Art. 31 - L’Autore, analizzando la clausola generale di rinvio contenuta nell’articolo emarginato nella quale il legislatore ha richiamato la disciplina delle “sanzioni amministrative” contenute nella l. 689/1981, ne sottolinea la portata problematica evidenziandone la complessità. Se da un lato, infatti, l’applicabilità dei principi generali era comunque assicurata dall’art. 12 della l. 689/1981; dall’altro lato la l. 287/1990 prevede anche sanzioni di tipo interdittivo, strutturalmente diverse da quelle pecuniarie previste dalla l. 689/1981 non solo, ovviamente, negli effetti, ma anche nelle modalità applicative. Ancora a proposito della portata del rinvio l’Autore pone il problema riguardo alle sanzioni che la l. 287/1990 commina a soggetti diversi dalle persone fisiche (imprese, enti, persone giuridiche); in particolare per quanto concerne la commisurazione della sanzione amministrativa, dal momento che l’art. 11 della l. 689/1981 reca tracce in equivoche di un modello “personalistico”, ritagliato sulla persona fisica. Ulteriore questione posta concerne l’individuazione del giudice competente a decidere delle opposizioni avverso i provvedimenti applicativi delle sanzioni previste dalla l. 287/1990. Infatti mentre la l. 689/1981 prevede una ben definita procedura di opposizione da svolgere davanti al pretore del luogo in cui è stata commessa la violazione, il successivo art. 33 stabilisce la competenza esclusiva del giudice amministrativo (individuato nel solo TAR del Lazio).
Art. 7 - L’Autore analizza puntualmente la contravvenzione introdotta in attuazione della d. CE 84/450 evidenziandone il carattere fortemente innovativo. La norma penale in commento costituisce una figura generale nella quale prende corpo l’intervento repressivo nei confronti della pubblicità ingannevole. La repressione penale, come sottolineato dall’Autore, assiste l’osservanza del provvedimento emanato dall’Autorità garante, in sede amministrativa; si tratta dunque di una tecnica incriminatrice che colpisce solo indirettamente la pubblicità ingannevole.
Art. 67 - L’Autore traccia brevemente la genesi della norma in commento e ne illustra struttura e funzionamento, soffermandosi sulla portata della sostituzione del testo della norma ad opera dell’art. 62 del d.legisl. 480/1992 e sottolineando come l’avvenuta formale sostituzione delle ipotesi di reato originariamente previste con violazioni di natura amministrativa fosse stata preceduta dalla depenalizzazione delle suddette contravvenzioni ad opera dell’art. 1 l. 706/1975 e dell’art. 32 l. 689/198.
Artt. 88-89 L’Autore, analizzando l’articolo 88 l.i., inquadra preliminarmente i rapporti esistenti tra la norma in commento e l’art. 473 co. 2 c.p., si sofferma quindi sulla descrizione delle condotte incriminate sottolineando come l’inquadramento della tutela penalistiva ad ulteriore salvaguardia dei diritti patrimoniali derivanti dal brevetto imponga un rinvio alla disciplina civilistica interna e internazionale sul tema. Di seguito, analizzando la previsione di cui al successivo art. 89 l.i., evidenzia le conseguenze dell’intervenuta depenalizzazione dello stesso ad opera dell’art. 32 della l.689/1981 e ricostruisce struttura e profili applicativi della norma in esame.
Art. 1 - L’Autore, dopo aver ricostruito la disciplina previgente e l’iter che ha condotto alla formulazione della norma in commento al fine di coglierne la portata innovativa ed inserirla correttamente nel contesto normativo, sottolinea come l’obiettivo dichiarato della novella che si dichiara dagli stessi lavori preparatori era quello di reagire con maggior vigore sanzionatorio alla “preoccupante diffusione della pirateria libraria” ed è questa la cifra che caratterizza la previsione in commento. L’Autore ricostruisce puntualmente la fattispecie soffermandosi poi sul problema dei rapporti con l’art. 171 l.a

Data Driven Discovery in Astrophysics
We review some aspects of the current state of data-intensive astronomy, its methods, and some outstanding data analysis challenges. Astronomy is at the forefront of "big data" science, with exponentially growing data volumes and data rates, and an ever-increasing complexity, now entering the Petascale regime. Telescopes and observatories from both ground and space, covering a full range of wavelengths, feed the data via processing pipelines into dedicated archives, where they can be accessed for scientific analysis. Most of the large archives are connected through the Virtual Observatory framework, that provides interoperability standards and services, and effectively constitutes a global data grid of astronomy. Making discoveries in this overabundance of data requires applications of novel, machine learning tools. We describe some of the recent examples of such applications

The prototype must support the highly distributed nature of the Euclid Science Ground System, with Science Data Centres in at least eight countries. There are strict requirements both on data quality control and traceability of the data processing. Data volumes will be greater than 10 Pbyte, with the actual volume being dependent on the amount of reprocessing required

In a certain time work agreement involving two parties, namely the P.G Mojo Sragen party and the worker, it is called a reciprocal agreement and therefore creates rights and obligations for the parties. If in the implementation of the rights and obligations between P.G Mojo Sragen and workers, one of the parties does not carry out their achievements, it will result in legal liability. The purpose of this study was to determine the process of agreement between P.G Mojo Sragen and workers, the applicable regulations and the rights and obligations of a certain time work agreement between P.G Mojo Sragen and workers, as well as legal responsibility if one of the parties made a mistake from the work agreement. The method used in this study is a normative approach because in this study, which are legal rules, legal principles in legal responsibility between P.G Mojo Sragen and workers. The type of research used by the author in this research is descriptive research to clearly describe the legal responsibility between P.G Mojo Sragen and workers. The results of this study indicate that in the process of implementing a work agreement for a certain time, prior to the occurrence of the agreement, the administrative requirements and legal requirements in accordance with Article 1320 of the Civil Code are: (1) Agreeing (2) Legal Capability (3) A certain matter (4) An lawful cause. At the time the agreement was signed with a certain time agreement P.G Mojo Sragen with workers that had been made by P.G Mojo Sragen based on a standard agreement. After the agreement, a binding legal relationship arises and gives birth to rights and obligations. If in the implementation one of the parties does not fulfill its rights and obligations, then it must be responsible on the basis of default in accordance with Article 1243 of the Civil Code and if one of the parties violates the applicable law, it can be accounted for based on unlawful acts in accordance with Article 1365 of the Civil Code
