States, as Ethico-Political Subjekts of International Law: The relationship between Theory and Practice in the International Politics of Samuel Pufendorf
This chapter focuses on the dialectical relationship between the various principles upon which the theory of international law as developed by Samuel Pufendorf is founded and supported. This theory is substantiated as much by principles of natural law, arising from the complex edifice of the duties of peace, as by strictly political criteria among which there are also, and not least, international treaties. The dialectical relationship that Pufendorf establishes between international law as a moral politics, and the interests of states as an expression of pragmatic politics, constitutes the thin ‘red line’ that keeps the disparate elements—be they moral or political—united and in which he roots his concept of international law

Die Frage, wie und von wem staatliche Herrschaft zu organisieren ist, berührt zentrale Elemente unserer Verfassungsordnung. Von der historischen Begrifflichkeit der Organisationsgewalt bis hin zur heutigen Europäisierung des Verwaltungsrechts wird immer wieder die Frage zentral, welche substanziellen Aussagen dem Grundgesetz über die Verwaltungsorganisation zu entnehmen sind. David Roth-Isigkeit erarbeitet ein umfassendes Bild davon, welche Akteure im Verfassungsstaat über die Organisation der öffentlichen Verwaltung zu entscheiden haben und an welche verfassungsrechtlichen Maßstäbe sie dabei gebunden sind. Dabei zeigt sich die durchdringende Ordnungskraft des besonderen Verhältnisses von Demokratie und Rechtsstaat in der deutschen Verfassungsdogmatik
Niccolò Machiavelli’s International Legal Thought: Culture, Contingency, and Construction
This chapter suggests a progressive reading of Machiavelli, relying on the unity of his national and international thought. It argues that his focus on the unification of political communities through the medium of law allows for a sophisticated theoretical understanding of international law. The chapter starts with a discussion of the relationship of his biographical events and his social epistemology. It proceeds with the relationship of Machiavelli’s concept of law as a governance tool to the area of morality and normativity. Ultimately, the focus lies on his understanding of imperialism and international relations in order to shape a novel understanding of Machiavelli that depicts him as a reasonable historical starting point for a modern, post-critical understanding of international law.</p
