    This paper aims to show how a consequentialist ethical theory can account for the function and utility of the concept of legal rights. It proposes that the so-called "Interest Theory" of rights, which treats rights as benefits for their holders, should be preferred to the so-called "Will Theory", on account of its better explanation of the specific function of rights. A consequentialist perspective, it is further proposed, can also explain away or amend some alleged or real defects of the Interest Theory, which are due to the influence of "right-based" ethical theories

    La legislación simbólica: la necesidad de una redefinición y el problema de las funciones simbólicas del derecho = Symbolic legislation: the need for a re-definition and the problem of the symbolic functions

    The aim of this paper is to propose a definition of “symbolic legislation” that can embrace the most common uses of this syntagma, while discarding the value connotations (in a negative sense) that are associated with it in legal doctrine. Instead of identifying symbolic legislation in the negative, i.e. by identifying its specific shortcomings or defects, an attempt will be made to offer a definition in the positive, capable of accounting for the reference to symbolism. A redefinition will then be proposed on the basis of what will be called the “symbolic functions” of law, which prevail in symbolic laws. These functions would be fulfilled by means of a secondary sense or meaning, which is added to the primary meaning of the provisions (the meaning that concerns the establishment of Hohfeldian legal relations). But as will be seen, when it comes to identifying the secondary or symbolic meaning, the characteristics that enable it to be distinguished from the primary meaning have yet to be convincingly determined.Objetivo del presente trabajo es proponer una definición de «legislación simbólica» que pueda abarcar los usos más comunes de este sintagma, descartando al mismo tiempo las connotaciones valorativas (en sentido negativo) que se le asocian en la doctrina jurídica. En lugar de identificar la legislación simbólica en negativo, es decir, individuando sus carencias específicas o defectos, se intentará ofrecer una definición en positivo, que explique la referencia al simbolismo. Concretamente, voy a proponer una redefinición a partir de las que llamaré «funciones simbólicas» del derecho, las cuales prevalecen en las leyes simbólicas. Dichas funciones serían cumplidas por medio de un sentido o significado secundario, que se añade al significado primario de las disposiciones (el significado que concierne el establecimiento de relaciones jurídicas hohfeldianas). Como veremos, no obstante, cuando se trata de identificar el sentido secundario o simbólico, todavía quedan por determinar de manera convincente las características que permiten diferenciarlo del sentido primario

    Age, sedimentation, and soil formation in the Val Sorda loess sequence, Northern Italy.

    The Val Sorda sequence is a key section for Quaternary stratigraphy of Northern Italy, because it is very well preserved and is the only loess section in the area providing 14C and luminescence dating. The base of the succession consists of a till, capped with a rubefied Eemian palaeosol. It is overlain by a colluvial layer and by a thick loess unit, including three chernozem palaeosols, formed during MIS 4 and 3. The sequence is capped and preserved by fluvioglacial and glacial deposits (MIS 2). Grain-size analysis of each single sand and silt fraction from the loess reveals that it can be used as a proxy of wind energy with higher amounts of coarser fractions corresponding to stronger winds; grain-size zones are identified showing cycles of variations in aeolian dynamics. Chernozems occur at grain-size zone boundaries, corresponding to changes in wind strength. Among heavy minerals, the ultradense fraction also represents a wind proxy, fitting with the identified grain-size zones, higher percentages indicating higher wind intensities. Although the Val Sorda sediments have the same provenance, the glacial and aeolian units are characterized by different heavy mineral assemblages. The loess unit is marked by the presence of garnet, while in both tills amphiboles are common. Magnetic parameters here considered confirm their role of palaeoclimatic proxies, similarly to that proposed for many loess sequences: MS and ARM values fit with the identified grain-size zones; higher values correspond to higher wind intensities. χfd% is sensitive to ultrafine SP particles, confirming its role as a pedogenesis proxy

    In Italy, requirement by law of a digital Covid-19 vaccine certification for accessing public transportation, workplaces, bars and restaurants, museums, etc. has raised accusations of state discrimination against those who are not vaccinated by choice or for health reasons. Such accusations are seldom argued for and they are untenable if direct discrimination is being referred to. However, the social meaning of the measures in question could convey a discriminating message of degradation and stigma of the unvaccinated. Moreover, indirect discrimination of already disadvantaged groups could ensue. Careful communication of the reasons underlying vaccine passports, as well as appropriate argumentation in public debate, are crucial to minimize the risk of discrimination

    Underground Nuclear Astrophysics at LUNA

    Since 1991, LUNA (Laboratory for Underground Nuclear Astrophysics) has played a leading role in the direct measurement of nuclear cross sections relevant to astrophysics, producing several pioneering results. Thanks to the shielding provided by the Gran Sasso mountain, LUNA enables measuring very small cross sections of the nuclear reactions involved in stellar and Big Bang nucleosynthesis at (or very close to) the energy range at which they occur in astrophysical scenarios. The present accelerator is provided with two beamlines, respectively dedicated to a solid target and to a differential-pumping extended gas target. The most recent measurements are briefly presented, together with the experimental techniques used, and the astrophysical implications. The imminent installation of a new 3.5 MV accelerator paves the way for the study of a number of key reactions regarding helium and carbon burning
