Social sustainability: from accessibility to inclusive design
Full text link[EN] Usually, articles and books about sustainability in building (and urban) sector are focused on environment, reuse, energy saving, solar and natural energy but the “social” sustainability is not considered as one topic for architects and engineers. But these professionals have to improve the quality of the life of the Human Being and to realize environments in which People can realize themselves safely and independently. The researches at the University of Pavia are focused on solutions to make inclusive the historical buildings and sites, looking for solutions that, at different scale, could be inserted respecting the history and the cultural environment but also improving the chance to visit and live according with the contemporary needs. No full textLa sentenza in commento offre l’occasione per riesaminare con spirito critico il principio di massima diffusione delle energie rinnovabili, affermato dalla Corte costituzionale attraverso numerose pronunce con cui è stata sancita l’illegittimità costituzionale di quelle disposizioni regionali che avevano posto limiti alla localizzazione in zona agricola degli impianti per la produzione di energia da fonti rinnovabili.
L’Autore ripercorre il tradizionale orientamento restrittivo della Consulta, confermato anche dopo l’adozione delle Linee Guida ministeriali per l’autorizzazione degli impianti da fonti rinnovabili, ed evidenzia l’innovatività della pronuncia resa dal Consiglio di Stato, che viceversa ritiene pienamente legittima la scelta della Regione Emilia- Romagna di assoggettare l’autorizzazione alla realizzazione su suolo agricolo degli impianti eolici di grandi dimensioni al rispetto un parametro di elevata efficienza energetica.
La sentenza si rivela di particolare interesse perché sembra preludere a una riconsiderazione delle priorità in materia di produzione di energia da fonti rinnovabili in Italia, dove la tutela dell’interesse agricolo è spesso stata posta in subordine rispetto al raggiungimento degli obiettivi di burden sharing fissati dal legislatore nazionale in attuazione delle direttive 2001/77/CE e 2009/28/CE.The judgment annotated gives an opportunity to review critically the principle of widespread of renewable energies as affirmed by the Italian Constitutional Court, who many times has sanctioned the regional rules that had fixed limits on the location in agricultural areas of plants for the production of energy from renewable sources.
The Author traces the traditional restrictive case law of the Italian Constitutional Court, also confirmed after the adoption of State Guidelines for the authorization of renewable energy plants, and highlights the innovative nature of the ruling made by the State Council, who vice versa believes fully legitimate the choice of the Emilia- Romagna region of subjecting authorized construction of grate size wind farms on agricultural land to a high energy efficiency parameter.
The judgment is of particular interest because it seems to herald a reconsideration of priorities in the field of energy production from renewable sources in Italy, where the agricultural interest protection has often been moved to the background in order to achieve the burden sharing goals set by the national legislature implementing Directives 2001/77/EC and 2009/28/EC

In particolare il contributo evidenzia come in altri contesti culturali (Nord Europa e Giappone) ci sia una maggiore attenzione verso la realizzazione di soluzioni residenziali capaci di variare nel tempo senza il ricorso ad invasive operazioni di cantiere. L'utilizzo di sistemi costruttivi a secco e il ricorso ad un tipo di impiantistica flessibili dovrebbero trovare anche in Italia maggiore applicazione per realizzare soluzioni capaci di adattarsi ai mutevoli quadri esigenziali
