Inadequacy and ineffectuality: Hong Kong's consumer protection regime against unfair terms in standard form contracts
This article examines the current Hong Kong consumer protection regime relevant to unfair terms in standard form consumer contracts and attempts to demonstrate the deficiency in this protection framework and the need for urgent reform. In particular, the article takes a closer look at the seemingly ineffectual Unconscionable Contracts Ordinance (Cap 458), as compared with its UK legislative equivalent, as well as other factors possibly affecting the pursuance of claims by consumers. To this end, the article attempts to explain why the current protection regime in Hong Kong is not being effectively utilised and suggests how this might be rectified in the interests of local consumers.published_or_final_versio
Culture of indifference : dilemmas of the Filipina domestic helpers in Hong Kong
In this study, an examination of the everyday experiences of the contract migrant Filipina domestic helpers exposes a culture of indifference which pervades the Hong Kong society on all levels--individual, community, and judiciary. At the centre of the abuses inflicted upon the Helpers is the employment contract with extraordinarily restrictive terms which promotes abuse by many employers. This study also looks at the transnational informal social infrastructure which has been organized by the Filipino community to mediate the hostile working environment engendered by the indifference of the global economic and political climate upon their lives.
Faced with the task of implementing new policies for controlling labour migration into Hong Kong, the legislators have focused on the end result and finding the means with which to accomplish their goal. Embedded within this process are unexamined cultural mores and practices. Although the starting point is to benefit the community, by providing domestic helpers to serve the middle and upper class households, too often the abusive consequences to individual migrants are ignored as the women become the means to an end. Migration has often been viewed as an aberration to the notion of the sedentary community. Treated as an anomaly, it is the migrant who problematizes simple theoretical positions of social organization and structure. The migrant is always treated as the one who does not conform to the ideal community and is conveniently merged into existing social categories, such as the lower status of women in Hong Kong, and the lower status of domestic workers -- relegated thereby to the periphery of the society's consciousness
Southern Chinese patients with systemic lupus erythematosus in Hong Kong have low vitamin D levels
BACKGROUND: Vitamin D insufficiency has been linked to pathogenesis of autoimmune diseases. This study aimed to measure serum 25(OH)D level in patients with systemic lupus erythematosus (SLE) in Hong Kong and to evaluate association between serum 25(OH)D level and disease activity. METHODS: Serum 25(OH)D level was measured by radioimmunoassay in SLE patients and healthy controls. Lupus disease activity was determined by SLE disease activity index (SLEDAI), serum anti-dsDNA antibody, C3 and C4 levels. RESULTS: Fifty-two SLE patients with mean ± standard deviation disease duration of 15.5±8.6 years were recruited. Five patients had active lupus disease. Five (9.6%) patients had serum 25(OH)D levels <30 nmol/L. Serum 25(OH)D level was significantly lower in SLE patients compared to age- and sex-matched controls (n=52) [45.5±12.3 vs 51.1±12.6 nmol/L, P=0.02]. Serum 25(OH)D levels were not found to be related to SLEDAI, elevated anti-dsDNA antibody, low C3 or C4 levels or medications. One vitamin D insufficient patient had low serum albumin-corrected calcium. Serum 25(OH)D levels were found to correlate negatively with estimated glomerular filtration rate (r= –0.30, P=0.03) but was not different between patients who had normal and impaired renal function (P=0.38). Admission guidelines for patients with chronic obstructive pulmonary disease in Hong Kong
Chronic obstructive pulmonary disease (COPD) is a common condition in Hong Kong and many affected patients require frequent admissions to hospital. The indications for hospitalisation for Chinese COPD patients have not been described for the Hong Kong setting. We have therefore compiled these criteria which artificially divide the admission process into acute, sub- acute, and elective. Patients should be immediately hospitalised if there is an exacerbation complicated by severe dyspnoea or respiratory failure. Sub- acute admission is indicated for stabilisation of severe COPD complications and elective admission is indicated for long term treatment rationalisation.published_or_final_versio
