The querela inofficiosi testamenti represents the earliest historical antecedent of the modern concept of forced heirship. Through this legal instrument, the closest relatives of a testator could challenge and nullify a will from which they had been unjustly excluded, thereby initiating intestate succession. This article first traces the scholarly trajectory that led Matteo Marrone, in the mid-20th century, to reconstruct the legal framework of this action as developed in Roman law from the pre-classical to the classical period. It then outlines the structure of his Course of Lessons, published in 1962 in Palermo as a monographic course intended for students of Roman law. The purpose of the paper is to illustrate the reasons behind the new edition of this Course, now made accessible to a broader audience of scholars in inheritance law, both historical and contemporary

The phenomenon of surrogacy represents nowadays one of the most sensitive topics in the legal debate. Its
multi-level complexity requires a constitutionally oriented interpretation that aligns with principles
emerging at a supranational level. Moreover, the analysis of this issue from a historical perspective helps
to better frame the terms of the debate, in light of the intrinsically historical nature of law. The latter
should be seen as a tool for enabling peaceful coexistence in a free society, whose values, however, are
bound to change over time. The article presents an overview of antiquity, broadening the scope of analysis
to practices that emerge from testimonies dating back to the earliest Mesopotamian cultures, the Hebrew
culture of the Old Testament and some references to Greek culture. It then proceeds to the examination of
the numerous sources that attest to the practice of the so-called cession of the wife in archaic and classical
Roman culture, with potential echoes even into Late Antiquity
Il proprium quaestionis crimen e la strategia difensiva nella Pro Caelio di Cicerone
The paper proposes a revised analysis of the speech, which was delivered by Cicero on behalf of Marcus Caelius. Numerous studies have shown the importance of the rhetorical aspects of this speech. The aim of this analysis is to examine its legal aspects. Firstly, many sources containing abundant evidence regarding the causae de vi ex lege Plautia will be examined in order to identify, among the many allegations made by opponents of this causa, those for which Caelius ex lege Plautia was responsible. Secondly, having identified the ex lege Plautia charges, the defensive strategy, which is specifically aimed at defending Caelius from the charge of Dione’s murder, will be thoroughly analysed. The purpose of this analysis is to demonstrate that Cicero obtained the acquittal of Caelius because he was able to prove that the charges, which were connected to the mors Dionis, the crimen auri and the crimen de veneno, were unfounded. Cicero was also able to summarize all of the allegations into one piece of evidence: the ambiguity of the role of Clodia as a witness

The paper traces a brief overview of the fundamental contribution given to the study of Roman law by the discovery of papyri and reconstructs a fruitful season of research during the so-called Century of Papyrology. In particular, against the broader background of the Wissenschaftsgeschichte of Roman law in the first half of the 20th century, the results proposed in a recently published monograph are analysed and some reflections on the role of modern Juristic Papyrology are proposed in the light of a renewed study of the sources of Roman law

Com'è noto, la patria potestas rivestì durante l'intera esperienza romana una rilevanza giuridica sia interna sia esterna alla familia. Essa dispiegava i propri effetti sia all'interno della familia proprio iure dicta, sia all'esterno, nelle dinamiche di quei rapporti che in prospettiva moderna consideriamo oggi rilevanti nell'ambito del diritto privato. La tradizione degli studi romanistici ha riservato particolare attenzione a entrambe tali categorie di effetti, coerentemente sia con una concezione della patria potestas quale potere 'assoluto' esercitato sui sottoposti, il cui contenuto, probabilmente in origine indistinto, espresse sempre una valenza fondamentalmente oppressiva, sia con una visione ideologica della familia quale istituto rilevante nell'ambito del diritto privat

AbstractIn a significant passage in his Εἰς Ρώμην, Aelius Aristides uses the terms ἄστυ κοινόν to describe Rome. This expression is commonly considered a Greek translation of the Latin words communis patria. A new contextual and terminological analysis of Aristides’ use of the terms, however, demonstrates that he was actually drawing on the older Hellenic models that also influenced Cicero’s writings on the Roman idea of communis patria
