Ancora sull'immaginario archetipo delle Istituzioni di Gaio
The Author in a previous study subjected to criticism the hypothesis that the Institutes of Gaius are a mere reworking of someone else’s manual, the so-called Gaius’ archetype. However, very recently an intervention of Pierfrancesco Arces has appeared that, in direct opposition to the aforementioned study, aims to reaffirm such a hypothesis. In the present article, the Author replies to this scholar’s intervention, showing that the clues adduced by the latter are unable to support the existence of the archetype
Postille di sistematica gaiana delle obligationes
The author develops and deepens some reflections made in
his own previous studies on the subject of the systematics of obligations in the Institutes of Gaius. In particular, new clues are added and further textual exegesis are carried out in relation to some fundamental points of Gaius’ work: the notion of ius obligationis, which is understood as alluding to the subjective position of the creditor holder of an action; the inclusion of this ius among res incorporales and the defence of both the integration ‘ea quae iure consistunt’ and the subjective perspective of this conceptualisation; the framing of legacies among the sources of
obligations; the meaning of the category of obligationes re contractae, to which the author proposes to refer legacies; the dichotomy between obligationes ex contractu and obligationes ex delicto in relation to the question of the originality or non-originality of the entire Gaian systematics of obligations

The author counters the idea that Theodosius II's codification expressed a conception of self-sufficiency of imperial legislation and argues that, rather, the emperor recognised the value of the writings of classical jurisprudence as another component of the overall legal order. Nov. Th. 1 does not express a derogatory attitude towards the ancient jurists.The criticism of the 'immense copia librorum' and the 'cloud of volumina' as the causes of the poor results of the studium iuris are, yes, addressed to the texts of the ancient jurists, but not as expressions of scientific elaboration, but as dispersive and inadequate sources of knowledge of the imperial constitutions. The emperor remedied this difficulty in consulting the constitutions with the Codex

The text of Gaius’ Institutes concerning the price of a sale contains a curious peculiarity. Gaius first of
all reports the requisites of the price in the form of peremptory rules, but soon afterwards he indicates
as consequence (nam...) a contrast of views: some jurists admit the relevance of a sale which doesn’t
observe these requisites. The Author suggest that the (merely) apparent contradiction is an example
of the particular approach ‘operativo-cautelare’ of the whole work: Gaius wants to point out, in a
‘warning perspective’, the conditions to be complied so that the effect of the legal transaction is sure
and beyond dispute, by distinguishing from the case in which the effect is uncertain

After a recollection of the relations between the schools of Palermo and Groningen in the field of Byzantine
law, which were fostered by Jan Lokin, and of the scientific profile of the late scholar, the author
tackles a textual comparison between the versions of a constitution of Arcadius preserved in the Theodosian
Codex and in the Justinian Codex of 534. In the latter, the concluding statement of Arcadius’s lex,
which contained the rule that an action cannot be commenced by the heir of a person who had not been
the holder of the same action, was eliminated by the compilers of 534: it was in fact in contrast to a constitution
of Justinian of 531, which, on the contrary, stated that actions can be commenced by and
against heirs and which, in substance, reiterated a provision already issued in 528. A passage from the Basilics,
generally overlooked by scholars, shows that Arcadius’ constitution had already been included in the
Code of 529 and that it also contained the rule deleted in 534. Evidently, the compilers of the first Justinian
Code had not taken the lex of 528 into account and this circumstance probably explains the very insistent
and resolute wording with which Justinian in 531 expressly abolished the rule enunciated by Arcadius.
This also explains the presence in the 534 Code of both Justinian’s constitutions of 528 and 531,
which has been the object of discussion among scholars

Si richiamano due riferimenti , nelle Res gestae di Ammiano Marcellino, ad interventi normativi dell'imperatore Giuliano, caratterizzati, entrambi, dall'obiettivo di esprimere in modo chiaro ed inequivoco il disposto legislativo; e si segnala che i due brani attestano, già alla fine del IV secolo, l'esigenza di precisione e di semplificazione del dettato delle leges che sarebbe stato poi perseguito su larga scala da Teodosio II con la sua codificazione

Traendo spunto dalle prospettive di metodo seguite dalla studiosa Franca de Marini Avonzo, si compiono alcune riflessioni su testi e problemi di età tardoantica (codificazione di Giustiniano e di Teodosio, cultura del testo religioso e giuridico) e di età severiana (i giuristi severiani come intellettuali, concezione ulpianea del ius e dei giuristi come sacerdotes, nozione e ideologia della 'vera philosophia' verso cui si applicano i giuristi, possibili scelte ideologiche di Ulpiano e Paolo) e sulla necessità di una vigile attenzione ai dati testuali delle fonti

Codification of ius : the Digest
Between 530 and 533 A.D. Justinian produced through the Digest a grandiose codification of legal material coming from classical jurists’ works. The aim was to make available for use in the courts a selection of texts that was complete in itself and that overcame the controversial nature of classical jurisprudential Law. Through the inclusion of the texts in the Digest and the alterations carried out to make the contents more intelligible, to eliminate internal contrasts and repetitions and to bring the texts up to date, the statements of the jurists become themselves, in the view of Justinian, an expression of the imperial will: they cease to be an autonomous legal source and become imperial laws, in accordance with the ideology of the emperor’s legislative and interpretative monopoly
