No full textPresentació per par de Jordi Ferrer del 4rt Premi Internacional de Cultura Jurídica, 2024, què en aquesta ocasió s’atorga al professor Ricardo Caracciolo. Crear i atorgar quest premi va ser un dels projectes amb el què va començar la Càtedra de Cultura Jurídica de la Universitat de Girona, un premi que suposa homenatge i reconeixement, però no només, i que inclogui discussió acadèmica, debat, etc. sobre l’objecte del premi, el seu pensament, etc. No entrem en els detalls dels mèrits teòrics de l’obra de Ricardo Caracciolo, de la seva teoria del dret, de la seva filosofia analítica de la què hem après tots. Jordi dona rellevància a un altre tipus de mèrit, que no es troben en els currículums al ús, en el cas de Ricardo; menciona el tarannà que coexistia al Instituto de filosofia del derecho, de la Universidad de Buenos aires, una manera de dedicació a la vida intel·lectual caracteritzada per l’honestedat i l’acceptació de la crítica, així com l’aproximació i dedicació al jovent; un altre dels trets diferencials de Ricardo ha estat la visió de continuïtat entre la investigació i la transmissió del coneixement. No full textAbordaré un text de Ricardo que és un text lateral a la seva obra. I crec que aquest text pot projectar certes preocupacions contemporànies i, per tant, mantenir viva la flama de Ricardo Caracciolo. Exposaré dues cites ben conegudes, i després intentaré mostrar-los més endavant com es vinculen amb la preocupació d'aquest text, encara que espero que sigui obvi. A la primera part reconstruiré molt ràpid les parts que m'interessen de les idees de Caracciolo; assenyalaré ràpid algunes crítiques que li han fet aquí, però passaré molt ràpid per això i aniré alguns aspectes i observacions puntuals. Després plantejaré una crítica que em sembla una mica més substancial, i finalment intentaré connectar el que diu Ricardo Caracciolo sobre els drets col·lectius amb els drets comuns, que és una discussió molt actual i alguns diuen que és idèntica en el text: hi ha els drets col·lectius, s'analitzen i en quin sentit hi ha un plus conceptual quan es parla o s'usa el terme drets col·lectius per oposició a la de drets individuals. Caracciolo defineix els drets col·lectius per oposició als drets individuals, tenint-ne en compte el contingut. Then I am going to propose a criticism that seems a little more substantial to me, and finally I am going to try to connect what Ricardo Caracciolo says about collective rights with common rights, which is a very current discussion and some say that it is identical in the text: collective rights exist, they are analyzed and in what sense there is a conceptual plus when the term collective rights is spoken or used as opposed to individual rights.
