Pojęcie prawa administracyjnego i nauki prawa administracyjnego w koncepcji V.E. Orlando
The notion of administrative law and science of administrative law in the concept of V.E. OrlandoThe purpose of this article is to demonstrate the influence of German writers, first of all the pandectists, on the thought of V.E. Orlando and the role they played. Orlando was the founder and constructor of Italian public law scholarship. The paper is based on the research of F. Longchamps de Bérier, but also M.S. Giannini, A. Sandulli and S. Cassese. The article describes three issues-problems. The first concerns the reasons for and conditions of the study of V.E. Orlando, particularly historical conditions. The second focuses on the principal theses of his manifesto. The last question is dedicated to one of the major handbooks of administrative law by this author — Principi di diritto amministrativo. The results confirm the opinion of F. Longchamps de Bérier and S. Casses, that the conception of V.E. Hamiltonian formalism for weak turbulence of inertial waves in rotating fluids
We present the Hamiltonian description of incompressible rotating fluid by using the Clebsch variables. We find the transformation which allows us to present the three-wave interaction Hamiltonian in normal variables in simple explicit form. We analyze the three-wave interaction amplitude and find new anisotropic spectra. Finally we study the convergence of integrals and present the kinetic equation
PEDAGOGICAL IMPLICATIONS V.E. FRANKL’S ANTHROPOLOGY
Niniejszy tekst opiera się na założeniu, iż nie ma sensu podejmowanie tematyki dotyczącej koncepcji wychowania człowieka, bez uprzedniego wprowadzenia określonych założeń antropologicznych, odpowiadających na pytania „kim jest człowiek?” i „jakie są jego kluczowe cechy?”. Na tej podstawie do analizy wybrano koncepcję wiedeńskiego psychiatry Viktora Emila Frankla, opierającą się nie tylko na gruntownych, opisanych wycinkowo w tekście założeniach antropologicznych, ale przede wszystkim odpowiadającej na kluczowe dla pedagogiki, szczególnie wychowania, pytanie o miejsce sensu życia w egzystencji człowieka. Można założyć, iż to najważniejsze dla człowieka pytanie, jest jednocześnie kluczowe w jego wychowaniu i wokół niego powinny kształtować założenia dotyczące wychowania. W związku z tym w artykule zanalizowano trzy elementy antropologii V.E. Frankla pod kątem ich implikacji pedagogicznych, tj. człowieka jako istoty duchowej, intencjonalnej oraz wolnej i odpowiedzialnej.This text is based on the assumption that we can consider the problem of man’s education based on the adoption of certain anthropological assumptions, i.e. first we should answer the questions: “who is a man,” “what are the most important human traits.” On this basis, the author chose to analyze the concept of Viennese psychiatrist Viktor Emil Frankl. This concept is based on strong anthropological assumptions, and some of them have been described in the text in the pedagogical context (i.e. man as a spiritual, intentional, free and responsible creature). This concept answers the question (crucial for pedagogical considerations, especially upbringing) for the place of the meaning of life in human existence. We can assume that the most important question for a man is crucial to his upbringing. Therefore, the concept of man’s education should be built around the answer to this question
The Cancelled Duel Between R.B. Apollonsky and V.E. Meyerhold: From the History of Russian Theater During the Epoch of Revolution
In the beginning of April 1917 a conflict burst out in the troupe of the Alexandrinsky Theatre: a number of prominent actors brought an accusation of aesthetic and political nature against director V.E. Meyerhold. The immediate reason for this was Meyerhold’s act – the director attended the meeting of “theatrical figures” convened by F.A. Golovin, the Commissioner of the Provisional government, not being among the persons elected to participate in the meeting of the troupe. In particular, artist R.B. Apollonsky compared V.E. Meyerhold with a famous friend of Nicholas II – G.E. Rasputin. Therefore, having ignored the accusations in “modernism”, he reacted harshly to the comparison with Rasputin. Outraged by this, Meyerhold called Apollonsky out to a duel. As a result, the duel did not take place, but the story was covered in press in unfriendly to Meyerhold light. The author concludes that Meyerhold represented in press after the February Revolution as a representative of the “old regime”, during this period was trying to distance himself from the fallen monarchy, actively assimilating the radical vocabulary. The isolation of Meyerhold in the circles of theater community took place after the described incident and was likely to make it easier for him in future to join the party of Bolsheviks

An Explorative Study on Brokers Influence on Sellers Legitimacy in Friendly Acquisitions: A comparative and cross-case analysis of four public acquisition transactions
Intentional or friendly acquisitions as argued in existing research are being practiced increasingly for past couple of decades, and yet the focus towards the selling company’s perspectives is observed to be relatively low compared to that of acquirers. Moreover, sellers’ position in acquisitions is often perceived as an action to counteract unforeseen/unplanned activities, whereas the recent trends of such acquisitions don’t abide by this assumption. Sellers are increasingly practicing strategically planned exits and within this narrow field of seller-initiated acquisitions, sellers that involve a broker to facilitate the acquisition transactions are put under perspective in this report. Within this novel field of research, this thesis explores the impact of selling firm’s legitimacy & broker’s impact on acquisition transactions that eventually lead to realization of higher returns to the seller. In order to achieve the research aim, systematic approach that consisted of two underlying approaches, theoretical and technical, was conducted. In the first, theoretical, phase of the research, selective literature on selling company’s underlying legitimacy aspects and broker’s orientation/type, functionalities, and driving incentives was surveyed. Precisely, the factors that were perceived as controlling factors in valuation of the seller by the acquirer were collectedly put in a framework. Observed factors in the first phase of the research lacked the literature that observed the interconnections and relationships among such underlying factors, therefore relevant justification to conduct a further technical research of acquisitions was in order. Further, in the second aspect of the methodology, an attempt was made to extend the proposed framework from the theoretical approach. A systematic approach was undertaken in order to conduct a total of four case studies categorized under two brokers and further into brokers individual cases of one early and a late maturity stage seller. Following the individual case analysis, comparative case analyses (among late-late and early-early sellers), and a cross-case analysis across the four sellers was conducted. The results of such comparative analysis provided grounds for the build up of patterns among late and early stage sellers, whereas the cross-case analysis provides the overlap of such patterns throughout the cases, which in turn are the propositions and generalized findings of the overall research. Besides such patterns and propositions, additional underlying factors to firm’s internal & external legitimacy, and broker were observed and incorporated in the afore-established framework. Both aspects of research approaches, when aligned together, reveal the importance of high impacting (1) development phase of the seller, (2) sellers formed alliances, its (3) socio-political legitimacy, (4) exit strategy planning, (5) involved broker’s incentives, (6) broker's human capital, and (7) broker initiated competitive negotiations on the over all acquisition transaction. Besides, the high impacting underlying factors, five propositions are formulated that show the impact and how such underlying factors can compensate each other when a seller’s undergoing acquisition. Further, besides the general findings, results from comparative case analyses reveal the findings precisely valid in the late or early maturity stages of the selling company. These findings are discussed further as patterns that were observed in both early and late maturity stage sellers. Relevance of this research is highly valuable in terms of the attempt it makes to bridge the observed academic gap in the field of seller-initiated acquisitions. On the other hand, the practical relevance of this study is the general findings and the maturity stage specific findings that provide an entrepreneur/manager to formulate a high impacting exit strategy that maximizes seller’s returns in the acquisition transactions by involving brokers.Technology, Policy and ManagementValues Technology and InnovationManagement of Technology (MOT
