The different legal layers and their interaction are examined, taking into accounts not only the law as presented in the official texts but also the living law. The result is a very fragmented and peculiar system where different and specific legal situations must be faced by those who deal with law in this African country.L’article prend en considération les différentes sources du droit dans le système juridique des Comores qui sont considérées à travers la méthode stratigraphique. Les différents composants du système juridique comorien et leur interaction ont été examinés, et pas seulement le droit contenu dans les textes officiels, mais le droit vivant aussi a été regardé. Le résultat est un système très fragmenté et particulier, ou ceux qui entrent en contact avec le droit de ce pays africain doivent faire face à des situations juridiques différentes et spécifiques
Language, Law and Food
The language of law has been traditionally characterized by an extreme technicism and the use of a specific jargon whose comprehension is considered a prerogative of legal professionals. The situation is gradually changing. There is a general trend to make law more understandable to non-lawyers and to the normal people in general. This implies the use of a different, more colloquial, kind of language, that could be more familiar to ordinary people. On the other side, food today is no longer what humans eat to calm hunger, but has become an object of research, elaborations, and contaminations, an expression of the different world cultures and a social phenomenon. The links between food and law are as old as the concept of law. Many authors have been using such links in creative ways to express specific features of law. This is because the language of food and cooking offers legal scholars a lot of metaphors, comparing rules to recipes, and their combination to culinary processes. The paper considers the use of food related metaphors and language, and the relationship between law and food in an interdisciplinary perspective, to examine how food related topics can be used to identify different rules, norms, or prescriptions
African law in action
This article discusses the issue of the effectiveness of law in Africa, looking at it from a perspective different from those commonly used in dealing with this theme. It proposes an analysis of the interactions between traditional, religious and official law in the course of the historical development of African law through the lens of the stratigraphic method. The analysis takes into consideration the different legal layers that have been posed upon each other. The work focuses on areas of law that are not commonly considered in this regard; in addition, the discourse is conducted using examples taken from jurisdictions that are not normally present in debates on African law. This implies the use of references that are not commonly encountered in African legal literature, together with some from the most important and renowned authors.
