Moving from a theoretical recasting of the “right to have rights” in the works of Hannah Arendt, the author deals with some critical stances on the legal treatment of asylum-seekers’ fundamental rights. In particular, it focuses on human dignity as a viable legal instrument in order to overcome the growing selective use of rights and remedies in the current migration crisis
The role of the Venice commission in democracy oversight through the Internet
n recent years the Venice Commission has analyzed several national rules aimed at limiting Internet’s diffusion because of its specificity vis-à-vis the already known media. The question was thus at stake of whether and of to what extent Internet could be assimilated to the latter. The Commission’s answer was regularly positive, with the effect of denying the states’ attempts of limiting freedom of expression on the web. On the other hand, the Commission released Opinion no. 974/2019, which contains a set of principles aimed at pointing out the risks no less than the opportunities which the enormous diffusion of the digital technologies is likely to bring about on the ground of democracy and of freedom of expression. The Author seeks to demonstrate that, contrary to what might prima facie appear, the latter Opinion’s approach does not counter, but rather complements, that formulated in the opinions denying the states’ attempts of limiting freedom of expression on the web
Las medidas para contrarrestar la crisis de la eurozona y su impacto en el modelo social europeo
The Author seeks to demonstrate that the impact of the eurozone’s financial crisis onthe European social model is due both to scarce capacity of the EU political institutionsin managing that crisis and to the fact that, in the last decade, the launch of theEuropean social model was not accompanied with the political conditions aimed atmeeting the challenges posed from a powerful non-regulated global financial market.To this end, after having exposed the main features of the EU economic governance,the author draws attention on the instruments (Six pack, Fiscal Compact, ESM) recentlyadopted from the EU or its single member States with the aim of reacting to thefinancial crisis. According to the Author, the failures of these instruments depend onthe national governments’ anawareness of the risks posed from the current crisis forthe whole construction of the EU.El autor busca demostrar que el impacto de la crisis financiera de la Eurozona en elmodelo social europeo se debe tanto a la escasa capacidad de las instituciones políticasde la Unión Europea para manejar la crisis, como al hecho de que en la última décadala puesta en marcha del modelo social europeo no se acompañó de las condiciones políticasdirigidas a enfrentar los desafíos presentados por un poderoso mercado financieroglobal y no regulado. Con este fin, una vez expuestos los principales rasgos del gobiernoeconómico de la Unión Europea, el autor dirige su atención a los instrumentos recientementeadoptados por la Unión o sus Estados miembros con la finalidad de reaccionara la crisis financiera (Six pack, Fiscal compact, ESM). De acuerdo con el autor el fracasode esos instrumentos se debe a la inadvertencia de los gobiernos nacionales de losriesgos presentados por la actual crisis para la plena construcción de la Unión Europea

Cinquanta anni di regionalismo, fra ‘libertà dallo Stato’ e culto per l’uniformità
The author affords an account of how regionalism’s main features have been related in the Italian constitutional practice. In particular, attention is driven on the seemingly contradictory relationship between a longstanding practice of uniformity and a recurring quest for “freedom from the State”. The paper tends to demonstrate that such relationship is far from contradictory, and that, on the other hand, it obliterates the true constitutional values regarding regional autonomy.

Il tempo della costituzione nel pensiero di Leopoldo Elia
This is the Author’s presentation at the Conference held on 10 December 2018 at the Sapienza University of Rome in memory of Professor Leopoldo Elia in the tenth anniversary of his death (5 October 2008). It is devoted to Elia’s conception of constitutional time, with the aim of demonstrating that, without giving an explicit theory of the issue, time was crucial in Elia’s thought on the constitution. To this end, the author affords an account of a series of Elia’s contributions, concerning both political institutions and constitutional justice
