    Riflessioni intorno all’idea di modernizzazione amministrativa

    Modernizzare l’amministrazione attraverso le riforme (e attraverso la legge quale strumento principe dell’azione di riforma) non è affar semplice. Le riforme non sempre sono in grado di far conseguire benefici maggiori dei costi che producono, anzi spesso queste hanno generato risultati “rachi- tici” e costi enormi. Mentre rendita della burocrazia, corruzione amministrativa, inerzia nel metodo delle riforme operano come ostacoli alla modernizzazione, la legi- slazione di riforma interviene sull’organizzazione amministrativa sottova- lutando il ruolo degli apparati. L’Autore analizza la questione anche in chiave comparata, evidenzian- do come la legge sia, in realtà, strumento ben poco adatto a riformare con una prospettiva di modernizzazione, in quanto congela uno status quo e mal si combina con l’esigenza di adattamento continuo cui l’amministrazione è chiamata.Modernizing administration through reforms (and through legislation as the most important tool for reform) is not a simple question. Reforms are not always useful to achieve benefits greater than the costs they produce; rather, they often have generated few results and huge costs. On one hand, bureaucracy, administrative corruption, and the inertia in the method of reform are all obstacles to modernization; on the other hand, reforms intervene on administrative organization, underestimating the role of the bureaucracy. The Author analyses the question from a comparative perspective, highlighting that legislation is, in reality, a tool unfit for the purpose of reforming and modernizing, because it freezes a status quo and limits the need for continuous innovation, which characterises modern administration

    Legislation has been long time subject of a dedicated science (science of legislation) and of a specific technique (legislative drafting). While in both perspectives quality of legislation has been considered relevant, nowadays the problem seems how achieving quality of legislation in a context characterized by highly accelerated technological innovation. From this point of view, quality vs quantity of legislation may be a real criterion in order to choose among technological solutions as well as to manage them effectively in the legislative process. Moreover, the article shortly analyze, in a procedural and critical way, some of the technological solutions with potential impact on quality of legislation by concluding that the artisanal dimension in the legislative process (based on the primacy of the human) should be strengthened, as far as possible, to maximize the contribution of technological innovation to legislative quality
