The common European asylum system and the social emergency of unaccompanied foreign minors
Get PDFSerena Baldin and Moreno Zago introduce the legal framework of asylum and illustrate the policies provided for unaccompanied foreign minors. Asylum is a form of protection given by a State on its territory to persons escaping persecution. After a brief explanation of the progressive assimilation of the constitutional concept of asylum to the refugee status regulated by the 1951 Geneva Convention, that has as a consequence the restriction of the potential beneficiaries of the asylum, the chapter intends to date back to the EU milestones in the ambit of the Common European Asylum System (CEAS) from the legal point of view (§ 2) and to put forward the present EU proposals elaborated to strengthen the asylum system in the Member States (§ 3). Subsequently, the phenomenon of unaccompanied foreign minors in the EU will be analysed (§ 4), pointing out the main aspects of “The Action Plan on Unaccompanied Minors” (§ 5), and the contributions that sociologysts and other experts can give in order to emphasize the importance of an approach that enables these minors to understand the new cultural references and to be understood with their own cultural heritage and their own experiences (§ 6)

No full textFor years, the Gross Domestic Product was used to measure the development of a country. The scientific debate has warned both the use of the indicator as a measure of economic growth, as it ignores the non-market goods and services, illegal activities, negative externalities or quality of public expenditure, both as a measure of well-being or quality of life. The remedies offered by international organizations seek to provide a more realistic measure of the social, political, economic and environmental performance of a country; however, the composite indexes proposed are mainly the result of a Western conception. The author, after having introduced the main indexes and the results applied to a set of European and Latin American countries, suggests an index based on the Andean cosmovision of buen vivir which highlights the relationship with the land and the community, the balance with nature and the psychological well-being

No full textThe collection "Europe of Migrations: Policies, Legal Issues and Experiences" brings together scholars from law, sociology, history, and political science with the aim of taking the stock of these topics. The volume shows that the EU and the European States are managing with great difficulties the recent flows of migrants. Although they should have several years of experience in this field, and notwithstanding the fact that they need migrants for their labor markets and for contrasting the demographic decline, the reality is that different political views and interests, inside single States and among States, do not facilitate the development of coherent policies and legal frameworks to tackle this issue. In spite of a number of good practices arising from NGOs and civil society and also from local and national authorities, as a whole the “fortress Europe” still seems unable to adopt effective policies to welcome and integrate migrants in accordance to the Charter of Fundamental Rights of the European Union
