    Concierto interpretado por Si Qing Lu y Radostina Petkova. Lu capturó la atención del mundo al obtener el Primer Premio en el XXXIV Concurso Internacional Paganini realizado en Génova (Italia) en 1987. Petkova nació en Burgás. Allí recibió sus primeras clases de piano en el Liceo de Bellas Artes. Continuó sus estudios musicales en el Conservatorio Estatal Superior de Música de Sofía, donde finalizó su carrera de pianista con "Summa cum Laude". Al terminar realizó un postgrado en el mismo conservatorio y fue nombrada profesora (en licencia). En este concierto interpretaron obras de Johann Sebastian Bach, Ludwig van Beethoven, Manuel de Falla, Fritz Kreisler y Henri Wieniawski

    Il titolo della tesi è la deroga preventiva agli effetti della risoluzione per inadempimento, ovvero, se e in quale misura le parti possano decidere (limitare, ampliare, o escludere), già nel momento della conclusione del contratto, gli effetti della risoluzione per inadempimento. L’approfondimento di tale questione potrebbe servire a valutare meglio, in una prospettiva più realistica, le diverse ricostruzioni prospettate con riferimento alla risoluzione per inadempimento e a cogliere, al di là dei meccanismi tecnico-formali della retroattività e della irretroattività, i veri punti cruciali della disciplina degli effetti della risoluzione, e la reale situazione economica su cui essa incide. La parte introduttiva contiene una panoramica degli orientamenti attualmente esistenti in relazione al diritto italiano con riguardo alla derogabilità preventiva agli effetti della risoluzione. Inoltre, in questa parte introduttiva, è presente anche il piano della successiva indagine, che evidenzia il collegamento logico tra i quattro seguenti capitoli. Il primo capitolo riguarda il fondamento della risoluzione per inadempimento. Secondo l’autore, la tesi preferibile è quella secondo cui la risoluzione sarebbe un rimedio a tutela del sinallagma funzionale. Una volta accertato il sinallagma funzionale come il fondamento della risoluzione per inadempimento, il secondo ordine di problemi da affrontare è quello concernente gli effetti della risoluzione per inadempimento nel diritto italiano. Perciò, nel secondo capitolo si esamina il principio di retroattività e la disciplina italiana sulle restituzioni. Si è fermato soprattutto sulla questione della compatibilità tra la disciplina dell’indebito e la risoluzione per inadempimento. Il terzo capitolo riguarda la questione fondamentale della ricerca, e cioè la questione se la retroattività sia una necessità o una finzione, ciò innanzi tutto nel diritto europeo poi anche nel diritto italiano. La conclusione di questo capitolo è che il principio di retroattività nel diritto italiano, non è una necessità, ovvero, una scelta ontologica, ma è una semplice finzione. Si può dunque immaginare che, pure nel diritto italiano attualmente vigente, con la risoluzione, in realtà, il rapporto contrattuale non si sciolga, bensì subentri ad esso, su una linea continua, un ulteriore rapporto, volto a regolare le restituzioni quali oggetto di obbligazioni ordinarie, e dunque soggette alla disciplina generale delle obbligazioni, anziché a quella relativa all’indebito. Una volta contestata, nel modo che ho appena detto, la necessaria presenza del principio di retroattività, l’ultima indagine che si è rimasta da compiere è quella relativa all’ individuazione degli spazi concessi all’autonomia privata. Quindi, nel quarto e ultimo capitolo, si è posto tale domanda: si può derogare agli effetti della risoluzione per inadempimento, e, se sì, entro quali limiti lo si può fare? Alla luce del lavoro svolto nei capitoli precedenti, si conferma che, almeno in linea di principio, le parti possono regolare il loro rapporto contrattuale anche per la fase successiva alla risoluzione, purché venga comunque salvaguardata la sinallagmaticità del contratto. Si è dedicato, infatti, nella prima parte del quarto e ultimo capitolo, a esaminare alcuni gruppi di casi, in cui, clausole che escludono totalmente o parzialmente le restituzioni delle prestazioni già eseguite dovrebbero considerarsi pienamente valide ed efficaci, proprio perché permettono comunque alle parti, in concreto, di mantenere salvo il reciproco equilibrio del loro rapporto. Nell’ultima parte del quarto capitolo, si è cercato di individuare i limiti dell’autonomia prativa, che, secondo autore, sono fondamentalmente tre: la disciplina della responsabilità contrattuale (come, ad. es., art. 1229 c.c.), l’esistenza della “causa concreta” e la limitazione della pena privata.The title of the thesis is ‘the preventive derogation of the effects of the termination of contract for breach’. To be more precise, the question is ‘if and to what extent the parties may agree ( to limit, expand or rule), at the time of the conclusion of the contract, on the effects of its termination for breach’. This research may serve to better understand, in a more realistic way, the several reconstructions proposed with regard to the termination of the contract for breach and to catch, beyond the technical and formal mechanisms of retroactivity and irretroactivity, the critical points of the rules of the effects of the termination and its economic impact. The introduction offers an overview of the existing guidelines with regard the Italian law on the preventive derogability of the effects of the termination of a contract. Moreover, it explains the research plan, with the outline of the logical connection between the following four chapters. The first chapter deals with the legal basis of the termination of a contract for breach. According to the author, the preferable thesis is that the termination would be a remedy for the protection of the functional sinallagma. Once having confirmed that the functional sinallagma is the basis of the termination for breach, the next problems concern the effects of termination for breach under the Italian law. In order to deal with this kind of problems, the second chapter examines the principle of retroactivity and the Italian rules on restitution. The study is mainly focused on the question of compatibility of the institute of ‘indebito’ with the termination for breach. The third chapter deals with the fundamental question of the research, namely the question whether retroactivity is a necessity or a fiction, under both European law and Italian law. The conclusion of this chapter is that the principle of retroactivity in Italian law is not a necessity, that is, an ontological choice, but a pure fiction. We can therefore imagine that, even in currently Italian law, the termination, in reality, does not conclude the contractual relationship. On the contrary, a further contractual relationship takes over, on a continuous line, with the aim to regulates the restitution as subject of ordinary obligations. Therefore, the general rules on obligations apply, rather than those on “indebito”. Once challenged, as just said, the necessary presence of the principle of retroactivity, the latest part of the research deals with the identification of the space reserved to private autonomy. So, in the fourth and final chapter, the question should be: can we change the effects of the termination of the contract and, if such the case, to which extent? In the light of the results achieved in the previous chapters, it is confirmed that, as regards the contractual relationship, the parties may, at least in principle, regulate the subsequent moments of the termination, without prejudice of the contractual sinallagma. The beginning of the fourth and final chapter examines certain groups of cases in which the clauses that exclude totally o partly the restitution should be considered fully valid and enforceable, since the parties are still allowed to maintain the balance of their mutual relationship. The last part of the fourth chapter is dedicated to the definition of the limits to private autonomy. According to the author, there are, basically, three limits: the regulation of contractual liability (i.e. Art. 1229 c.c.), the existence of the “cause concrete” and, finally, the limitation of private punishment

    A thesis submitted in partial fulfilment of the requirement of the University of Wolverhampton for the Degree of Doctor of Philosophy. Accompanying video file could not be uploaded.This thesis is an investigation into the development of glass as an expressive medium in China through direct contact with Western methods of making, decoration and forming glass. The investigation proceeds through an analysis of the parallels between glass objects produced from Kangxi (1662-1722) to Qianlong period (1736-96), and contemporary practitioners’ (2000-2009), which is complemented by my own practice. The investigation mainly looks at three aspects and their inter-relationship within these strands. They are: 1) the history of glassmaking from 1696 to 1795 in the Qing dynasty with Western influences; 2) the analysis of Contemporary Chinese studio/academic glass within the imported UK model; 3) the development of my personal glass practice within this matrix. Practical work is of two components: reproductions of historical examples and personal creative pieces. The inter-relationship/comparison between these three strands seeks to identify themes, such as the influence of the imported models, reactions to them (the nature of hybrid), and the development of Chinese identity within glassmaking. The purpose is to draw similarities and differences from the comparisons in terms of philosophy, attitude, cultural reference and technique, between Qing and contemporary China, to provide general principles in practice and guidance for future development. Basic information has been gathered from a wide range of sources both in China and in the UK using libraries, museums and galleries / literature from books, journals, archives and websites. Some information has been derived from direct contact (emails, interviews, conversations and questionnaires) with practitioners and scholars. The nature of the research has involved the examination of real historical objects and their technical repetitions, visits to Chinese Universities and personal exhibitions. These investigations included the identification of almost all of the extant examples of the Qing dynasty and their examination in terms of the identified aims of the research, especially in terms of physical evidence within the objects themselves. A body of personal work has also been developed and presented as a case study and used as an investigative tool for analysing the contemporary movement and the making of suggestions. The techniques addressed in this research were developed as examples to illustrate the diverse possibilities of practice. The whole study has been complemented by practice, the outcome of the research naturally consisted of a written thesis and a body of personal work. The written part contains the interpretation of contemporary Chinese studio glass and the analysis of its actual influences from Western practice. Furthermore the comparison of historical experiences is given through the viewpoint of a glass practitioner. A series of similarities and differences and the experiences from other practical models (Western Studio Glass Movement) have been illustrated from the comparison, as well as a set of recommendations and a vision for future development in China. The use of visuals, including image comparisons, technical and process illustrations, drawings, videos and actual samples, are designed to give new insights on the research of Chinese glass and provides an added dimension for presenting and encouraging discourse within the research of Art & Design. Additionally, a comprehensive appendix at the end of the thesis records almost all of the existing Qing glass objects while concentrating on the highest quality of the same category both in and out of China. Further information on relative exhibitions, publications and contact lists are useful for those who are willing to pursue a further study
