    Wydział Prawa i Administracji: Zakład Prawa Międzynarodowego i Organizacji MiędzynarodowychPraca zawiera analizę odpowiedzialności organizacji międzynarodowych za działania ich funkcjonariuszy w powszechnym prawie międzynarodowym, ze szczególnym uwzględnieniem praktyki funkcjonowania UE. Praca odnosi się wyłącznie do reguł wtórnych, stanowiących konsekwencję czynu międzynarodowo bezprawnego dokonanego przez organizację międzynarodową, skodyfikowanych w Draft Articles on Responsibility of International Organizations. W pierwszym rozdziale autor przeanalizował pojęcie organizacji międzynarodowej. Rozdziały drugi i trzeci poświęcone zostały sposobom determinacji podmiotowości organizacji międzynarodowej, gdyż jest to warunek sine qua non przypisania jej odpowiedzialności. W tych ramach, autor postanowił także pokrótce zbadać kwestie związane z determinacją i zakresem kompetencji organizacji międzynarodowych. W czwartym rozdziale syntetycznie został omówiony ogólny reżim odpowiedzialności międzynarodowej, a szczególna uwaga została zwrócona na hipotezę o jedności tego reżimu. Rozdział piąty omawia przesłanki odpowiedzialności organizacji za działania ich funkcjonariuszy. W rozdziale szóstym poddano analizie okoliczności wyłączające bezprawność czynu. Rozdział siódmy i ósmy przybliżają odpowiednio konsekwencje przypisania organizacji odpowiedzialności w prawie międzynarodowym oraz zagadnienia związane z jej realizacją. W zakończeniu autor przedstawia najważniejsze wnioski wyciągnięte w toku przeprowadzonej analizy oraz formułuje uwagi krytyczne.This doctoral dissertation provides an analysis of responsibility of international organizations for the acts of their agents in general international law with particular emphasis on the functioning of the EU. The dissertation refers entirely to secondary rules resulting from internationally wrongful acts performed by international organization as codified in Draft Articles on Responsibility of International Organizations. In the first chapter the author analyses the notion of international organization. The Second and third chapters are dedicated to the ways of determining legal personality of international organizations, which is an indispensable condition for attribution of responsibility. Within this framework the author decided to briefly examine the issues related to the determination and scope of competences of international organizations. The general regime of international responsibility, with special attention to the hypothesis of its unity, is synthetically discussed in the fourth chapter. Conditions of responsibility of international organizations for the acts of their agents are discussed in the fifth chapter. Circumstances precluding wrongfulness are analyzed in the sixth chapter. Chapters seven and eight respectively elucidate the consequences of attribution of responsibility to the organization in international law as well as issues related to its implementation. The author draws the most important conclusions deriving from the undertaken analysis and formulates some critical remarks in the final chapter

    Means of international control for peaceful utilization of atomic energy

    The article discusses a question of functioning of means of international control of peaceful utilization of atomic energy — a problem of great importance for modern international law. In the introducting part the author presents basic remarks on the essence of international control as one of the institutions securing effectiveness of norms of international law. This serves as grounds for stating an issue of international control for peaceful 'utilization of atomic energy with indicating specific features of control activities in that scope. Essential discussion is concentrated on questions of character of means of international control for peaceful utilization of atomic energy. Those problems are presented on a basis of cardinal outline of legal structure of control system of International Atomic Energy Agency, which consists of Agency Statute, Safeguards Document, Inspectors Document as well as 'provisions of relevant Safeguards Agreements. Upon a study odi basic regulation of international law concerning the IAEA control system it is indicated by the author that these provide a combination of two types of means of control i.e. means of disclosure and of verification. Particular attention is drawn by the author to functioning of the records system (accounting records, operating records), reports system (initial reports, inventory change reports, material balance reports, special reports) and the inspections system (ad hoc inspections, routine inspections, special inspections).     International controls on non-proliferation of nuclear weapons

    The article discusses issues of international law related to the implementation of provisions of the Non-Proliferation Treaty. The author's study on the control activities of the International Atomic Energy Agency in the field of non-proliferation of nuclear weapons constitute the basic part of the article. In the light of provisions of the Treaty the MAEA is the sole competent organ to perform international control of its observance. Subjective and objective scope of the MAEA control activities in this range is defined in the Treaty provisions and the specific control procedures —- in the provisions of the Agency Statute and in its specific regulations (Safeguards Document, Inspectors Document) as well as in the provisions of Safeguards Agreements. Essentially, the author focuses on problems of Safeguards Agreements concluded in a result of implementation of the Treaty provisions. Safeguards Agreements concluded by the Agency and a State of a group of member States, contain regulations on general grounds and rules of control activity of the Agency in the scope of peace nuclear activities of member States and provisions defining procedure of applying control mechanisms. The author discusses substantiate of these agreements on the example of a typical agreement of MAEA with Poland, and interprets its basic provisions.     Wydział Prawa i AdministracjiZgodnie z Konwencją o prawie morza, państwa są zobowiązane do ochrony i zachowania środowiska morskiego. Państwa powinny umożliwić dochodzenie roszczeń w celu niezwłocznego uzyskania odpowiedniego odszkodowania lub innej rekompensaty za szkodę wyrządzoną zanieczyszczeniem środowiska morskiego. Pomimo istnienia tych ogólnych zobowiązań, międzynarodowy system kompensacji szkód spowodowanych zanieczyszczeniem nadal jest bardzo ograniczony, w szczególności w odniesieniu do uszczerbków dotyczących zasobów naturalnych. Przedmiotem pracy jest analiza pojęcia „szkoda w środowisku per se”, pod którym należy rozumieć szkodę wyrządzoną tym składnikom środowiska, które nie są własnością kogokolwiek i z reguły nie mają wartości handlowej. W praktyce szkoda ekologiczna najczęściej kojarzona jest wyłącznie ze szkodą wyrządzoną państwom, jednostkom oraz osobom prawnym na skutek zanieczyszczenia lub innego negatywnego wpływu na środowisko. Wobec powyższego, pojawiła się potrzeba wprowadzenia koncepcji szkody w środowisku per se, która jest przedmiotem tej pracy. W pracy podjęto analizę możliwości uzupełnienia obowiązujących ram prawnych o adekwatną regulację odpowiedzialności w przypadku wyrządzenia takich szkód.Under the United Nations Convention on the Law of the Sea, states are obligated to protect and preserve the marine environment. The states must ensure that it is possible to obtain prompt and adequate compensation or other relief for damage caused by pollution of the marine environment. Despite these general obligations, the international pollution compensation system is still quite limited, specifically with respect to harm to natural resources. The thesis discusses the term “harm to the environment per se”, which is to be understood as harm caused to those components of the environment that are unowned and, in most cases, without specific commercial value. Environmental harm is usually associated exclusively with harm caused to states, individuals and legal entities as a result of pollution or other adverse effect upon the environment. Therefore, the need arose to introduce a concept of harm to the environment per se, which is the subject of the thesis. The thesis has an analysis of the possibility to supplement the existing legal framework with an adequate regulation of liability for such harm

    The essay presents the issue of the principle of self-determination from the perspective of international human rights law. The author highlights the close relationship between the principle of self-determination and the principle of respect for human rights and fundamental freedoms. In practice, the principle of self-determination is a prerequisite for the effective guarantee of human rights, and, at the same time, guaranteed protection of human rights is a prerequisite for implementing the principle of national self determination. The author presents the issue of self-determination in the context of the basic regulations of international human rights law, considering regulations of both a ‘hard’ and ‘soft’ law character

This study seeks to present and evaluate the concept of the international legal personality of international organisations, which is not widely accepted within international legal doctrine.     Wydział Prawa i AdministracjiZasadniczym celem rozprawy jest przedstawienie i teoretyczna analiza zasad prawnomiędzynarodowej odpowiedzialności państwa za niszczenie dóbr kultury. Zagadnienie to potraktowano jako szczególne „odgałęzienie” ogólnych zasad prawnomiędzynarodowej odpowiedzialności państwa, dla którego głównym punktem odniesienia są Artykuły o odpowiedzialności państw za akty międzynarodowo bezprawne opracowane przez Komisję Prawa Międzynarodowego. Podstawowym problemem badawczym jest zbadanie specyfiki poddanego analizie reżimu odpowiedzialności prawnomiędzynarodowej. W pracy określono przesłanki, zasady oraz konsekwencje tejże odpowiedzialności. Ponadto, nawiązując do zjawiska fragmentacji prawa międzynarodowego oraz specyfiki instytucji odpowiedzialności w poszczególnych jego działach, zbadano czy istniejące normy ogólne z zakresu odpowiedzialności państw, ujęte w Artykułach KPM, czynią zadość potrzebom stosunku prawnego, który powstaje w wyniku naruszenia prawnomiędzynarodowego zobowiązania państwa do ochrony dóbr kultury.The basic aim of the dissertation is to present and analyse principles of state responsibility for the destruction of cultural property. This issue was tackled as a specialized “subsystem” within the system of general international law of state responsibility, for which the Articles on Responsibility of States for Internationally Wrongful Acts (ARSIWA) are the main point of reference. The main research problem is to study the specificity of analysed regime of state responsibility. The research focuses on the sources, principles and content of state responsibility for the destruction of cultural property. Furthermore, referring to the phenomenon of fragmentation of international law and acknowledging peculiarities of specific regimes of responsibility, it examines whether existing general international law of state responsibility formulated in ARSIWA meets the requirements of a new legal relationship arising from the breach of an international obligation to protect cultural property

    Problematyka artykułu nawiązuje do klasycznej, ale niezwykle ważnej i aktualnej w praktyce międzynarodowej problematyki zakazu użycia siły, zwłaszcza siły zbrojnej. Dotyczy bowiem możliwości podejmowania i realizowania przez państwa działań zbrojnych pod postacią samoobrony. Prawo każdego państwa do użycia siły w ramach samoobrony było i jest postrzegane jako jedno z praw fundamentalnych, gwarantowanych zarówno przez zwyczajowe, jak i pozytywne prawo międzynarodowe. Jego realizacja w praktyce budzi jednak wiele kontrowersji i pytań. Są one związane zarówno z ewolucją samej instytucji samoobrony, jak również z nowymi tendencjami w zakresie legalizowania różnych akcji zbrojnych dokonywanych poza ramami Karty Narodów Zjednoczonych. Autor prezentuje te tendencje, zwłaszcza w kontekście działań zbrojnych podejmowanych przez państwa w sytuacji potencjalnego zagrożenia atakami terrorystycznymi, a określanych jako uprzedzające i prewencyjne użycie siły. W konkluzji autor stwierdza, że o ile w wypadku zbrojnej operacji uprzedzającej uzasadnione jest odwoływanie się do konstrukcji prawnej samoobrony, o tyle w wypadku zbrojnej operacji prewencyjnej jest to znacznie bardziej ryzykowne, a wręcz nieuprawnione. Prewencyjne użycie siły zbrojnej nie spełnia bowiem kryteriów legalności samoobrony – zarówno tych określonych w Karcie Narodów Zjednoczonych, jak i tych wynikających z prawa zwyczajowego.The subject of this paper touches upon the prohibition to use force, and military force in particular, by States in self-defence. This is a classical example of an important and still very topical issue in international law practice. The right of each State to self-defence is perceived as one of the fundamental rights provided for in customary as well as positive international law. And yet, the exercise of this right has always raised many controversies and questions resulting, on the one hand, from the fact that the concept of self-defence has evolved over years, and, on the other hand, because of the recent tendencies to legalise different military actions carried out outside the framework of the United Nations Charter. These tendencies, presented in the paper in the context of military actions taken by states in situations of a potential terrorist attack, are described as either a pre-emptive, or a preventive use of military force. The author then concludes that although in the event of a pre-emptive military action taken by a State in reliance of its right to self-defence it may be justified to rely on the legal construction of self-defence, in the context of a preventive military operation, such reliance would be much more risky, if not inadmissible. A preventive use of military force fails to meet the criteria of legality of self-defence set forth in the UN Charter, as well as those resulting from international customary law

    Safeguards Agreements of the International Atomic Energy Agency

    Safeguards Agreements are the important legal institution in the system of international control of peaceful utilization of the atomic energy. The control is kept by the International Atomic Energy Agency. The control activities of this organization have to secure that any help offered by itself, by its request, or under its supervision or control cannot be diverted into any military goals. The control activities of the Agency in this scope have to preclude any proliferation of nuclear technology by means of eliminating the situations of inadequate utilization of the Organization's assistance by a State and to prevent a seizure or increase in an army nuclear supplies used and produced in the objects subjected to the safeguards system of the IAEA. The control activities of the Agency is regulated by many acts, the essential ones are: the IAEA Statute, the Safeguards Document, the Inspectors Document. They provide the key model of the control system. These provisions are specified in the Safeguards Agreements. The agreements are concluded between the Agency and one or several member states and they contain commitments of the states- -parties to the agreement to use materials equipment and installations subjected to the IAEA safeguards solely for peaceful goals, the organization is granted the right to control carrying out the commitments of the contracting states. The agreements can concern whether a project of utilization of the Agency assistance or bilateral or multilateral regulation in the scope of utilization of the atomic energy, enabling a contracting state to apply to the organization asking for executing safeguards, they can also refer to any activity of a state pertinent to the atomic energy which is unilaterally subjected to the safeguards of the Agency. The author of the article indicates at the substance of the Safeguards Agreements and discusses their particular types in the IAEA regulations and practice. These are: Project Agreements, Safeguards Transfer Agreements, Safeguards Execution Agreements, Unilateral Safeguards Submission Agreements, Supplementary and Subsidiary Agreements.
