In the first part ''Introduction in Maritime Proprietary Law'' the author deals with the definition and sources of maritime proprietary law. He also elaborates the problem of ownership and other proprietary rights on ships. Finally, the author explains the position of various persons involved in the employment of ships (shipowner, operator, manager, carrier, maritime agent etc.). In the second part ''Liability of the Shipowner'' the author primarily deals with the various cases of shipownerʼs liability based on tort. Special attention is paid to the legal issues related to the limitation of shipownerʼ liability. In the third part ''Contract for the Employment of Ships'' the author gives a systematic analysis of the various types of contracts for the employment of ships (contracts of carriage of goods, contracts of carriage of passengers, contracts of towage and contracts relating to other maritime services). He further deals with important and complicated topic of carriage performed by several carriers. The matter of charter by demise is particularly elaborated. The final chapter of this part is devoted to the problem of the law applicable to the contracts for the employment of ships. In the fourth part ''Marine Averages'' the author analyses internal and international law and practice related to the general average, collisions at sea and salvage. He points out the important role of the ship master in the event of a marine accident. The final part of the book is entitled ''Marine Insurance''. The author defines the institute of marine insurance and elaborates its economical importance, historical development and organization. Special attention is paid to the legal sources of the law of marine insurance. The most important legal source - the contract of marine insurance is particularly elaborated. The author deals with different types of marine insurance like hull insurance, cargo insurance and liability insurance. Various examples of maritime contracts and documents are enclosed to the book. The author divided subject matter of his book into the following parts: Part I – ''Introduction''. The author elaborates on the object, purpose and methods of his scientific research. Part II – ''Definitions of basic terms in the context of multimodal traffic law''. In this part the author explains the important terms such as: transport, traffic; conventional, combined and multimodal transport and traffic; law, traffic law, transport law, low of freight forwarder. Part III – ''Sources of the law of multimodal traffic''. All sources of the law of multimodal traffic are classified into two main categories: primary (international) sources and secondary (national) sources. Various international conventions and ''soft-law'' rules are analyzed, as well as relevant Croatian laws. Part IV – ''Basic features of the work related to the contract of multimodal traffic''. The author deals with following topics: definition of the contract on multimodal traffic; essential and non-essential elements of the contract; formation of the contract, conclusion of the contract, contracting parties, types and importance of multimodal transport (traffic) documents, amendments to the contract, termination of the contract. Part V – ''Duties, rights and liability of the multimodal transport operator''. At the beginning of this part, the author deals with the duties of the operator (exercising due diligence; taking in charge of the goods; performing the transport; issuing the multimodal transport document; delivering the goods to the consignor). This part also contains elaboration on rights of the operator (remuneration for his services; reimbursement of expenses; right to be informed about dangerous and valuable goods). At the end of this part, special attention is devoted to the liability of the operator (liability for loss or damage to the goods; liability for delay in delivery; liability for acts of his servants, agents and independent sub-contractors; limits of operator’s liability). Part VI – ''Duties, rights and liability of the consignor''. The most important duties of the consignor are elaborated (exercising due diligence; preparing goods for transport; delivering goods and related documents to the operator; loading the goods, payment of freight, informing operator about particulars related to dangerous and valuable goods. Rights of the consignor are also analyzed, as well as his liability toward the operator.     Pravno uređenje morskih luka je jedno od najsloženijih pitanja pomorskoga prava. Važnost ove tematike je još veća nakon osamostaljenja Republike Hrvatske i uvođenja tržišnog gospodarstva. Ova knjiga prvi put cjelovito i sustavno obrađuje ovu temu. Knjiga je podijeljena na 13 poglavlja. Prilog knjizi su i tekstovi relevantnih zakonskih propisa. Također je vrlo vrijedan iscrpan popis literature, te bilješke uz tekst.The extensive text of the book is divided into thirteen parts. Part I is an introduction. Part II is a historical review, of the legal status of the sea ports and coast in the territory of the Republic of Croatia until the coming into force of the Sea Ports Act of 1995. The author describes various legal acts ranging from Roman law to the Maritime Code of 1994. Part III is a historical review of the legal status of the seaports and coast on the territory of the Republic of Croatia after the coming into force of the Sea Ports Act of 1995.This act stipulates two types of ports (those open for public traffic and those for special purposes). The author points out some problems: transition of socially owned ports, legal status of a port object (inmovable assets), priority concession, relationship between priority concession and free zone. Part IV deals with the relationship between concession charge, communal charge and water charge. In the maritime domain (including the port territory) the concessionaire is obliged to pay a concession charge for economic exploitation or special use of the maritime domain. At the same time he must pay a communal charge to the county authorities and o water charge to ''Croatian Waters''. The author argues that the concession and communal charges are identical. He points out the legal problems of interpretation in the jurisprudence and jurisdiction of the Croatian superior courts. In conclusion, he thinks that the problem has not yet been solved. Part V consists of the cadastre and land register of sea ports as maritime demesne. Part VI is a detailed account of the legal status of the ports of Split, Rijeka and Ploce (seaports open to public traffic on international significance for the Republic of Croatia). Also, the author discusses the international treaty concluded between Croatia and Bosnia and Herzegovina in connection with free transit through the territory of the Republic of Croatia in and from the port of Ploce and through the territory of Bosnia and Herzegovina in Neum (1998). He thinks that the treaty does not serve Croatian interests. In conclusion, the author proposes solutions de lege ferenda. Part VII describes the legal status of Croatian seaports and ports in internal waters which are open to passenger and cargo traffic. In particular, the author focuses on the new laws: the Maritime Code (1994), Seaports Act (1995), Waters Act (1995) and Ports in Internal Waters Act (1998). He analyses similarities and differences between particular provisions concerning the questions of division of ports, port activities, port authority, concessions for port activities, and transformation of social ownership. In Parts VIII-XI, Italian, Slovenian, Bosnian-Herzegovian and Montenegrin legislative solutions are elaborated. Part XII includes the relevant solutions of the new Croatian Act of Maritime Demesne and Sea Ports which come into force on October 15, 2003. In Part XIII, the author spells out his concluding remarks. The book is written clearly and concisely. It is a valuable work in the field of maritime law.     Ovo je djelo nadopunjeno i prošireno izdanje knjige istoga autora: Međunarodno pravo mora i izvori međunarodnog prava (1989.) To je bilo potrebno između ostalog i zato što je u međuvremenu usvojen Sprazum o primjeni XI. dijela Konvencije UN o pravu mora (koja je tek 1994. stupila na snagu), zatim je donešen Pomorski zakonik RH, a došlo je i do daljnjeg razvitka sudske i arbitražne prakse vezane uz međunarodno pravo mora. Knjiga je podijeljena u 3 dijela: ''Pravo mora u doba mira'', ''Pravo mora u oružanim sukobima'', te ''Razgraničenje morskih prostora''. Knjiga je obogaćena kronološkim pregledom više od 50 mnogostranih međunarodnih konvencija, te kazalima.The author divided the subject matter of this book into the following parts: Part I - ''Law of the Sea in Peacetime''. This part begins with elaboration on historical development of international law of the sea. It continues with the analyses of the legal regime of different maritime areas (internal waters, archipelagic waters of the archipelagic states, contiguous zone, high seas, international seabed, international straits and canals). The end of this part is devoted to the legal status of merchant ships, warships and other vessels staying (or sailing) in different maritime areas during the peacetime. Some very important topics are elaborated in this chapter such as the innocent passage through the territorial sea, duties of a foreign ship staying in a port of a coastal state, transit passage in international straits, legal position of ships on the high seas, immunity of warships and other government ships operated for non-commercial purposes, etc. Part II - ''Law of the Sea in Armed Conflicts''. At the beginning of this part the author gives an overview of international conventions and other sources of maritime law of war. He continues with the analysis of restrictions in maritime warfare. There are four groups of those restrictions. The first group is related to the protection of specific persons (wounded, sick and shipwrecked persons, prisoners of war, and civilians). The second group of restrictions is related to the methods of warfare. The third type is related to the objects of war. Finally, the last type of restrictions is connected with the prohibited use of some kinds of weapons. The author points out the necessity of the enforcement of humanitarian law at the time of war. Some other very important topics are also explained in this part, such as the neutrality in maritime warfare, rights and duties of the parties involved in maritime warfare as well as of the neutral parties. The legal status of the enemy and neutral ships and merchandise is particularly elaborated. Part III - ''Delimitation of Maritime Areas''. In the first chapter of this part the author analyses legal rules related to the state boundaries and delimitation of the sea. The second chapter of this part is of utmost importance. The first Chapter is devoted to the oil pollution from ships in general, with an emphasis on the necessity of international unification of legislation for both the victim of pollution and the party liable for its occurrence. The second Chapter provides a summary of the fundamental features of the 1969 Civil Liability Convention and the 1971 Fund Convention. The third Chapter deals with the amendments of the ''old'' regime. For this reason, the author elaborates on the most significant provisions of the 1992 Conventions, pointing out the differences between the ''old'' and the ''new'' regime. The fourth Chapter examines the oil pollution laws of the USA, which has not accepted the international convention system. The fifth Chapter deals with the analysis of the admissible claims for pollution damage in accordance with the Conventions. In the sixth Chapter the author elaborates on the liability regime regulated by the Croatian maritime legislation. She analyses the provisions of the Maritime Code, which have been adjusted to the 1992 Convention. Finally, Chapter seven provides an overview of a number of problems related to the application of the two liability regimes, and gives an insight into the future of the international oil pollution system. The author concludes that the presented oil pollution compensation regime has contributed enormously to the protection of the marine environment. The book is written clearly and systematically.     U radu se analizira uspješnost međunarodnih konvencija i protokola s obzirom na postignuti stupanj unifikacije pomorskog prava. Uočavaju se poteškoće u pogledu donošenja i postizanja šire prihvaćenosti pojedinih konvencija i protokola. Iznose se prijedlozi za otklanjanje i ublažavanje tih poteškoća. Posebice se proučava postignuti stupanj unifikacije međunarodnog uređenja materije prijevoza stvari morem, općeg ograničenja odgovornosti brodovlasnika kao i pomorskog prijevoza putnika i prtljage. Ukazuje se na to da svako od tih pitanja uređuje više konvencija i protokola što se ocjenjuje nepoželjnim. Osobita se pažnja posvećuje položaju RH s obzirom na njenu obvezanost tim međunarodnim ugovorima. Iznosi se i argumentira prijedlog da RH otkaže Međunarodnu konvenciju za izjednačenje nekih pravila o teretnici iz 1924. (Haška pravila) i Konvenciju o ograničenju odgovornosti za pomorske tražbine iz 1976. Naglašava se potreba sadržajno jednakog pravnog uređenja pojedinih pitanja na međunarodnoj i internoj razini. Odluka o obvezivanju nekom konvencijom ili protokolom mora biti temeljena na stručnom mišljenju i donesena u cilju zaštite interesa hrvatskog pomorskog poduzetništvaThe lack of uniformity is a major problem of international maritime law. In this paper the author analyses the level of unifi cation achieved in respect of three important subjects: carriage of goods by sea, limitation of shipownerʼs liability and carriage of passengers by sea. The author points out main obstacles for achieving wider acceptance of maritime conventions and protocols relating to these topics. He also makes some proposals for overcoming and reducing such obstacles. Special attention is devoted to the conventions and protocols ratified by the Republic of Croatia. The author suggests that Croatia should denounce the International Convention for the Unification of Certain Rules of Law relating to Bills of Lading (Hague Rules 1924) as well as the Convention on Limitation of Liability for Maritime Claims, (LLMC 1976) remaining the party only to their respective protocols (Visby Protocol 1968 and SDR Protocol 1979 amending the Hague Rules; 1996 Protocol amending LLMC). He strongly recommends that substantially similar rules of maritime law should be applicable at the international level as well as at the internal level

    Autor objašnjava smisao načela forum non conveniens u pravu zemalja common law pravnog sustava. Analizira noviju sudsku praksu u svezi s primjenom toga načela u sporovima o utvrđivanju granice odgovornosti brodovlasnika. Autor podržava stajalište izraženo u najnovijim sudskim odlukama da sud koji primjenjuje granice odgovornosti brodovlasnika utvrđene Konvencijom o ograničenju odgovornosti za pomorske tražbine iz 1976. nije zbog toga nužno prikladniji da odlučuje od suda koji primjenjuje (niže) granice odgovornosti utvrđene Konvencijom o odgovornosti vlasnika pomorskih brodova iz 1957. godine.The author elaborates the meaning of the principle of forum non conveniens in the common law legal system. He analyzes the court decisions applying this principle in the matter of global limitation of the shipowner's liability. The author agrees with the opinion expressed in the latest court decisions that the court applying the limits of liability prescribed in 1976 Convention on Limitation of Liability for Maritime Claims is not necessarily ''more convenient forum'' than the court applying the (lower) limits of liability prescribed in 1957 International Convention relating to the Limitation of Liability of Owners of Sea-going Ships

    Rad predstavlja usporednu analizu odredaba Atenske konvencije o prijevozu putnika i njihove prtljage morem, iz 1974., koje reguliraju pitanje zastare tražbina za naknadu štete zbog smrti ili tjelesne ozljede putnika i odgovarajućih odredaba u propisima hrvatskog zakonodavstva. Daje se kritički osvrt na neke odredbe Pomorskog zakonika RH. Zaključuje se da hrvatski Pomorski zakonik uglavnom prihvaća rješenja Atenske konvencije, ali postoje i određeni propusti koje valja ispraviti.The author is comparatively analysing the provisions of the 1974 Athens Convention relating to the Carriage of Passengers and theit Luggage by Sea regulating the time-bar for actiones for damages arising out of the death of or personal injury to a passenger, and the corresponding solutions of Croatian internal law. At the internal level, the time-bar for those actiones has been regulated by the provisions of the 1994 Croatian Maritime Code and by the Croatian Law on Obligations. The author gives a critical review of some provisions of the Croatian Maritime Code. He concludes that the Maritime Code mainly incorporates the solutions of the international instrument. However there are some failures which have to be corrected
