Le garanzie immobiliari in Europa. Studio di diritto comparato
Il libro analizza i diritti nazionali delle garanzie immobiliari in tre fra le esperienze giuridiche che, in materia di diritto ipotecario, maggiormente sembrano incarnare le diversità che si affacciano sullo scenario europeo: Germania, Inghilterra e Italia. L'analisi storico-comparatistica dei dati giuridici consente di portare alla luce tutti quei dati che le trattazioni municipali lasciano sovente inespressi. Si tratta, ad esempio, delle radici delle diversità tecniche attualmente esistenti, delle scelte di policy che riposano dietro i dettagli specialistici, dell'influenza esercitata dalla cultura degli interpreti sulle soluzioni operative adottate di volta in volta nelle singole esperienze giuridiche o, ancora, del ruolo delle prassi professionali e degli interessi corporativi. Sulle tradizioni nazionali, il diritto comunitario, spinto dai bisogni delle lobby finanziarie che intendono promuovere la cartolarizzazione delle ipoteche, sta producendo una spinta verso l'armonizzazione giuridica nel settore delle garanzie immobiliari, che la presente ricerca valuta anche alla luce della recente crisi finanziaria globale
El proyecto “The Common Core of European Private Law”: aportaciones italianas a la comparación jurídica europea
The research project «The Common Core of European Private Law» can be looked at as the result of a methodological “legal fusion” from the U. S. A.
to Europe. In this fusion, the particular European cultural context, together with a series of influences by the Italian legal scholarship, have led to an
enrichment of the imported model with original elements, thereby assuring the wide success of the initiative. This essay illustrates aims and methods of the project, deals with the relationship existing between the «Common Core» and the Italian legal culture, and assesses the impact of the project in Europe. Special attention is paid to the contributions of the «Common Core» towards many directions, like the increasing of knowledge in the field of European private law, the (better) understanding of the link existing between law and language, and the creation of a European legal culture, but also its limits are analyzed, which may put at risk the surviving of the project

The Draft Common Frame of Reference: National and Comparative Perspectives, by Vincent Sagaert, Matthias E. Storme and Evelyne Terryn (eds), (Cambridge: Intersentia, 2012), Book Review
The volume under review gathers the contributions to a Conference held in Kortrijk on 10-11 June 2010, focussing on the “Draft Common Frame of Reference” (DCFR) and Belgian private law. The book looks at the DCFR both as a model for the national legislatures and as the basis for scholarly discussions. In fact, the contributions aim on the one hand at a thorough analysis of the DCFR rules and, on the other, at a comparison of those rules with Belgian private law in an attempt to ascertain which of the DCFR provisions could be used to modernize Belgian law and, which would be felt as unfamiliar and therefore rejected, or would lead to no concrete advantage to the national law.
The outcome of the contributions is to no surprise for those accustomed to comparative law and the critical literature on the DCFR. There are areas in which the DCFR comes truly like a restatement of common rules shared by the European traditions and areas where the DCFR fails to be a reliable model for Europe. Despite the diversity of results in the assessment of the DCFR rules in comparison with national law, and – one could say – exactly in virtue of these diversities, the book is worth reading also for a non-Belgian lawyer. It is so because it provides an interesting intellectual exercise that proves to be very useful in the perspective of the building of a European legal scholarship. Comparative law teaches us that without a shared legal culture the operative success of any legal integration effort is deemed to fail
