On the sharpness of a certain spectral stability estimate for the Dirchlet Laplacian
No full textWe consider a spectral stability estimate by Burenkov and Lamberti concerning the variation of the eigenvalues of second order uniformly elliptic operators on variable open sets in the N-dimensional euclidean space, and we prove that it is sharp for any dimension N. This is done by studying the eigenvalue problem for the Dirichlet Laplacian on special open sets inscribed in suitable spherical cones

BENTHAUS, stn DW 2018, 22°37’S, 152°49’W, 770-771 m, 1 lv. DISTRIBUTION. — Known from New Caledonia (Dijkstra 1985) and the Hawaiian Islands (form gregoryi Dall, Bartsch & Rehder, 1938). Depth range 50-70 m (alive) (unpubl. data, coll. HD). Now also Austral Islands (new record), only loose valves at 500-770 m depth. REMARKS The present specimens are in all characters indistinguishable from the holotype from the Loyalty Islands. Living depth range 50-70 m (unpubl. data, coll. HD). Now also Society Islands (new record), only a single valve at 440-490 m depth. No full textNella procedura di negoziazione assistita le commissioni di certificazione vengono quindi coinvolte solo nella fase conclusiva della “trasmissione”, prevista dall’ultimo periodo dell’art. 2-ter del d.l. 132/2014. Tuttavia, nulla è detto circa l’effetto giuridico di tale tramissione; non è possibile rintracciare nella lettera della norma alcuna correlazione a condizioni di validità e/o efficacia, né tanto meno l’eventuale ritardo o omissione di tale adempimento sono in qualche modo sanzionati o sanzionabili. Si potrebbe quasi sostenere che le Commissioni di certificazione non abbiano alcun ruolo nella negoziazione assistita che è, invece, procedimento in cui la norma prevede un ruolo attivo e fattivo dei legali delle parti riservando alla Commissione di certificazione un ruolo passivo, di mera ricezione dell’accordo.
Lo strumento della negoziazione assistita nella materia lavoristica, rimettendo alle stesse parti del rapporto di lavoro la possibilità di compiere atti dispositivi con gli effetti dell’art. 2113 c.c. senza la necessità dell’intervento di una “sede protetta”, segna una discontinuità del percorso di simmetria tra inderogabilità e indisponibilità, che costituisce il fondamento teorico tradizionale della disciplina lavoristica. L’Autrice propone alcune piste interpretative volte a rintracciare nel combinato disposto delle norme applicabili, l’effettività del ruolo delle Commissioni di certificazione nella negoziazione assistita partendo dagli antefatti storico-normativi ed esaminando, con profilo critico, l’art. 2-ter d.l. 132/2014 nel più ampio quadro sistematico della fattispecie delle “sedi protette” di cui all’art. 2113 c.c.In the assisted negotiation procedure for labor disputes, the certification commissions are therefore involved only in the final phase of the "transmission", provided for in the last sentence of the art. 2-ter of the legislative decree 132/2014. However, nothing is said about the legal effect of this transmission; it is not possible to find in the letter of the rule any correlation to conditions of validity and/or effectiveness, nor is any delay or omission of such fulfillment in any way sanctioned or sanctionable. It could then be argued that the certification commissions have no role in assisted negotiation which is, instead, a procedure in which the law provides for an active role of the parties' lawyers and reserves the certification commission a passive role, of merely receiving the agreement . Assisted negotiation in labor matters, giving the parties to the employment relationship the possibility of carrying out dispositive actions with the effects of the art. 2113 c.c. without the need for the intervention of a "protected headquarters", marks a discontinuity in the path of symmetry between mandatory and unavailability, which constitutes the traditional theoretical foundation of the labor discipline. The Author hypothesizes some interpretations to trace, in the combined provisions of the applicable rules, the effectiveness of the role of the certification commissions in assisted negotiation, starting from the historical-regulatory background and examining, with a critical profile, the art. 2-ter legislative decree 132/2014 in the broader systematic framework of the case of "protected offices" referred to in art. 2113 c.c
