Tracing and attaching bank accounts in EU cross-border insolvency proceedings

    No full text
Tracing and attaching bank accounts (“TAB”) is complex in cross-border insolvency situations. The paper tackles such complexities and spells out the instruments that insolvency practitioners may use in the EU context. Accordingly, the author dwells primarily on Regulation (EU) 2015/848 to detect the extraterritorial powers it confers to insolvency practitioners and explain how it governs the coordination between the lex concursus and the law of the State where the bank account is located when it comes to determining practicable attachment measures. The paper also clarifies when insolvency practitioners may resort to the European Account Preservation Order (EAPO) as an alternative pathway to national measures. Four special focuses conclude the analysis. The first concerns the future of EU harmonisation in TAB activity; the second compares intra and extra-EU TAB operations; the third and fourth examine the restrictions on TAB measures flowing from sovereign bank accounts and accounts frozen because of economic sanctions

    No full text
This paper sets out the author\u27s view of discourse analysis and illustrates the approach with an analysis of discursive aspects of marketization of public discourse in contemporary Britain, specifically in higher education. It includes a condensed theoretical account of critical discourse analysis, a framework for analysing discursive events, and a discussion of discursive practices (including their marketization) in late capitalist society, as well as analysis of samples of the discourse of higher education. The paper concludes with a discussion of the value of critical discourse analysis as a method in social scientific research, and as a resource for social struggle.

Plan BThe construction industry is one of the most dangerous industries in the United States. In order to compete in today’s industry, contractors must treat risk control like other essential company functions by allocating personnel and funding to ensure asset protection. An analysis was performed to identify deficiencies in the pre-planning practices of a general contractor located in northwest Wisconsin. The analysis identified losses associated with deficiencies in the risk management system as well as techniques contractors can utilize to significantly reduce their risk of experiencing human, equipment, environmental, and financial based loss. Guidelines for developing and implementing a successful pre-planning program were outlined as well key program components

The role of infrastructure investment location in China's western development

    No full text
Development of the western region is vital to the balanced growth of China. The author studies the impacts of infrastructure investment that may most efficiently alleviate the burden of geographical remoteness of the West. Having constructed the ?adjusted distance? to approximate the transport cost, which takes into account the effects of real distance and infrastructure development, the author defines the ?peripheral degree? to measure the effective remoteness of a province to an economic center. Using panel data for 1979?99 from the Chinese provinces, she shows that geographic attractiveness plays a significant role in aSolow-type growth determination model. Given the invariability of pure geographic position, progress in transportation facilities is essential to reduce the geographic handicap and to encourage the catching-up of the western region. The author?s simulation results show that the central transportation hubs (Hubei, Henan, and Hunan) merit most infrastructure investments, for they favor the development of many provinces, if regional balanced growth is considered as the prime objective. In particular, improvement in the transportation facilities in central hubs will have greater effects on western development than that in the western region by itself. Improvements in the transportation facilities of the central hubs substantially improves the geographic attractiveness of the western region by reducing the transport cost from the West to the Coast and by promoting the emergence of new economic centers in such hubs, which tends to modify the national economic geographic structure.Decentralization,Health Monitoring&Evaluation,Economic Theory&Research,Environmental Economics&Policies,Public Health Promotion,Economic Theory&Research,Achieving Shared Growth,Trade and Regional Integration,Economic Conditions and Volatility,Health Monitoring&Evaluation

Improving air quality in metropolitan Mexico City : an economic valuation

    No full text
Mexico City has for years experienced high levels of ozone and particulate air pollution. In 1995-99 the entire population of the Mexico City metropolitan area was exposed to annual average concentrations of fine particulate pollution (particulates with a diameter of less than 10micrometers, or PM10) exceeding 50 micrograms per cubic meter, the annual average standard in both Mexico and the United States. Two million people were exposed to annual average PM10 levels of more than 75 micrograms per cubic meter. The daily maximum one-hour ozone standard was exceeded at least 300 days a year. The Mexico Air Quality Management Team documents population-weighted exposures to ozone and PM10 between 1995 and 1999, project exposures in 2010, and computes the value of four scenarios for 2010: A 10 percent reduction in PM10 and ozone. A 20 percent reduction in PM10 and ozone. Achievement of ambient air quality standards across the metropolitan area. A 68 percent reduction in ozone and a 47 percent reduction in PM10 across the metropolitan area. The authors calculate the health benefits of reducing ozone and PM10 for each scenario using dose-response functions from the peer-reviewed literature. They value cases of morbidity and premature mortality avoided using three approaches: Cost of illness and forgone earnings only (low estimate). Cost of illness, forgone earnings, and willingness to pay for avoided morbidity (central case estimate). Cost of illness, forgone earnings, willingness to pay for avoided morbidity, and willingness to pay for avoided mortality (high estimate). The results suggest that the benefits of a 10 percent reduction in ozone and PM10 in 2010 are about 760million(in1999U.S.dollars)annuallyinthecentralcase.Thebenefitsofa20percentreductioninozoneandPM10areabout760 million (in 1999 U.S. dollars) annually in the central case. The benefits of a 20 percent reduction in ozone and PM10 are about 1.49 billion annually. In each case the benefits of reducing ozone amount to about 15 percent of the total benefits. By estimating the magnitude of the benefits from air pollution control, the authors provide motivation for examining specific policies that could achieve the air pollution reductions that they value. They also provide unit values for the benefits from reductions in ambient air pollution (for example, per microgram of PM10) that could be used as inputs into a full cost-benefit analysisof air pollution control strategies.Montreal Protocol,Public Health Promotion,Global Environment Facility,Air Quality&Clean Air,Health Monitoring&Evaluation,Montreal Protocol,Air Quality&Clean Air,Health Monitoring&Evaluation,Global Environment Facility,Transport and Environment
