As in former reflections by the same author on the topic, it is argued that the scientifically category of the ‘general clauses’ is too vague and uncertain, because of the different causes described in the essay. The given suggestion is to classify the several general clauses in more analytical subtypes, that would allow to better answer a series of issues raised by the study of the general clauses

Teodorico Pedrini: The Music and Letters of an 18th-century Missionary in China
No full textPeter Allsop and Joyce Lindorff originally intended to investigate the origin of Arcangelo Corelli’s influence on the sonatas of Teodorico Pedrini, a Vincentian who served in China’s imperial court from 1711 to 1746. He was at the center of the conflict over the Chinese Rites, which led to the suppression of the first Catholic mission to China. During their research, Allsop and Lindorff discovered a wealth of letters and diaries by or about Pedrini. His music and his capacity as court music master were “key to his unequalled intimacy with a succession of Chinese emperors.” Allsop and Lindorff review the past research on Pedrini, explore his relationship with Emperor Kangxi, and explain the importance of music and multiculturalism at court. Pedrini’s music is also discussed

from its relationship with Hans Kelsen’s theory, of which Winkler himself
stands as one of the more established scholars. The Author agrees with the
kelsenian goal of an avalutative juridic science – a key idea in methodological
positivism – that would describe law as it is rather than as it ought to be.
However the means to this end are of a different kind from Kelsen’s ones: notably,
they diverge in the categorical distinction of Sein and Sollen, and in the
conception of interpretation as a positive law-independent operation.
Winkler advances an empirical-rational, space and time-related concept of
law, into which interpretation works as a tool for recollecting the given content
of norms, in a sound and epistemically correct way

No full textThe electrical distribution architecture has a vital impact on performance of the installed system throughout its lifecycle. The design of a power system like an hospital has to be comprehensive in regard to the system traditional design configuration aspect as well as its operational safety aspect, such as management and maintenance. The comprehensive design has to survey and define both aspects during the different design phases and during the overall operational life cycle of the system. The architecture of an installation involves the configuration, the choice of power sources (utility and alternate power source) the definition of different distribution levels and the choice of equipment. Each node presents a kit of instructions as a logic gene describing a complete and reversible evolution of the component switching means from a opening status to a closing one. Previous papers have introduced a language-program for analyzing and transcribing the instructions of safety procedures for each working zone WZ and of integrity procedures for each sources node versus the loss of service continuity (Parise program).
This paper discusses the impact of the architecture on the comprehensive procedures for a complex system. To enhance the integrity of power system analysis and operation, the design could adopt the cut and tie rule, introducing ring configuration and floating nodes. The suggested advanced approach assists in the elaboration of the procedures for switching from one set or configuration of a power system to another and will help the training of operators in defining the instructions to be used in the development and the operating of each power system

Essi narrano non solo le violenze e le abiezioni osservate e subite, ma esprimono anche un messaggio fondamentale: solo l’istruzione diffusa, l’educazione al senso critico e alla partecipazione sociale avrebbero potuto arginare la riemersione dei regimi totalitari e garantire la pacifica convivenza tra i popoli
