Interactions entre le droit des sûretés sous le Code civil du Québec et la loi sur les banques
The purpose of this study is to provide a precise and exhaustive study as well as an analysis of the place occupied by the banking security under Quebec Law in relation to the coming into force of the Civil Code of Quebec on January 1st 1994.The author shall emphasize her research on specific elements that have changed with the existence of new rules of civil law and that will contribute to the creation of new conflicts between financing banks of specific classes of debtors under the Bank Act mechanism and the other creditors of the latter.A first step will be to review constitutional principles underlying conflicts between provincial private law and federal exclusive jurisdiction matters, an analysis being considered necessary in order to study specific conflicts that might exist along the overlap situations between the Civil Code of Quebec and the Bank Act.This text core shall emphasize on the nature of the right conferred to the bank by the banking security under the light of the new Quebec law of real security, the effect of article 1801 C.c.Q. in relation to the banking conventions, and the multiple interactions between the banking security and certain types of hypotheses
Recommissioning Law Reform
This article offers a critical analysis of expert Law Reform Commissions in Canada. The author traces the history of the idea of institutional law reform from its intellectual roots early in the twentieth century through its apotheosis in the 1960s and 1970s to its modern decline, which the author attributes to shifting cultural tendencies creating scepticism as to the value of law reform. The author argues for a reconceptualization of expert Law Reform Commissions, and his analysis proceeds in three stages. First, the author examines the concepts of law which are promoted by law reform and concludes that the widespread belief that explicit, official law (state legislation) is the superior juridical form is in fact erroneous. The author argues that formal legislation is not the only form of law, but in fact everyday practices (including non-linguistic ones) also constitute part of legal normativity. Next, the author contends that law reform is not the exclusive domain of the law reform commissioner, but in fact is carried out by judges, lawyers and all citizens every day simply by the performance of their daily activities. Finally, the author argues that in order to maintain their utility Law Reform Commissions must be willing to reimagine themselves. They must be willing to reduce staff and work with external personnel, they must reject narrow instrumentalist processes and focus on issues of broader relevance, and they must conceive of research projects not directly related to doctrinal categories of law and which are intended to create a product digestible by the entire population. The author concludes by arguing that, while there is a future for expert Law Reform Commissions in Canada, they must be willing to recommission themselves with a new focus

The presence of hospital foundations inside a public healthcare system raises the question of whether they are charitable organisations doing charitable acts and how they differ from state institutions. A charitable act is based on the notion of gift. A gift relationship, compared to a commercial relationship, is founded on sharing and mutual responsibility rather than common interests. Among friends and relatives, giving reveals strong and lively relationships. In modern society, giving also takes place between strangers. It reveals strong community ties. The charitable sector, including hospital foundations, is the most common form of giving among strangers. Those who participate in this sector show a high level of involvement in many sectors of society and have strong community ties. State action takes place irrespective of the quality of community ties, although it ultimately depends on it. Charitable action complements state action. However, state action remains essential since charity is alien to the concepts of justice and equity
Electronic mass media and freedom of expression in Germany, the United States and Canada
This thesis examines the constitutional guarantee of freedom of expression as applied to electronic mass media. It compares the different approaches adopted in Germany, the United States and Canada. After an overview of freedom of expression doctrine in general and the main features of the regulation of electronic mass media the rationalization of this regulation in freedom of expression doctrine is analyzed.The focus of this analysis is how electronic mass media have changed the traditional understanding of fundamental rights and freedoms as purely negative individual guarantees. This change occasions and necessitates a closer look at governmental regulation and the role of the state, and the different conceptions of freedom of expression that can be used to justify it
The vampires of Transylvania : ethnic accommodation and legal pluralism
This thesis presents a theoretical discussion of how legal pluralism and the idea of parallel systems of justice can address issues of ethnic accommodation.It is divided into four chapters: (I) an introduction why Transylvania has been selected as a site of analysis; (II) a brief presentation of the ethno-history of Transylvania; (III) an analysis of law focusing on the possibility of applying parallel legal systems, in contemporary states, taking as a case study how Romania might deal with Transylvania; (IV) finding conclusions between utopia and reality.The evolution of the ethnic composition of Transylvania over the centuries is used to illustrate the complexity of the legal and political issues that must be addressed. Several questions of legal theory are then addressed. When does a norm become legal? What is the relationship between Law and state institutions or the relationship between Law and society? Is Law a singular or a pluralist phenomenon? How is Law culturally, historically or politically determined? How can ethnicity or cultural membership be defined in legal terms?The two main justifications for accommodating ethnic minorities through parallel legal systems are then examined: the argument based on the collective rights of national groups; and the argument based on protecting the cultural continuity of a national group. The thesis suggests that thinking about parallel legal system must be grounded in the specific historical, political, ethnic, and legal context of a region.The goal of "The Vampires of Transylvania" is to challenge contemporary legal thinking rather than to provide an absolute final conclusion on the topic of parallel legal systems. Final answers in this field are possible only after legal mythology and ethno-cultural taboos have both been demolished
Scots law : how can and why should it survive?
This thesis has two main themes: that law is of primary importance to Scotland as a nation and to Scottish nationalism and that the distinctiveness of Scots law is threatened by a discernible tendency towards anglicisation or standardisation with English law. The thesis examines the nature of culture and nationalism in general, and in the Scottish context in particular, and discusses the foundational elements of Scotland's nationhood. Law is specifically considered in the latter two contexts. Thereafter, some elements which substantiate the claim of distinctiveness made for Scots law are identified and one view of the mechanisms by which it is becoming anglicised is presented. Finally, justifications for actively pursuing the survival of the Scottish legal system as a distinctive body of norms are outlined and action which could be taken to ensure that survival is discussed
European Community and human rights : the antitrust enforcement procedure facing article 6 of the European Convention on Human Rights
The Senator Lines' case, currently pending before the European Court for Human Rights, reveals a lack of procedural fairness of the European Antitrust enforcement under the terms of the European Convention for Human Rights. But in spite of a well-established concern for Fundamental Rights from the European Community, the later is still not bound by the Convention.That is why it is critical that the EC accede to the Convention following the example of its branches. Meanwhile, it is necessary to determine whether the Member States could be held responsible for the Community's acts that violate the rights protected by the Convention. That is the question the Court will have to answer in the Senator Lines' case. Nevertheless, the Council Regulation which organises the antitrust enforcement procedure must be reformed in order to ensure an indispensable balance of power
"Nothing in this act shall preclude any better ideas" : exploring the relationship between legislation and governance
The jurisprudence of Lon Fuller continues to provide important insights into the relationship between the design of legal institutions and the results that flow from them. This thesis explores Fuller's insights as a foundation for considering the place of legislation within contemporary governance. The challenges of contemporary governance involve a plurality of dimensions and participants. This means that the capacity of legislation to provide an effective response is more contingent than is often recognised. This thesis understands legislation as informing and being informed by an appreciation of the purposes to which that legal form might be put in complex regulatory contexts. An exploration of this issue, and an appraisal of how it contributes to understanding legislation as a medium of governance, sheds light on both the challenge of effective lawmaking in the modern political state, and practical concerns to which contemporary legal theory must respond

L’hypothèse du pluralisme juridique dans les sociétés démocratiques avancées
« Le droit n'est pas autant un fait social qu'une construction sociale. Le droit n'existe comme phénomène normatif que dans la mesure où il est reconnu à ce titre par les citoyens. L'idéologie de la modernité soutient essentiellement que (1) le droit est uniquement rattaché à l'Etat politique (centralisme); (2) qu'il ne peut y avoir qu'un seul ordre juridique correspondant à un seul espace géographique (monisme); et (3) que le droit est toujours le produit d'une activité explicite d'institutions telles que la législature (positivisme). Ni l'une ni l'autre de ces trois perspectives idéologiques n'est soutenable aujourd'hui comme hypothèse pour penser le droit dans les sociétés multiculturelles. Par contre, l'hypothèse du pluralisme révèle l'impact de divers ordres juridiques autonomes et concurrentiels dans nos vies quotidiennes. Elle nous permet de voir dans quelle mesure le sujet de droit est effectivement celui qui crée le droit. Enfin, cette hypothèse montre que le sujet de droit est celui qui rend possible le fonctionnement de toutes les institutions juridiques -- étatiques ou autres -- en leur accordant leur légitimité. La problématique fondamentale du droit contemporain a trait à la conciliation des divers ordres juridiques reconnus et créés par les citoyens et citoyennes.
