La prova del licenziamento ritorsivo nella legge 179/17 sul whistleblowing
The essay examines the legislative protection of the whistleblower introduced by Act n. 179/17, focusing on a specific aspect, namely the rule on the burden of proof. As Act no. 179 establishes a reversed burden of proof in favour of the employee, the analysis compares this rules with those otherwise applicable in the case of retaliatory, discriminatory and unfair dismissals. Effectiveness and Problematic Aspects of the EU Framework on Psychosocial Risks
The aim of this chapter is to reconstruct the regulatory framework concerning the prevention of psychosocial risks (PSRs) in the context of the European Union law and to assess its effectiveness. The analysis retraces the references to this topic, from the first Health-and-Safety at Work action programme of 1978 to the Communication on the Modernisation of the EU Occupational Safety and Health Legislation and Policy published by the Commission in 2017 . Specifically, it highlights how these references found their roots and were translated into EU law, both through hard law sources, as interpreted by the Court of Justice, and soft law regulatory instruments, issued by the EU institutions or the social partners at European level. In this reconstruction, the author points out how the key question underlying the development of the EU regulatory system in the field of PSRs does not concern the actual existence of a solid protection basis at hard law level – which can be properly identified within the 89/391/EEC directive as interpreted by the ECJ and the European Commission – but rather to the effectiveness of such protection and to the functionality of soft law in ensuring its implementation and detailing its content
Viaggio nella “terra di mezzo”, tra contratti leader e pirata
Moving from a reconstruction of the position of Confsal, as an “autonomousμ trade union, in the current system of industrial relations, and from a comparison between the collective agreements signed by Cifa- Confsal and those of Cgil, Cisl, and Uil, the essay investigates on the use of the concepts of “leaderμ and “pirateμ agreements. This permits to address, on a more general level, issues connected to the measurement and comparison of unions’ representativeness as well as to the definition of sectors. In this perspective, the author wonders on the possibility to shift from a mere comparison between subjects to a comparison of contents; as well as from a comparison (of subjects and contents) based on quantitative data to a comparison that includes qualitative aspects
Presenze mediali.
The book "Straniere in Sardegna" records the results of some researches on the experiences and representations of migrant women residing on the island. In particular, the present article is dedicated to their representation in local mass media channels. What is the role of local daily newspapers in the interaction between natives and new residents inside a territory? What kind of images do they spread about the female migrant population to the Sardinians readers, and more generally out in the territory? The answers are based on results of a research conducted in 2006, when all the articles on male and female migrants issued by the two major local newspapers during the previous years had been gathered, classified and analysed.
After reconstructing the general picture on foreigners presence on the territory as suggested by the newspapers, the author lingers on creating more detailed female profiles
Grown up Youngstairs. New Profiles of Immigrants Girls in Italy
Who are and how do the young daughters of immigration live in Italy today? What are the reference values and the expectations for the future of the girls coming from a foreign family that grow up within the Italians? What attracts them and what do they reject of their lifestyles and of Westerner cultures? What are the major obstacles they meet, within their family and outside, in their path into social integration? What strategies of identity do they enact in order to live with the daily dilemma filled of callings from such different cultures?
This paper narrates the final results of the research project Media, mode e amori dei figli dell’immigrazione [Media, fashions and loves of the children of immigration], an investigation that aimed mainly at the questions mentioned above, and that identified in the analysis of cultural costumes, of the expressive styles and of the sentimental relations of the territory, still unknown to Italian literature, useful to penetrate the private sphere of these existences. On the basis of the stories of the 45 young migrants interviewed, all between 17 and 25 years of age, resident in Rome and in the adjacent provinces, the author proposes the recourse to a new social category – that of the adult youths – as an ideal type to synthesizes certain reoccurring traits in the biographies of the young immigrant women in Italy
Cross-cultural couples are one of the most important indicator of integration between natives and immigrants living within the same territory. This is an emergent phenomenon today in Italy. Using the data of some researches conducted by the author from 2003 to 2008, this article sketches out the profiles and the family life of cross-cultural couples formed by an Italian wife/husband and an immigrant partner: the first encounter, the beginnings of the relationship, the decision to live together and to marry, the family’s and friends’ reactions, the differences that create problems and/or opportunities in the private life
L’architettura di palazzo Francesconi. Peruzzi tra Roma e Siena
On the basis of new documents and a detailed analysis of its fabric, the article examines the architecture of the Palazzo Francesconi at Siena, one of the many buildings traditionally attributed to Baldassarre Peruzzi in his hometown, but never yet subjected to any detailed study. After a summary discussion of the chronology of the building, closely linked to the fortunes of its patron, and after firmly establishing that the work began in 1520, the author examines its architecture in detail. She points out the close links with architectural research in Rome, and especially in the circle of Leo X, in the second decade of the sixteenth century, but also the differences and similarities with the contemporary context in Siena itself, from the viewpoint of plan, use of materials, design of the main façade and type of arcaded courtyard.
In the second part of her article the author presents some hypotheses on the configuration of the initial project, which was only partially put into practice, and reviews the successive changes in programme. The regular plan and the façade with superimposed orders – a case unique of its kind in Siena in the first half of the sixteenth century –, the patron Bernardino Francesconi’s network of political and family contacts, the dating, personal relations with the Sienese artistic environment, and the traces identified in other projects of the architect and in some of his drawings, permit the author to argue convincingly for the project’s attribution to Peruzzi. A less schematic division of the chronology of Peruzzi’s activity as an architect, traditionally separated into an ante 1527 in Rome and a post 1527 in Siena, results from this. The article thus suggests a greater mobility of Baldassarre and lends force to the idea that he continued to have relations with Siena throughout his career, as would also be confirmed by other episodes recalled in the article
The Prevention of Psychosocial Risks in European Union Law
The paper retraces the references to PSRs in the EU context, from the first Health-and-Safety at Work action programme of 1978 until the 2012 European campaign on the topic. More specifically, it analyses how these policy references found their roots and were translated into EU law, both in hard law sources, as interpreted by the Court of Justice, and in soft law regulative instruments, either as institutional documents or social dialogue outcomes. In this reconstruction, the author highlights how the key question underlying the development of the EU regulative system in the field of PSRs does not concern the actual existence of a solid protection basis at hard law level – which can be properly identified within the 89/391/EEC directive as interpreted by the ECJ and the European Commission – but rather to the effectiveness of such protection and to the functionality of soft law in ensuring its implementation and detailing its content
