White women, race matters ::the social construction of whiteness /
Beginning with the premise that race shapes white women's lives, just as much as gender shapes men's lives or sexuality shapes heterosexual lives, the author examines, through 30 life-history interviews, just how this "whiteness" is constructed. "Whiteness" is not an empty signifier, but rather a multifaceted daily experience of racial structuring, and through ethnographic descriptions of the 30 womens' lives, Frankenberg provides evidence that "whiteness" is a specific set of cultural practices
Günter Frankenberg\u27s Comparative Constitutional Studies: Between Magic and Deceit
Constitutions traffic in magic and deceit, argues Günter Frankenberg, promising freedom and democracy even as they underwrite the exercise of coercive power on a massive scale. Scholars should approach constitutions with a healthy skepticism, but, Frankenberg contends, most mainstream scholars are too credulous, especially regarding the claims of liberal constitutionalism. Comparative Constitutional Studies serves as his corrective to the perceived blind spots and predilections of mainstream comparative constitutional scholarship, and it gives attention to little-known constitutions, forgotten histories, and alternatives to liberal constitutionalism. It’s a rich, challenging, and valuable book, one that takes the reader to some off the beaten track places and offers some new perspectives on well-studied landmarks. It does not, however, represent such a radical break from mainstream scholarship as the author supposes, both because the book’s own analysis, in practice, is not deeply unconventional, and because mainstream scholarship is more diverse than Frankenberg gives it credit for

First, the author portrays the classical stage of critical theory from research carried out by Horkheimer, Marcuse and Adorno. Then, he seeks to analyze the inclusion of the normative dimension as the object of study by Neumann and Kirchheimer and the influence of Habermas's discursive theory in the development of critical theory. Furthermore, he states the main objections that are made by critical theoreticians about positivist legal philosophy, especially in regard to Public International Law, and presents proposals for new critical approaches.

Political technology and the erosion of the rule of law ::normalizing the state of exception /
'Books abound on the question whether states of emergency can be legally controlled. But Frankenberg's account stands out because of his mastery of the political and legal contexts in which the terms of the debate about states of emergency were framed for us - the situation of Weimar and the constitutional reaction in postwar Germany. In addition, Frankenberg has an astonishing command of the history of political theory from Hobbes to the present. His innovative but scholarly analyses permit him to construct a narrative about the potential of the rule of law to respond to emergencies that includes detailed examinations of Schmitt, Foucault, Habermas, Agamben, and many others. His treatments of these figures seek to draw out the genuine insights they might offer, so that, even though none of the figures escapes the force of his criticism, his argument will challenge the assumptions of all involved in the debate.' - David Dyzenhaus, University of Toronto, Canada. This timely volume by distinguished scholar Günter Frankenberg offers a sophisticated analysis and sharp critique of the reactions of nations such as the US, Great Britain and Germany to perceived terrorist threats, organized crime actions and other political emergencies that have occurred in recent years. The author demonstrates how governments have increasingly sacrificed the rule of law and human rights for the benefit of security programs - as evidenced by a rise in extraordinary measures such as surveillance, detention and torture - thus normalizing the state of exception and privileging preemptive, proactive and coercive methods of political engineering. An interdisciplinary and multi-jurisdictional study, this book develops and implements a unique theoretical and conceptual framework for understanding the rise of technical-political rationality and the fall of the rule of law, and submits both to a firm critique. Particularly relevant in light of current controversies, this provocative book will appeal to scholars and students of international and constitutional law, legal theory, political science, and terrorism studies
Assessing Segregation Under a New Generation of Controlled Choice Policies
Student assignment policies (SAPs) in K–12 schools can either reproduce or help ameliorate existing inequality. Some districts are trying to maintain voluntarily adopted integration policies despite the Supreme Court’s recent 2007 decision in Parents Involved, which prohibited most race-conscious school choice policies that were effective and popular ways of accomplishing integration. While alternative policies with minimal or no use of race are still permitted, it is unclear whether they will create diverse schools. This research examines the new generation of school choice policies post- Parents Involved to understand how they affect diversity in our multiracial yet increasingly race-neutral era. Analysis of the use of a new generalized, race-conscious SAP in Jefferson County (Kentucky) Public Schools suggests that their plan is largely able to maintain integrated schools, albeit with some increasing racial segregation; economic segregation patterns are mixed. Moreover, the controlled choice policy has lower segregation than simulated, non–integration focused policy alternatives.</jats:p
