R. v. Ferguson and the Search for a Coherent Approach to Mandatory Minimum Sentences under Section 12
No full textSince the early days of the Charter, uncertainty prevailed about constitutional exemptions as a remedy for breaches of the section 12 guarantee against “cruel and unusual treatment or punishment”. It was unclear whether an offender could be exempted from the application of a mandatory minimum sentence that would produce an unconstitutional result in the unique circumstances of the case. The Supreme Court of Canada recently decided this issue, ruling in R. v. Ferguson that constitutional exemptions are unavailable under section 12. However, the author argues that uncertainty lingers in the wake of Ferguson because the Supreme Court failed to resolve the underlying issue, which is how to address sentencing provisions that operate constitutionally in most cases but have unconstitutional effects in rare cases. Viewed in its jurisprudential context, Ferguson suggests that section 12 provides little protection to individuals whose exceptional circumstances render the application of a mandatory minimum sentence cruel and unusual

Haemorrhagic kidney syndrome of Atlantic salmon, Salmo salar L.
No full textThis report describes a new syndrome affecting farmed Atlantic salmon on the Canadian east coast that has resulted in increased morbidity and mortality in affected stocks. The major pathological findings are apparent only microscopically and include renal interstitial haemorrhage and acute tubular necrosis and tubular casting. As a result, the disease has become known as haemorrhagic kidney syndrome (HKS). Affected fish are lethargic and anorectic, and lark external lesions. Clinically, HKS fish are anaemic, hypoproteinaemic and hyperosmolalic, with increased serum concentrations of sodium and chloride. At necropsy, internal changes ranged from apparently normal to include one or several of the following: swelling and/or patchy reddening of the kidney, pale gills, exophthalmos, serosanguinous ascites, darkening of the posterior intestine and splenomegaly. Ultrastructurally, viral inclusions were found in the cytoplasm of erythrocytes of HKS fish, and there were unusual electron-dense inclusions within the tips of renal tubular microvilli of HKS fish. The significance and relevance of the ultrastructural findings to HKS are unknown. Virus isolation was attempted using CHSE, RTG-2, FH-10, BE and EPC cell lines; no virus was isolated. Bacteriological analysis failed to reveal significant pathogens. Analysis of tissues for heavy metals and pesticides was negative. Assays for clostridial toxins, lipopolysaccharide and verotoxins were negative. Ideological Drift and the Forgotten History of Intent
No full textIt would no doubt surprise many readers of contemporary Equal Protection scholarship to hear intent doctrine described as one of the major racial justice victories of the Brown v. Board of Education era. Instead, under the account familiar to most contemporary readers, the institutionalization of intent was a conservative development, marking a turn away from racial justice concerns in the mid- to late 1970s.
Drawing on archival and other historical source materials, this Article contends that the former account in fact represents the true genesis of intent doctrine in Equal Protection jurisprudence. During the Plessy v. Ferguson era, restrictive doctrines barred racial justice advocates from challenging laws based on their invidious intent. Intent doctrine arose in the aftermath of Brown as a response by progressive actors to the ways that these Plessy-era doctrines allowed rampant Southern evasion of Brown’s desegregation mandate.
Understanding this progressive history of intent doctrine has important implications. There are strong reasons to believe that these early progressive struggles to establish intent-based invalidation helped facilitate the 1970s-era conservative turn in intent doctrine that progressive scholars today decry. Thus, although the normative valence of intent doctrine shifted from progressive to conservative in the early to mid-1970s, progressive and moderate Justices on the Court were slow to realign their own doctrinal preferences. As a result, the Court’s progressive wing rarely resisted—and at times aided—the conservative doctrinal developments of the mid- to late 1970s.
The long history of intent therefore may help us to better understand the genesis of a phenomenon that scholars have long observed: the realignment of Equal Protection doctrine away from racial justice aims. And the long history of intent suggests that it is not only politics, but also doctrine, that plays a key role. Thus, while changes in popular sentiment serve as the backdrop to shifts in the Court’s normative orientation, it is the cooptation of progressive doctrine that renders such shifts familiar and unobjectionable to the Court

Dynamical systems on networks
No full text"We obtain results for two distinct dynamical models: the Kuramoto model, a general model for coupled oscillator systems, and a model for opinion formation in social networks. Our main focus is on understanding the fixed points of these systems and their stability. For many models the stability of such fixed points can be studied with a Laplacian matrix. We give a formula for the inertia of these matrices, characterizing the real parts of the spectrum, by relating them to another matrix depending on the network topology. We then study the Kuramoto model, and in particular, the phenomena of synchronization, when all oscillators rotate at a common frequency, which corresponds to a fixed point. This phenomenon is well-known to depend on the natural frequencies of the oscillators and, more specifically, that the chance of synchronization increases if the natural frequencies are more similar. We then give upper and lower bounds for the volume of the set such frequencies in frequency space. Our bounds can be formulated in terms of sums over spanning trees which we further use to deduce that the volume is intimately related to the number of spanning trees for dense networks. We also characterize the structure of fixed points of the Kuramoto model by showing that every fixed point corresponds to a lattice point in a certain set which records how the phase-angles wrap around cycles in the network. As a consequence, under mild conditions, we derive the rate of growth of the number of fixed points as we consider increasingly large graphs with fixed topology. We also consider a model for opinion formation in social networks. More specifically, we characterize the global minima of an energy functional, intuitively the ``most stable"" configurations, when the network is ``balanced"" as well as show that the number of stable configurations can increase as we increase the strengths of the relationships in the network. Finally, we describe an algorithm for generating certain random networks. These networks are generalizations of Erd\H{o}s-R\'{e}nyi graphs with correlations between pairs of edges depending on the particular pattern they create. Mr. Kilback
Our yearbook staff and their teacher advisor, Mr. Hart,
are to be highly commended for their diligent work in providing
this annual publication for our school.
A major event this year was the comprehensive school
evaluation by personnel from the Regional Office. The evaluation
identified certain areas of program, procedures, equipment, and
physical facilities which needed attention by the staff and school
board.
Another development was action by the school board to assure
greater control over students behaviour. Related to this issue
was the formation of a parent/student/teacher advisory committee
for consideration of matters of common concern, and participation
by many parents in noon supervision throughout the winter months.
The popular movement this year was "back to the basics," with
its conflicting interpretations and viewpoints. A gradual change
to a more highly structured curriculum is evident, with increased
emphasis on standardized testing at various grade levels.

No full textThe integration of corporate sustainability within operations remains an important and fundamental challenge for business. This paper first consolidates and then builds upon the EABIS-supported activities of Cranfield School of Management with business practitioners. It focuses on the performance and evaluation criteria relating to determining corporate responsibility (CR) value.
The paper begins by categorising components of CR in terms of decision-making levels and business case requirements. It then describes a methodology for establishing CR issues with the prioritisation of stakeholders before linking this relationship onto business benefits and shareholder value drivers. Using illustrated models and worked examples, sections within the paper provide further practical advice and guidance for developing and populating elements within the framework. Additional sections then complement the application of the CR Value-chain framework, with a chapter on performance measurement that explores the key performance measure characteristics required to underpin the performance element of the framework. The final chapter describes decision-making support tools, such as financial appraisals and risk evaluations, which also underpin the shareholder value approach and should be integrated within this corporate sustainability value management framework.
A key purpose of this approach is to support the integration of sustainability performance management processes and systems within business practice. It explores methods for making more explicit the issues surrounding CR and financial value. It also provides useful approaches for helping businesses select, measure and evaluate performance for internal CR strategies, policies and processes. Some analytical methods are considered for identifying the costs and benefits from sustainability-related issues, projects and new ventures, including discussions with regard to harmonising existing business functions.
