a son-in-law as part of his wife\u27s family. The implication is that the husband changes his position in the inheritance system and becomes the protector of his in-laws\u27 property. Reconceptualizing the Marriage Age Limit in Indonesia: Efforts to Strengthen Family Resilience in North Sumatra
The issue of early marriage has become a polemic and still occurs frequently in Indonesian society. This paper considers the importance of limiting the age of marriage to prevent negative physical, social and emotional impacts on children. This paper abstracts how early marriage in Indonesia impacts family resilience. This type of research is field research, with a text analysis approach related to social issues to answer related factors that influence early marriage and how to improve family resilience. The author conducted research by interviewing five people, one of whom is the deputy head of the Religious Court, the other four are actors who play the role of parents in fulfilling the economical and social needs of children in low-income families, the impact of the increase in the marriage age limit on the rise in marriage dispensation applications at the Indonesian Religious Court, irregularities in marriage dispensation, the phenomenon of underage marriage, the practice of nikah sirri and its implications for marriage registration in Indonesia. The results show the need for better education, economic access, substantial law enforcement, and changes in social and cultural norms to address early marriage, concluding that limiting the age of marriage is vital to achieving family stability, happiness and well-being in Indonesia
Implementasi Moderasi Beragama Dikepluralitasan Desa Manik Maraja, Kecamatan Sidamanik, Kabupaten Simalungun, Provinsi Sumatera Utara
Melihat keadaan Desa Manik Maraja yang plural dan dinamis dan dengan adanya sedikit kesenjangan sosial lintas agama di Desa Manik Maraja kami merasa perlu untuk lebih memperkenalkan dan menerapkan kehidupan yang moderat, sebab jika ini dibiarkan maka berkemungkinan timbulnya konflik sosial yang berkepanjangan. Tujuan riset ini adalah untuk lebih mewujudkan integrasi dan keharmonisan sosial di Manik Maraja. Metode yang digunakan dalam penelitian ini adalah kualitatif dengan pendekatan fenomenologi. Hasil temuan ini menunjukkan bahwa masyarakat Manik Maraja membutuhkan sikap moderasi beragama karena dengan diimplementasikan-Nya moderasi beragama tentu akan membawa masyarakat Manik Maraja semakin terintegrasi dan harmonis dalam hidup kebermasyarakatan. Upaya dalam implementasi moderasi beragama telah terlaksana dan kini masyarakat Manik Maraja lebih mengenal tentang moderasi beragama, dan daripada itu telah memudahkan dalam penyebaran dan penerapan moderasi beragama secara menyeluruh di kehidupan masyarakat Manik Maraja
Sistem Kewarisan Adat Simalungun (Studi Kasus Desa Rambung Merah, Kabupaten Simalungun)
Penelitian ini bertujuan untuk mengkaji eksistensi hukum waris adat Simalungun di Desa Rambung Merah dalam konteks pluralisme hukum nasional Indonesia. Metode yang digunakan adalah penelitian lapangan (field research) dengan pendekatan kualitatif fenomenologis dan empiris-sosiologis, yang memfokuskan pada makna, persepsi, dan praktik masyarakat mengenai sistem kewarisan adat. Hasil penelitian menunjukkan bahwa hukum waris adat Simalungun, yang semula bersifat normatif dan mengikat, kini mengalami transformasi menjadi lebih fleksibel dan berbasis kesepakatan. Faktor pendorong perubahan ini adalah kesadaran masyarakat terhadap nilai keadilan, khususnya keadilan gender, serta berkembangnya moderasi beragama. Masyarakat Muslim di Desa Rambung Merah cenderung meninggalkan sistem waris adat karena dianggap diskriminatif terhadap perempuan, dan memilih hukum waris Islam sebagai acuan. Sementara masyarakat Kristen masih membuka peluang penggunaan hukum waris adat, asalkan dilaksanakan melalui musyawarah seluruh ahli waris. Diskusi menunjukkan bahwa pluralisme hukum di Indonesia mendorong munculnya model adaptasi dan kompromi dalam pelaksanaan hukum waris adat, sehingga tetap relevan dan selaras dengan perkembangan sosial serta nilai-nilai agama. Dengan demikian, hukum waris adat Simalungun tidak hilang, tetapi bertransformasi menjadi alternatif kondisional yang mengutamakan keadilan substantif dan harmoni keluarga di tengah masyarakat multikultural
