On February 26, 2014, Dr. Ted Butryn and Dr. Matthew Masucci spoke in the University Scholar Series hosted by Interim Provost Andy Feinstein at the Dr. Martin Luther King, Jr. Library. SJSU professors Ted Butryn and Matthew Masucci co-investigated on a two-year World Anti-Doping Agency grant, which examined female triathletes and their awareness of doping and the anti-doping movement. Dr. Butryn is a 2012 Salzburg Fellow and Professor of Sport Sociology and Sport Psychology in the Department of Kinesiology. Dr. Masucci is an Associate Professor of Interdisciplinary Sport Studies in Kinesiology. No full textIl volume contiene un’esposizione delle strutture fondamentali e dei princìpi che presiedono al diritto penale internazionale, nel suo attuale sviluppo.
Nella prima parte vengono analizzate le principali fonti ed istituti della materia, con specifica attenzione allo Statuto di Roma, che ne costituisce una prima codificazione. Oggetto della trattazione sono, tra l’altro, il principio di stretta legalità, con i suoi corollari; i contenuti della responsabilità penale internazionale; i crimini internazionali.
Nella seconda parte sono sviluppati i commenti a casi di particolare rilievo, emersi nell’esperienza applicativa fino ad oggi maturata.
Il testo, per ciò intitolato Strutture del diritto penale internazionale. Interpretazione, applicazione, fattispecie, viene costantemente aggiornato per offrire un’esposizione aderente all’attualità, diretta sia a chi si confronti per la prima volta con il diritto penale internazionale, sia ai cultori della materia

This paper analyses the criminal liability of legal entities subjected to
modifications according to d. lgs. 231/2001.
Such liability stays even after the transformation; on the contrary, in case
of merger, it is subjected to shifting from the original entity to that resulting

from the operation. In the division, to the purposes of bans and disqualifications,
law expressly requires the transfer of the branch of the enterprise in
which crime has been committed.
Valuing such formula and catching its systematic relevance we can hypothesise,
also de jure condito, that the responsibility of the entity resulting
from the division is subordinated to the finding of a relevant continuity with
the entity in which the presupposed crime was committed. The continuity
might be deduced from the preservation of the managers and from the unchanged
distribution of the powers of management and/or control of the entity;
it remains to be established whether such a requirement can be postulated
also in case of transformation and merger.
Finally the paper covers the problem of establishing whether after relevant
modifications of the entity its liability, however conceived, presupposes
further requirements, capable of consecrating what could be defined as a
blame upheld by factors of effective “personalisation” of the charge.

Se così fosse, si coltiverebbe una visione peculiare della legalità: ove si profili una cesura tra l'illecito, nella sua astratta definizione, e il modo di offrirne la prova nel processo, il sistema non potrebbe esimersi dal congegnare un rimedio di ordinamento che ristabilisca quanto la legalità impone. In questa prospettiva l'articolo rivisita i problemi fondamentali sollevati dai cosiddetti reati di sospetto, dalle presunzioni di offesa, dalle regole di giudizio sull'ascrizione della responsabilità penale
A note on optimal metering schemes
No full textA metering scheme is a method by which an audit agency is able to measure the interaction between servers (e.g., web servers) and clients (e.g., browsers) during a certain number of time frames. Metering schemes involve distributing information to clients and servers. Obviously, such information distribution affects the overall communication complexity. A metering scheme is said to be optimal if the information distributed to clients and servers is the minimum possible. Optimal metering schemes have been proposed by Naor and Pinkas [Lecture Notes in Comput. Sci., Vol. 1403, pp. 576-590] and Masucci and Stinson [Lecture Notes in Comput. Sci., Vol. 1895, pp. 72-87). In this paper we show a construction for optimal metering schemes, called the vector space construction, that generalizes previous constructions for optimal metering schemes
