La movimentazione di materiali in ambito costiero, disposta per le più diverse finalità - ripascimento degli arenili, lotta all'erosione costiera, mantenimento dei fondali, realizzazione di infrastrutture, attività di dragaggio - pone problemi assai rilevanti, in particolare per quel che concerne il riparto di competenze fra i soggetti abilitati a rilasciare i provvedimenti autorizzatori per i diversi tipi di intervento. Complice anche una legislazione regionale non omogenea, l'assetto competenziale appare tuttora incerto e variabile, stante anche una giurisprudenza costituzionale non chiarificatrice.The immersion into the sea or the deposit in coastal zones of materials – from dredging activities, too – raise very important problems for environmental protection. Set out to pursue the most various purposes (to mention some: shoreline restoration, fight against coastal erosion, depth maintenance in harbour zones, realization of infrastructures, laying of cables and pipes down into the sea), material handling into the sea and in coastal zones represents an activity with a high impact on environment, fit for altering in a significant way the morphology of areas and, potentially, for irretrievably damaging local ecosystems.
To such a delicate question the legislator has some difficulty in giving an adequate answer. Material handling into the sea or in coastal zones comes out to be committed to a congeries of rules, building up a framework of law which appears plainly fragmentary and incoherent. Unavoidably, the asystematicity of the legal framework reverberates on the complex system of competences of public authorities who are given the power to issue the required authorizations for the several kinds of activities; it’s a system which appears to be uncertain and changeable, also because of the presence of a not homogenous regional legislation

The role played by the decree of urgency in the implementation of the Government’s
policy, the use of the ‘question’ of confidence made by the Government, the
submission of the so-called maxi-amendments are tiles of a mosaic, all contributing
to clarify which is the weight of the parliamentary majority (or, as the system seems
to move towards a “de facto unicameralism”, the majority in one of the two chambers)
in its relationship with the Government itself: that is, if it is still holding the
ability of sustaining an interlocution, being able at least to take part in the drafting
of the acts it is being asked to approve; or if we are facing a significant shift towards
the executive branch in the decision-making balance; or if the actual power
relationship developed itself in such a way as to suggest that we might at times be
facing some sort of (crypto)assemblearism

Public participation in environmental decision-making is one of the three ‘pillars’ of the Aarhus Convention (1998), which, as a mixed agreement, applies to the EU institutions too. Nevertheless, the EU Treaties do not contain specific provisions with regard to participation in environmental matters, which therefore draws on the general provisions of TEU end TFEU. In turn, Regulation (EC) No 1367/2006 (the so-called Aarhus Regulation) only provides for a participation in the elaboration of EU plans and programmes relating to the environment, but not in other cases, such as the prepara-tion of policies and of legal drafts. Within the framework of the White paper on governance (2001) and the so-called ‘Better regulation’ system, the Commission strives to interpret participation in its mildest sense, that is mere consultations. In this context the Commission also relies on the digital plat-form Have your say, the functioning of which, however, still presents many problematic issues, not least the one relating to the low attendance of the public. A brief overview of some consultations re-garding environmental-related topics seems to constitute an effective ‘litmus paper’ of the functioning of the platform, in particular for what concerns the low rate of participation
