No full textLa dottrina italiana, salvo rarissime eccezioni, trascura l'esame della compensazione tra debiti non reciproci ritenendo che sia inammissibile una compensazione volontaria tra debiti non reciproci, e che, in queste stesse circostanze, di fronte al chiaro dettato dell'art. 1241 c.c., non sia nemmeno proponibile la questione dell'ammissibilità di una compensazione legale. Chi scrive ha avuto già modo di esprimere il suo netto dissenso dalle convinzioni sopra riportate (cfr. F. Nappi, Studi sulla compensazione, Torino, 2004); in questo saggio segnala l'utilità della categoria della Drittaufrechnung – costruita in Germania per accogliervi tutte le ipotesi di compensazione tra debiti non reciproci – per procedere ad un'applicazione dell'art. 1248 c.c., in relazione a certe specifiche fattispecie, che eviti altri deformanti schemi normativi di riferimento
