Il diritto che libera. Crisi del paradigma costituzionale e ascesa dell’etica neo-liberale

    No full text
As an analytic exercise in political theory, this essay is a short inquiry into the nature and causes of the ongoing process of erosion of parliamentary democracy in view of the ascending influence exercised, in many spheres of life, by the neo-liberal ideological paradigm on a global scale. On the one hand, the essay constitutes an attempt at shedding light on the historically significant, yet controversial, relationship between democractic theory, constitutionalism and liberalism. On the other hand, it examines some of the main features of the Gordian knot that joins neo-liberalism to liberalism. One of the main scopes of the essay is to address, and possibly answer, the question of the hidden normative assumptions of liberal theory for the purpose of establishing whether neo-liberal liberty is annihilating liberal-democracy. In doing so, special attention has been paid to the issue of the nature and function of law in the context at hand

L'utopia liberale realizzata. Dalla cornice libertaria all'ordine del rizoma

In the perspective of political philosophy, this essay is a short inquiry into the presuppositions and implications of the coalescence of libertarian and progressive ideas as envisaged by eminent thinkers of the French tradition such as Michel Foucault, Gilles Deleuze, and Felix Guattari on the one hand, and of the north-American one such as Robert Nozick on the other. The essay constitutes an attempt to shed light on the controversial relationship between the notion of libertarian framework and the concept of the order of the rhizome on the assumption that precisely such relationship is one of the main conditions for the intelligibility of the Foucauldian idea of liberalism as actualized utopia. The main purpose of the essay is to address, and possibly answer, the question of the risk inherent in turning nomad thought into the core of neo-liberalism

This essay constitutes a politico-philosophical short inquiry into the presuppositions and implications of the reduction of Michel Foucault’s research project to its bio-political dimension and of the coalescence of libertarian and progressive ideas that are at the heart of his understanding of liberal governamentality. The essay aims to shed light on the controversial relationship between the classical notion of liberty and its management within the liberal science of government as portrayed by the French philosopher. The basic assumption underlying our account is that such relationship is the ground for the intelligibility of the Foucauldian idea of liberalism as actualized utopia. Our main purpose is showing that the concept of sovereignty is not obliterated but rather reinforved by the risks inherent in the very functioning of liberal governamentality
