El Derecho a la Educación de los Niños: Un análisis del caso Tailandés
Grado en DerechoLa educación es un Derecho Humano Fundamental garantizado por diversos instrumentos normativos que obligan a los Estados a respetarlo y fomentarlo. En muchas ocasiones se trata de la única oportunidad con la que cuentan los niños que se encuentran en riesgo de exclusión social para salir de la pobreza y labrarse un futuro que les permita participar de pleno en la realidad social y económica de su comunidad. A pesar de ser un derecho reconocido por la mayoría de Estados, se trata a su vez de una materia para la que los éstos cuentan con diferentes medidas de aplicación. Este hecho da lugar en muchas ocasiones al abandono por parte de los gobiernos de aquel sector de la población que no cuenta con los medios necesarios para acceder a esta herramienta. En este trabajo se analizará el caso concreto de Tailandia, país que servirá para hacer un estudio sobre la situación oficial de ratificación de los tratados sobre el papel en contraste con sus esfuerzos reales puestos en marcha a lo largo del tiempo para cumplir con los objetivos a los que se ha comprometido.Education is a Fundamental Human Right guaranteed by several legal instruments that bind States to its respect and promotion. In many cases, it is the only chance for children that are under risk of marginalization to escape poverty and make a better future for themselves, one that allows them to fully participate in the social and economic reality of their communities. Although it is a right recognised by most Nations, it is also a subject for which each country has different methods of enforcement. This fact leads in some cases to the government´s neglection of that sector of the population that does not have the necessary means to access education. This document will consist on the analysis of the specific case of Thailand, a State that will be the basis of a study that will allow to see the differences between the countries’ official position on the ratification of treaties and the real efforts that it has been implementing over the years to fulfil the goals it has set up itself to

El derecho internacional y europeo de los derechos humanos relativo a la práctica de la declaración del niño como prueba en el proceso penal
El objeto de estudio de esta tesis se centra en el marco normativo que rodea la práctica de la declaración de un niño cuando es sospechoso, acusado, víctima o testigo en el proceso penal. La tesis de este trabajo se fundamenta en que el derecho procesal penal se articula principalmente sobre los adultos y que los niños son un añadido. A través del estudio comparado de la normativa internacional relativa a la práctica de la prueba penal sobre los niños se destapan numerosas lagunas, vacíos y contradicciones entre normas de diferentes ámbitos jurisdiccionales que pueden provocar que los niños caigan dentro de esos huecos, provocando una desprotección, o una discriminación injustificada en su contra. El objetivo de este trabajo se ha centrado en analizar los lugares en los que las normas se entrecruzan, evidenciando los posibles fallos o limitaciones y proponiendo posibles iniciativas o cambios que pueden conducir a que el ordenamiento, en esta área de los derechos humanos, sea más garantista y equitativo.
El estudio inicia el recorrido a partir de un análisis histórico de los cambios en la forma de valorar la declaración del niño en el proceso penal El segundo capítulo de este trabajo analiza el marco internacional de los derechos humanos que prohíbe la coerción en el proceso penal aplicable los niños. Con este fin se analiza en primer lugar las declaraciones obtenidas a través de torturas y de tratos inhumanos o degradantes y en segundo lugar las declaraciones obtenidas a través de otro tipo de coerción como son el uso del engaño y de la trampa. El tercer capítulo estudia las garantías que han de acompañar las declaraciones de los niños en el proceso penal, para ello, se consideran el derecho a una evaluación personalizada, el derecho del niño a ser informado, la asistencia letrada, la presencia de los padres o tutores, la grabación en vídeo y la especialización en infancia. El cuarto capítulo, dedica su atención a los límites del derecho a la confrontación directa de la defensa cuando la víctima o testigo es un niño en el proceso penal, y estudia las diferentes medidas que se han implementado por parte de los ordenamientos nacionales y que han sido avaladas por la jurisprudencia internacional: medidas técnicas que permiten no apartar al niño de la sala del juicio; medidas que recurren al uso de la videoconferencia; la pre-constitución de la prueba en fase de instrucción y en último lugar se dedica al estudio del ejercicio de la dispensa del deber de declarar por parte del menor. El último capítulo se dedica al requisito de la corroboración y el uso del testimonio de referencia, la prueba circunstancial y la prueba pericial a través de los informes de los expertos testigos.The Convention on the Rights of the Child of 1989 was a milestone in the history of the normative framework of the United Nations. Since then, international law on the rights of the child has undergone an intense development in different spheres of the law. However, it is a normative text that does not reach all areas that impact on children and there are areas that remain without being studied. This thesis focuses on the normative framework that surrounds the evidence of children statements when they are suspects or accused, victims or witnesses in the criminal process. This is an issue of current importance because, unfortunately, children participate in the commission of crimes and are victims and witnesses of them, not only within the borders of the State but also beyond them. This dissertation shows that criminal procedural law is articulated mainly on adults and that children are frequently tangentially considered. Through the comparative study of international regulations regarding the practice of criminal evidence on children, numerous gaps and contradictions between international, European and national norms arise that can cause children to fall within the gaps, causing a lack of protection or an unjustified discrimination against them. The objective of this work has focused on analyzing the places where these norms intertwine, evidencing the possible failures or limitations and proposing possible initiatives or changes that may lead to a more equitable and fair legal framework in this area of human rights.
The study begins by analyzing the different ways in which child statements have been assessed by courts of law throughout history. The second chapter focuses on international human rights law framework that prohibits coercion in the criminal process when obtaining statements from children. To this end, torture and inhuman or degrading treatment are addressed firstly and secondly, statements obtained through other types of coercion, such as the use of deception and entrapment. The third chapter studies the safeguards that must accompany the statements of children in the criminal process that allow not only that children provide statements free of coercion, but also participate on an equal footing as adults. The safeguards that are considered in detail are the right to have an individual assessment; the right of the child to be informed; to have legal assistance; the presence of parents or guardians; video recording; and specialization of professionals. The fourth chapter devotes its attention on the limitations on the right to direct confrontation of the defense when the victim or witness is a child. The measures studied consider the use of technical means to limit confrontation, the admissibility of pretrial statements and last, testimonial privileges. The fifth chapter is devoted to corroboration as a requirement by human rights law when statements of victims are unavailable. La responsabilidad de proteger a los civiles : análisis de las resoluciones 1973 y 1975 del Consejo de Seguridad
Grado en Derecho y Grado en Relaciones InternacionalesLa doctrina de la Responsabilidad de Proteger surge como consecuencia de las grandes controversias generadas por el uso de la fuerza en las intervenciones humanitarias durante los años 90, ampliamente criticadas por cuestiones de efectividad, motivaciones, legalidad y legitimidad. En el año 2011 el Consejo de Seguridad aprueba las Resoluciones 1973 y 1975 amparándose en esta norma emergente, con el objetivo de intervenir en Libia y Costa de Marfil tras haberse constatado violaciones de derechos humanos que podrían constituir crímenes contra la humanidad. Este trabajo estudia la implementación de sendas resoluciones para comprobar si se puede decretar la legalidad de las intervenciones en Libia y Costa de Marfil bajo la doctrina de la Responsabilidad de Proteger.The doctrine of the Responsibility to Protect arises as a result of the great controversies generated by the use of force in humanitarian interventions during the 1990s, widely criticized regarding lack ofeffectiveness, motivation, legality and legitimacy. In 2011, the Security Council approved Resolutions 1973 and 1975 based on this emerging norm, with the objective of intervening in Libya and the Ivory Coast after finding violations of human rights that could constitute crimes against humanity. The rapes commited against the Yazidi women : a genocide? A study of the crime of rape as a form of genocide in International Criminal Law

Aunque su comisión fue reconocida en ciertas instancias de los juicios de Tokio y Nuremberg, la jurisprudencia de los Tribunales ad hoc de Ruanda y Yugoslavia fueron las primeras instituciones que definieron la violación en Derecho Penal Internacional. Con el establecimiento de la CPI, el crimen de violación fue incluido en el Estatuto de Roma, siendo reconocido de forma internacional como un crimen de guerra, un crimen de lesa humanidad y un modo de comisión de genocidio. La violación ha sido también definida en el documento anejo al Estatuto de Roma, los Elementos de los Crímenes. El Estado Islámico de Irak y Siria, en su guerra para establecer un califato, ha llevado a cabo una campaña de violencia sexual contra mujeres de minorías religiosas como las Yazidi. Los responsables del Estado Islámico deben ser considerados responsables por los crímenes cometidos contra estas mujeres en el territorio de Irak y Siria. El propósito de este trabajo es, por un lado, examinar la evolución de la definición de violación en Derecho Penal Internacional y aplicar dicha definición a los crímenes cometidos por ISIS contra las Yazidíes. Por otro lado, este estudio busca analizar cómo los elementos del actus reus de genocidio pueden ser cometidos por medio de la violación y considera cómo las acciones de ISIS en relación con las Yazidíes pueden ser cualificadas como genocidio por medio de la violación.Rape has been used as a tool of war throughout the history of mankind. Even though its commission was recognized in some instances of the Tokyo and Nuremberg trials, the jurisprudence of the Ad Hoc Tribunals of Rwanda and Yugoslavia were the first institutions to define rape in International Criminal Law. With the establishment of the ICC, rape was included in the Rome Statute, being internationally recognized as a war crime, a crime against humanity and a means to commit genocide. Rape has also been defined in the correlated document to the Rome Statute, the Elements of the Crimes. The Islamic State of Iraq and Syria in its war to establish the caliphate has carried out a campaign of sexual violence against women of religious minorities such as the Yazidi. The responsible members of the Islamic State should be therefore charged for the crimes being committed against women in the territory of Iraq and Syria. The purpose of this dissertation is, on the one hand, to examine the evolution of the definition of rape in International Criminal Law and apply the current definition to the crimes committed by ISIS against the Yazidi. On the other hand, this study aims to analyze how the elements of the actus reus of Genocide can be committed through rape and considers whether the actions carried out by the Islamic State towards the Yazidi could qualify as a genocide by means of rape
