    Plenary Lecture: Knowledge Management or Knowledge-Cum-Values-Management?

    There is abundant literature on knowledge management, but we know of only two articles (of Mulej and co-authors) acknowledging interdependence of the human knowledge and the human values, recently. Mulej addressed this interdependence since his formulation of his 'Dialectical Systems Theory' in a Slovenian article in 1974 and in his best-seller book 'Creative Work and the Dialectical Systems Theory' in 1979 (in Slovenian). His co-authored English book 'Dialectical Systems Thinking and the Law of Requisite Holism concerning Innovation', Emergent Publications, Litchfield Park, Arizona (2013), contains the related novelties. The point can be simply exemplified: 'If somebody has gained knowledge on shooting with a rifle, does the person's choice to shoot whether at a paper target or at a human being depend of the person's knowledge or values?' The paper is aimed to address generation of human properties on which one's bases for action, called the subjective starting points in the Dialectical Systems Theory, and their impact over the human capacity to generate inventions and innovations in a socially responsible manner, meaning consideration of interdependence and holism in order to minimize one's detrimental impact over society, i.e. humans and nature. The addressed thesis reads: Knowledge management that fails to consider human values and other emotions is too one-sided to prevent failures, which tend to result from one's / team's lack of requisite holism; it is irrational to be only rational in human decision making and action

    Qualitative Model for Recognizing the Development Phase of Life Cycle in Smaller Companies in Terms of Handling Entrepreneurial Crisis by Implementing Non-Technological Innovation

    Obravnavamo faze življenjskega cikla iz vzorca malih in srednje velikih slovenskih podjetij iz predelovalne dejavnosti. Uporabljen je model Puempina in Prangeja (1995), ki je štirifazni (pionirsko podjetje, rastoče podjetje, zrelo podjetje in podjetje v preobratu) in vsaki stopnji so pripisane idealnotipske krize (in kazalci za njihovo ugotavljanje). Raziskali smo različne tipologije inovacij s poudarkom na netehnoloških inovacijah. Za implemetnacijo inovacij v posamezni fazi življenjskega cikla in ob kazalcih kriz smo oblikovali in uporabili model, ki je kombinacija modela Muleja in Hrastove (2012), dopolnjen s socialnimi inovacijami Štukljeve (2015), podprt z 12 dimenzijami Sawhneya in sodelavcev (2006). Analizirali smo podjetja iz vzorca in jih umestili glede na fazo življenjskega cikla. Prav tako smo preverili, ali so podjetja identificirala kazalce krize. Podatke smo obdelali posebej za mala podjetja in posebej za srednje velika podjetja. Kjer je bilo smiselno smo podatke tudi primerjali in komentirali. Rezultate smo prikazali v tabelah in grafično.We adresses the life cycle stages in a sample of small and medium-sized Slovenian companies in the manufacturing sector. We use the model of Puempina and Prangeja (1995), which is a four-phase (pioneering company, growing business, a mature company and a company in turnaround) and the ideal type of crisis (and indicators for their determination) is attributed to each stage. We explore the different typologies of innovation with a focus on non-technological innovation. For innovation implementation at each stage of the life cycle and the indicators of crisis, we designed and used a model which is a combination of design From Mulej and Hrast(2012), supplemented by social innovation Štukelj (2015), supported by 12 dimensions Sawhney et al (2006). We have analyzed the companies in the sample and placed them in relation to the stage of the life cycle. We\u27ve also checked whether the companies have identified the indicators of crisis. Data was analyzed specifically for small businesses and particularly for medium-sized companies. Where it made sense data were also compared and commented. The results are shown in tables and graphics

    Better Performance through Enterprise Governance and Management Process Innovation

    All the changes we are facing today take place within the global economic environment. These changes are caused by increasingly important inventions, suggestions, potential innovations, and innovations (and their diffusion to many users) resulting from crucially needed creativeness and innovativeness, new ideas, and constructive thinking; we are living in the era of different viewpoints and each of them originate from different knowledge, values, and experiences. This is why also the enterprise’s performance, and the ways of its achievement are continuously changing. One way of reaching enterprise competitiveness is provided by enterprise governance’s and management’s process innovation (GMPI) whose importance we will try to introduce here. We will discuss about enterprise policy, strategic management, innovativeness, competitiveness, and better performance of enterprises on the basis of GMPI.

    CORPORATE SOCIAL RESPONSIBILITY IN SUPPLY CHAIN AS FOUNDATION TO ENVIRONMENTAL INNOVATIONS

    V magistrskem delu obravnavamo družbeno odgovornost podjetij (DOP) v oskrbni verigi ter inovativnost, ki izhaja iz strategij podjetij da prestopijo okvire ustaljenega poslovanja in ustvarijo dodano (zeleno) vrednost svojim izdelkom in storitvam. Magistrsko delo je zastavljeno tako, da vključuje poglobljen strokovni in znanstveno-raziskovalni nivo in v ta namen uporabljamo pristop z raziskovanjem domače in tuje strokovne literature. Vsebinsko je naloga razdeljena na teoretičen del, kjer v drugem poglavju obravnavamo DOP, razloge vključevanja v norme, poslovno politiko in prakso ter dimenzije in področja, ki jih pokriva DOP. V tretjem poglavju govorimo o inovacijah, povezovanju DOP v inovacijski proces in iz tega izhajajočih družbenih inovacij. Četrto poglavje pa je posvečeno oskrbni verigi in vključevanju DOP v njo ter vzvodom in oviram za zeleno nabavo. Drugi del naloge zajema terensko raziskavo v podjetjih IMI plc, kjer smo izvajali anketo o družbeni odgovornosti podjetij in njeno izvajanje preko okoljskih inovacij, ki so odvisne od zakonskega okvirja, od pričakovanih koristi za kupce izdelkov in koristi podjetij samih, od splošne inovativnosti in od »zelene zrelosti« podjetja. V sklepu so povzete ključne misli in ugotovitve, ki smo jih pridobili skozi nastajanje magistrske naloge. Izsledki te raziskave bodo lahko služili vodstvu kot informacija, kako povečati konkurenčnost in hkrati prenoviti politiko podjetja v duhu DOP. Z razvojem strategije trajnostnega razvoja lahko podjetja namreč razumejo pomembnost svojega vpliva na družbo in okolje, kot rezultat tega pa spodbudijo sprejemanje ukrepov z merljivimi cilji.The master\u27s thesis deals with corporate social responsibility (CSR) in supply chain and innovations arising from business strategies to exceed the existing business and add (green) value to their products and services. Thesis contains a thorough professional and scientific research level. Therefore, the research of domestic and foreign professional literature is the used approach. Contents are divided into a theoretical part, where in the second chapter author describes CSR, reasons for its implementation in norms, business policy and daily business and dimensions and areas covered by CSR. The third chapter covers innovations, integration of CSR into the innovation process and the resulting social innovations. The forth chapter is dedicated to the supply chain and CSR\u27s integration into it and leverages and barriers to green purchasing. The second part of the thesis encompasses data on field research of IMI plc companies, where we performed a survey on corporate social responsibility and its implementation through environmental innovation, which depends on the legal framework, the expected benefits of the product to customers, companies themselves, general innovation and green maturity of the company. In conclusion, the key ideas and findings, gained in the process of research for this thesis, are summarized. The results of this study might serve the company management as useful information to increase competitiveness and renew the company policy in a spirit of CSR. With the development of a sustainable strategy companies can comprehend their impact on society and the environment, and as a result encourage the adoption of measures with measurable targets

    Assessment of Innovation Managers with criminal Law aspects as the crucial Criterium of Social responsibility

    Zgodovinskost človeka je obenem podoba njegove ustvarjalnosti, ki predstavlja izraz človekove specifične lastnosti. Ustvarjalnost pa je potrebno tudi vrednotno ocenjevati (v dobrobit človeštva) v skladu z zakonom zadostne in potrebne celovitosti skozi prizmo njenega doprinosa k doseganju celovite družbene odgovornosti in ne samo njenega enostranskega dela, gospodarjenja. Gospodarjenje je rezultat človekove ustvarjalnosti, hkrati pa predstavlja področje možne (in zahtevane) človekove ustvarjalnosti, saj je ustvarjalnost izhodišče in predpogoj za razvoj racionalnega gospodarjenja. Prav v procesu gospodarjenja se je potrebno izogniti utečeni miselnosti, vedno istemu, delnemu pogledu na določeno ekonomsko odločitev in ponavljajočemu se ekonomskem procesu izvajanja točno določenih korakov procesa gospodarjenja. Ekonomskega dogajanja v vseh štirih fazah gospodarjenja pa človek ne prepušča zgolj in samo »hladni« ekonomski logiki (četudi ima ta tudi normativno plat). V procesu gospodarjenja so se tako izoblikovali kriteriji, ki sicer praviloma ne sodijo na področje »čiste« ekonomske teorije, pa vendar dajo vsaki ekonomski odločitvi bistveno težo, saj predstavljajo vrednostni kriterij, ki pa ekonomski odločitvi doda, potrdi ali odvzame končni cilj - dobiček ali korist: etika in morala, pravo in družbena odgovornost. Z razvojem gospodarjenja so med ekonomskimi subjekti nastajala in obstajala vedno kompleksnejša obligacijska razmerja, ki jih je v življenjsko pomembnih družbenih razmerjih urejalo pravo. Poudariti je potrebno, da smejo in morajo (upoštevaje načelo racionalnosti ekonomskih subjektov celo morajo) ekonomski subjekti do pravnih norm zavzeti samo dve diametralno skrajni stališči: ravnajo v skladu z določili pravnih aktov, oziroma zavestno ravnajo v nasprotju z njimi. V procesu gospodarjenja se namreč z ekonomskega vidika lahko pojavi inovacija, ki da procesu gospodarjenja (ali njegovemu delu) etiketo učinkovitosti in uspešnosti (dobiček ali korist), vendar pa je z vidika družbene odgovornosti nesprejemljiva, z njenega ožjega vidika – pravnega, pa je lahko celo nelegalna, zato lahko da procesu gospodarjenja (ali njegovemu delu) etiketo nelegalnosti in s tem potrjene družbene nesprejemljivosti. Postopek opredeljevanja (ne)legalnosti je dolg in zahteven, zaradi česar ima (morda inovativna) ekonomska rešitev z vidika kazenskopravne ustreznosti ves čas status kvaziinovativnosti do dokončne odločitve pristojnega organa (pravnomočne sodbe v imenu ljudstva), s tem pa vprašanje opredeljevanja kvaziinovativnosti še ni zaključeno. Dokončna opredelitev kvaziinovativnosti je namreč mogoča šele ob celostni primerjavi ekonomskih in pravnih vplivov na kvaziinovacijo in končni odločitvi (ekonomski oceni) o njeni dokazani koristni novosti. Kazensko pravo kot skupek pravnih pravil določa vsebino, obseg in način udejstvovanja državne kaznovalne pravice. Kršenje kazenske zakonodaje je temeljna značilnost družbenega in individualnega pojava. V nekaterih skupinah socioloških teorij kriminalitete pa je mogoče razbrati tudi to, da so vzroki za pojav kriminalitete v temeljnem ekonomskem problemu gospodarjenja. Gospodarsko kazensko pravo (kot del kazenskega prava) je formalno gledano le pravni odziv na gospodarsko kriminaliteto, ki predstavlja celoto v določenem času in na določenem območju izvršenih kaznivih dejanj znotraj širše sfere gospodarstva. Gospodarsko kaznivo dejanje je protipravno dejanje, ki ga zakon, ko je posredno ali neposredno ogrožena pravna vrednota in dobrina iz sfere gospodarstva, določa kot kaznivo dejanje ter hkrati določa njegove znake in kazen zanj. Z našega vidika lahko nesporno opredelimo, da je gospodarsko kaznivo dejanje potrjeno nelegalna rešitev temeljnega ekonomskega problema, še vedno pa je iz ekonomskega vidika lahko inovativna.The historical development of a human being provides an image of his creativity, which reflects his specific characteristics. Creativity must be valued (for the sake of humankind) in accordance with the law of sufficient and necessary integrity through the prism of its contribution to achieving a comprehensive social responsibility and not just with regard to its unilateral work, management. Management is the result of human creativity and, at the same time, it represents the field of possible (and required) human creativity, which is the starting point and a prerequisite for the development of a rational management. In the process of management, one must avoid the established mentality, the partial view, which is always the same, of a certain economic decision and the repeating economic process of implementing particular management steps. However, in all four phases of management the economic development is never left to a mere »cold« economic logic (although it has a normative side). Thus, certain criteria were established in the process of management, which do not otherwise belong to the field of a »clean« economic theory, but give good weight to every economic decision. They represent the value criterion, which adds, confirms or diminishes the final objective - profit or gain: ethics and morals, law and social responsibility. The development of management made the developing and existing obligational relations between the economic operators which were, in the case of vital social relations regulated by law, increasingly complex. It is necessary to stress that, with regard to the legal norms the economic operators can and must (if considering the principle of rationality of economic operators), opt for only two diametrically opposite options: they can act in accordance with the provisions of the legal Acts, or they can act consciously contrary to them. Considering the economic aspect, the management process can result in innovation, which labels it (or its part) as effective and successful (profit or gain). However, the innovation is unacceptable from the aspect of social responsibility and might even be illegal, considering the more narrow - legal aspect. Therefore, it can also label the management process (or its part) as illegal and thus unacceptable in social terms. The procedure for defining (il)legality is long and exacting, Therefore the (perhaps innovative) economic solution is always regarded as quasi-innovative, if considering its adequacy in criminal justice terms, until the final decision is adopted by the competent authority (a final judgement in the name of the people). However, the issue of defining quasi-innovativeness does not end here. The final definition of quasi-innovativeness can be made only after a comprehensive comparison of the economic and legal influences on quasi-innovation has been made and a final decision (economic assessment) regarding its proven and useful novelty has been adopted. Criminal law, as an aggregate of legal rules, determines the contents, extent and manner of the practice of the State Penal Justice system. Violation of the criminal legislation is the basic characteristic of the social and individual phenomena. In some groups of sociological theories on the subject of criminality it is possible to establish that the reasons for the occurrence of criminality lie in the basic economic problem of management. The economic criminal law (as a part of the criminal law) is, in formal terms, a mere legal response to the economic criminality, which represents a whole in a certain period and on a certain area, where the criminal offences have taken place, inside the broader sphere of the economy.
