provisional measures in the Allegations of Genocide under the Convention on the
Prevention and Punishment of the Crime of Genocide (Ukraine v. Russian Federation).
The conditions for the adoption of provisional measures, notably prima facie jurisdiction
ratione materiae, were deemed to be met since the Court upheld Ukraine’s ‘creative’
interpretation of the Genocide Convention. The appropriateness of adopting an Order that
has not had any meaningful impact on the ground so far must be appraised by keeping in
mind the Court’s role as principal judicial organ of the United Nations; it can be seen as
an (admittedly limited) contribution to international peace and security, and thus to the fulfillment of the aims of the Charter
