Global Justice and Regional Metaphysics: On the Critical History of the Law of Nature and Nations
Get PDFThis paper provides a sceptical discussion of the recent critical (postcolonial) historiography of the law of nature and nations (jus naturae et gentium). It argues that the critics and defenders of the early modern law of nations (jus gentium) both assume the in-principle existence of a global conception of justice against which the historical failures or successes of might be guaged. In calling the existence of such a conception into question the paper argues that early modern natural law and jus gentium was even more 'regional' or 'Eurocentric' than its critics allow for. As a result, its limits may not be measured against a universal conception of justice that it failed to embody, but only in relation to its internal divisions and its external conflicts with extra-European empires and cultures

No full textAbstractMergers and acquisitions (M&A), leveraged finance and capital markets are important markets for professional advisory firms such as investment banks, financial sector law firms and the ‘Big 4’ consultancies. While market totals are widely published in free sources, finding both sub-totals and lists of deals is more difficult and usually requires access to paid-for sources. In this article Ian Hunter considers the best paid-for and free sources and looks at the caveats in relying on them. In essence, he asks ‘why don't the sources agree?’ and provides a ‘jargon buster’ and a critique of sources in M&A, leveraged finance and capital markets.</jats:p
