L'architettura del testo. Studi contrastivi slavo-romanzi. Atti del 3° Convegno internazionale di linguistica... Ediz. italiana, francese e russa
Questo volume collettivo comprende una selezione dei testi presentati al terzo Convegno internazionale di linguistica testuale contrastiva slavo-romanza (16-19 maggio 2013, Napoli) organizzato dal gruppo di studio GELiTeC in collaborazione con l’Università “L’Orientale” di Napoli. Il volume riflette i tradizionali indirizzi di ricerca del gruppo: l’analisi contrastiva, sotto differenti prospettive, dei fenomeni delle lingue slave e romanze, nonché dei mezzi di cui esse dispongono per garantire la coerenza e la coesione del testo. La prima parte del volume, «Semantica e pragmatica delle forme verbali», si concentra sulle categorie di tempo, aspetto e modalità. La seconda parte del volume, «Strutturare il testo», è dedicata alle relazioni e strategie testuali, in particolare la comparazione, la conclusione o l’approssimazione. Attraverso la molteplicità delle tematiche trattate il lettore potrà disporre di nuovi dati e di soluzioni originali, offerti proprio grazie all’approccio contrastivo e alla sua capacità di raccogliere insieme e di scorgere fenomeni che solitamente sfuggono a un approccio monolingue
Unione europea e flussi migratori, o del tramonto dello spirito comunitario: considerazioni a margine del Consiglio europeo del 28-29 giugno 2018
All’esito di una lunga maratona negoziale, preceduta da aspre scaramucce dialettiche tra gli Stati membri e da un pre-vertice tenutosi nella capitale belga la domenica precedente, il Consiglio europeo del 28-29 giugno ha adottato alcune Conclusioni sulle migrazioni. Il documento finale pretende di offrire un quadro di riferimento per l’azione dell’UE in materia per i mesi e gli anni a venire, integrando precedenti conclusioni tematiche approvate in occasione delle riunioni succedutesi con una certa frequenza a partire dalla primavera del 2015. Per questo motivo esso tocca svariate questioni. Nel presente contributo sono affrontati due aspetti che sono entrambi sintomatici della persistente difficoltà di orientare lo sviluppo della politica UE sulle migrazioni secondo linee coerenti con il dettato del diritto primario (e in particolare con l’art. 80 TFUE): l’ipotesi di condurre le persone soccorse in mare in hotspot collocati in Paesi terzi o sul territorio UE; la riforma del sistema Dublino
Walking the (Barbed) Wire of the Prohibition of Collective Expulsion: An Assessment of the Strasbourg Case Law
Following the Hirsi judgment dating back to 2012, the prohibition of collective expulsion gained a prominent role in the European system of protection of human rights. Its implications on the restrictive migration policies implemented by European States at the borders or elsewhere are far reaching.
With the N.D. & N.T. judgment of February 2020 the Strasbourg Court had the occasion to assess the controversial Spanish policy of hot returns at its terrestrial border with Morocco. Contrary to the previous findings of the Chamber, the Grand Chamber held that no violation of Art. 4 Protocol No. 4 of the Convention occurred. This article critically assesses the reasoning followed by the Court in introducing a sort of ‘bad behaviour exception’ to that provision: several flaws and questionable passages, both in abstract and in the application to the circumstances of the case, are
highlighted. It then argues that it is possible and desirable to significantly reduce the impact of this unfortunate precedent on future cases dealing with collective rejections

In questo lavoro propongo una riflessione linguistica sulle approssimazioni quantitative, condotta attraverso il confronto e la verifica di paralleli tipologici tra l'italiano e il russo. Viene proposta attraverso tabelle una modellizzazione semantica delle approssimazioni suddivise secondo il coefficiente di scalarità, in rapporto al limite inferiore o superiore attorno al punto centrale indicante la cardinalità. Tutti i modelli sono espressi da approssimatori. Le tabelle adattate secondo il modello proposto da Adamovič (2011) evidenziano i casi di simmetria e asimmetria tra l'italiano e il russo
The reform of the Dublin system and the need to go beyond a simple restyling: a possible negotiating strategy for Italy
La Serie “Policy Briefs” dell’Osservatorio discute in maniera sintetica e policy-oriented i temi di maggiore attualità nel dibattito italiano ed europeo, offrendo un contributo di idee e spunti ai decisori politici e alla comunità degli esperti. Tra i Briefs recentemente pubblicati possono essere menzionati i seguenti: The EU external policy on migration and asylum: What role for Italy in shaping its future? (A.V. Palm, May 2017); Critical aspects of the Hungarian Law on asylum seekers’ detention (E. Andriolo, June 2017); Welfare Tourism within the EU: Filling the Perception Gap (D. Pedrali, July 2017).Focusing on the certified shortcomings of the Dublin system and on the recent
debate fuelled by the May 2016 proposal of the European Commission (where
minimum policy changes to the current Dublin Regulation have been foreseen), the
Brief urges the Italian Government to take a proactive stance (not limited to
propose the deletion of the irregular entry criterion, or to complain about the fault
of solidarity from other Member States) and advocates the need to make significant
changes towards an effective and reasonable system of allocation of asylum
seekers.
To make these changes possible, a ‘genuine link approach’ between the asylum
seeker and the competent EU Member State is suggested, able to substitute the
irregular entry criterion and – in the same time – to address the main concerns of
many Member States and of other relevant stakeholders. A centralized system for
registering all the applications and the attribution of relevant shares according to a
reference key would be the first steps in this direction, followed by an assessment
of the asylum seeker that takes into account the pivotal importance of the possible
relationship(s) of the concerned person with a suitable Member State (or more)
through objectively verifiable connections such as family links (in a broader sense
than the current one), language, professional and educational ties, private
sponsorship and so on.
The MS declared competent would fill its annual share of asylum seekers with
applicants who are – at least in part – likely to raise less problems as far as financial
costs and social integration are concerned and can contribute to the local economy.
The whole procedure would be more balanced and less conflictual, while the
drivers for secondary movements will be reduced to a large extent. In order to
prevent a possible overburden on some Member States (which are usually
preferred by asylum seekers as host country), some corrective and compensatory
tools are proposed. The recognition of a limited degree of free circulation for
economic purposes, to the benefit of the recognized refugee, is suggested too
Can EU free movement rights be abused? Critical remarks on the “marriages of convenience clause"
The article (presented in a preliminary version during an international conference, following a competitive call for abstracts) deals with a little explored aspect of the EU regime of free circulation for EU nationals and their family members, namely the possibility for Member States to deny the exercise of such freedom to the married partner invoking the debatable doctrine of "marriages of convenience". After some preliminary remarks, the articles discusses the relevant legal framework and the critical issues raised by a Commission’s «Handbook on addressing the issue of alleged marriages of convenience between EU citizens and non-EU nationals in the context of EU law on free movement of EU citizens». In particular, the issues treated are: definitional aspects; scope of the Handbook and the question of the registered partnerships; the frequent transnational dimension of the phenomenon and the doubt about the chance to conduct a serious and balanced investigation; the dilemma about the recourse to (more) detailed provisions or to open and debatable clauses such as the one on marriages of convenience
The determination of competence in asylum procedures and the questionable Dublin system
The essay offers a critical discussion of the criteria for allocating the competence to assess asylum claims, so far employed in the Dublin system and confirmed in the May 2016 proposal of the European Commission. Indications coming from other fields of international cooperation in the adjudication of acts or status with transnational dimension are investigated in order to dismantle some assumptions on the feasibility of certain allocative criteria. A a ‘genuine link approach’ between the asylum seeker and the competent EU Member State is suggested, able to substitute the entry criterion and – in the same time – to address the main concerns of many Member States and of other relevant stakeholders. Additionally some relevant procedural issues are tackled, together with the debated topic of an effective implementation of the principle of 'solidarity and fair sharing of responsabilities' enshrined in Article 80 TFEU
