A New Human Rights-Based Approach to the UN Watercourses Convention
The UN Secretary-General's Advisory Board on Water and Sanitation calls on governments to ratify and implement the 1997 UN Watercourses Convention (UNWC) in accordance with Target 7C of the Millennium Development Goals concerning the provision of sufficient water to sustain human life. This call makes clear the dynamic interaction between two different legal regimes: human rights and international water law. With a view to enhancing the interaction between these two regimes, this paper proposes a new human rights–based approach to the interpretation of UNWC founded upon a state's positive obligations

Le contrôle de l’exécution des arrêts de la Cour européenne de droits de l’homme
Cette article a pour objet, après avoir fait une brève analyse de l’efficacité obligatoire des arrêts de la Cour Européenne des Droits de l’Homme, d’analyser en particulier l’activité du Comité des Ministres du Conseil de l'Europe. Une brève réfé-rence est aussi faite à la pratique de la Cour et de l’Assemblée parlementaire, en raison du rôle limité qu’elles jouent dans la phase du contrôle. Ensuite, quelques réflexions seront faites à propos de la réforme adoptée à travers le Protocole modificatif n. 14, approuvée le 13 mai 2004 et qui est entrée en vigueur en juin 2010

La disciplina della ricerca scientifica in mare alla luce della recente prassi internazionale
This paper analyses to what extent the 1982 UN Convention on the Law of the Sea, especially Part XIII, is challenged by the UN Decade for Ocean Sciences for the Sustainable Development, covering from 2021 to 2030. It argues that State practice shows a paradigm shift: from a system of unilateral scientific research to multilateral scientific coordination and cooperation at international and regional level. Multilateralism allows the achievement of a balance between the freedom of research of all States and the protection of interests of coastal States. This paper suggests that regional cooperation may provide the best solution for attaining sustainable scientific goals and creating favourable conditions to boost the progress of ocean sciences

La presente monografia studia l’evoluzione della disciplina degli spazi internazionali alla luce di crescenti e nuovi utilizzi resi possibili dal sempre più rapido avanzamento tecnico-scientifico. La finalità primaria è quella di indagare le principali dinamiche ed evoluzioni normative che influenzano la condizione giuridica ed il regime di utilizzazione degli spazi presi in considerazione. In particolare, si sofferma sul processo di adeguamento normativo che sembra oggi avvenire sulla base di una integrazione del criterio spaziale con quello funzionale per la definizione e determinazione dei rapporti tra ciascuno Stato e gli altri Stati in relazione ad uno spazio internazionale

Digital surveillance has sometimes been deemed a ‘dangerous habit’ of States or as ‘a valuable tool’ for ensuring national security. At any event, the general perception seems to be that surveillance measures are ‘highly intrusive acts’ mostly impinging on the enjoyment of human rights of individuals or groups. The general research object of this paper focuses on when State digital surveillance violates international human rights law, specifically the right to privacy and the freedom of opinion and expression. Additionally, it highlights recent developments on advancing responsible behaviour of States in cyberspace and its impact on the human rights framework within the context of national security strategies

A reflection on political globalization and human rights
In In the current era of political globalization, States maintain their traditional role of protagonist in the international (human rights) system. At the same time, however, they are expected to devise instruments that will maximise their ability to adapt to the needs of an effective protection of human rights due to the ‘present-day conditions.’ Indeed, if one pauses to reflect on the increasing diversity of international actors and consider ‘international law in her infinite variety,’ the question is whether the international human rights regime of today is in fact different today from that of previous eras. This study focuses on the extent to which political globalization is transforming (or not) the conditions under which international human rights law operates and how far political globalization is associated with ‘new limits’ to, or alternatively ‘new forms’ of international human rights law (if any)
