Sprawa Jadhav jest piątym sporem w orzecznictwie MTS opartym na art. 36 Konwencji wiedeńskiej o stosunkach konsularnych z 1963 r. W umowie tej strony przewidziały m.in. natychmiastowe zobowiązanie państwa przyjmującego do powiadomienia właściwego urzędu konsularnego o zatrzymaniu obywatela państwa wysyłającego. Autor w artykule wskazał na szereg błędów interpretacyjnych popełnionych przez MTS w wyroku z 17 lipca 2019 r.Jadhav Case was the fifth dispute in the ICJ judicature based on Article 36 of Vienna Convention on Consular Relations 1963 (after cases: Bread, La Grand, Avena and Diallo). Kulbhushan Sudhir Jadhav was an Indian spy convicted by the Pakistani military court for death sentence. In 2017 India submitted an application to ICJ and indicated that Pakistan had breached Article 36 of Vienna Convention by failing to fulfil its obligation versus Indian consular officers and Indian detained citizen Jadhav. There was in this case however an important question concerning relation between Vienna Convention and bilateral treaties' rules as regulated in art. 73 of Vienna Convention. The legal situation of detainee and construction of consular notification in Jadhavwas different in this case from the situations in other ICJ cases concerning consular access, where there were no bilateral agreements among states. There is however such a treaty on consular access signed in 2008 in Islamabad between Pakistan and India (UNTS No 54471). In this agreement parties provided i.a. an immediately obligation of receiving state to notify the appropriate consular post of detention of citizen of the sending state. The individual right in such case does not exist. There is a question wheatear ICJ properly identified rules of consular law, which should be applied in Jadhav Case. The paper analyses this problem in critical manner. Author in this paper pointed out several interpretative mistakes made by ICJ in Judgement from 17 July 2019

Data-Driven Approach for Modeling the Mixed Traffic Conditions Using Supervised Machine Learning

    No full text
The article describes modeling vehicular movements using supervised machine learning algorithms with trajectory data from heterogeneous non-lane-based traffic conditions. The trajectory data on the mid-block road section of around 540 m is used in the study. Supervised machine learning algorithms are employed to model the vehicular positions. A set of parameters were identified for modeling the longitudinal and lateral positions. With the set of parameters, the algorithm’s potentiality for mimicking vehicular positions is evaluated. It was identified that supervised machine learning algorithms would model the vehicles’ positions with accuracy in the range of 20–60 mean absolute percentage error. The k-NN algorithm was marginally edging past all algorithms and acted as a promising candidate for modeling vehicular positions.Green Open Access added to TU Delft Institutional Repository ‘You share, we take care!’ – Taverne project https://www.openaccess.nl/en/you-share-we-take-care Otherwise as indicated in the copyright section: the publisher is the copyright holder of this work and the author uses the Dutch legislation to make this work public.Transport and Plannin

    Fading correlation of co-located transmitters

    No full text
Fading or attenuation of a signal due to environment is a phenomenon often encountered in wireless communications. It is expected that co-located transmitters i.e. transmitters placed very close to each other show a high signal fading correlation due to the presence of similar fading environment. In this thesis, we present an experimental study of this phenomenon. Correlation of received signal strengths obtained from co-located transmitters in dynamically varying environments indicate that the large scale signal variations (shadow fading) are highly correlated while the small scale variations (multipath or fast fading) show a low correlation. Highly correlated large scale variations suggest a presence of same large shadowing elements in the transmit-receive path while a low correlation among the multipath variations is due to mutual coupling between the antennas at very close distances. This has two implications: it suggests that shadow fading variations can serve as an indicator of the co-location of closely spaced transmitters while the multipath variations cannot. However, low multipath signal correlations suggest that antenna diversity could be investigated for implementation in mobile handsets.M.S.Includes bibliographical referencesby Prashant Jadha

Sull'obbligo degli Stati di registrare gli accordi internazionali presso il segretariato generale delle Nazioni Unite: il caso Jadhav

    No full text
This paper discusses the Jadhav case submitted to the ICJ by India against Pakistan on 8 May 2017. The case concerns the alleged violation of the 1963 Vienna Convention on Consular Relations with regard to the detention and trial of an Indian national who was sentenced to death by a Pakistani military court. Pakistan claimed to have applied the 2008 bilateral Agreement on Consular Access, providing that “in case of arrest, detention or sentence made on political or security grounds, each side may examine the case on its merits”. Nonetheless, according to India, the bilateral Agreement cannot be invoked before the ICJ, as it was not promptly registered with the UN Secretariat, inconsistently with Article 102 of the UN Charter. The author does not share such a formalistic interpretation of Article 102. This provision aims at discouraging secret treaties. Since the bilateral Agreement has never been secret, it could be invoked before the ICJ regardless of its registration. Hence, it was not necessary for Pakistan to register the bilateral Agreement after India had instituted proceedings before the ICJ

Becoming psychologists in Ecuador: a critical ethnography of trainees' professional identity

This thesis is an ethnography of the way psychologists construct their professional identities during their training in a State-funded Ecuadorian University, approached from the perspective of Critical Psychology. Considering the field´s theoretical bias, critical psychologists have called for qualitative data that contribute to ongoing discussions. Responsive to such call, this thesis asked the question: “How do psychologists in contemporary Ecuador construct their professional identity?” The author conducted a twelve-month critical ethnography, focusing on a particular training facility as a strategic site; from there, the inquiry extended to so-called “vulnerable” and “marginal” places, where trainees performed their preprofesional and professional roles. Findings highlight how the negotiation of professional identity is a “messy”, subject-dependent and context-dependent process shaped by power. Trainees dwelled between the coloniality of hegemonic psychology, and a – mostly veiled - cultural resistance to it. They embodied a “dual belonging”, being members of “professional” and “popular” worlds simultaneously. Trainees learned a “help-as-war” metaphor: utilising foreign theories and methods to help allegedly ignorant and in-deficit subjects, even if this implied disrespecting their culture and needs. To unpack the local professional – popular interactions which shape – and are shaped by - professional identity, the author suggests the working category of “liminal exchanges”, which integrates classic Freirean conceptualisations with relevant anthropological insights regarding gift giving. Findings stress the need to construct a more critical psychology training, one which acknowledges the “messiness” of professional identity and responds more congruently to the culture and needs of the people. This would require in-group and intergroup processes of conscientización; reinforcing our commitment with social justice while avoiding unfruitful purism; accepting enabling contradictions; and articulating the fight for structural transformations with small-scale performative changes. The ethnographic evidence presented in the thesis has significant implications for ongoing debates within Critical Psychology and related fields, at a local and global scale

    Get PDF
The term Arrhythmia refers to any change from the normal sequence in the electrical impulses. It is also treated as abnormal heart rhythms or irregular heartbeats. The rate of growth of Cardiac Arrhythmia disease is very high & its effects can be observed in any age group in society. Arrhythmia detection can be done in many ways but effective & simple method for detection & diagnosis of  Cardiac Arrhythmia is by doing analysis of Electrocardiogram signals from ECG sensors. ECG signal can give us the detail information of heart activities, so we can use ECG signals to detect the rhythm & behaviour of heart beats resulting into detection & diagnosis of Cardiac Arrhythmia. In this paper new & improved methodology for early Detection & Classification of Cardiac Arrhythmia has been proposed. In this paper ECG signals are captured using ECG sensors & this ECG signals are used & processed to get the required data regarding heart beats of the human being & then proposed methodology applies for Detection & Classification of Cardiac Arrhythmia. Detection of Cardiac Arrhythmia using ECG signals allows us for easy & reliable way with low cost solution to diagnose Arrhythmia in its prior early stage

Morphing Matter is a soft-robotic material with a bit of a personality. When applied to the seated context, it can sense posture and simply nudge the user in the right direction by providing support through the contact surface. This project focuses on developing a scalable soft robotic material with programmable behaviour. The project is aimed at creating a tool for the exploration of how dynamic seating can be designed to trigger behavioural change for health and wellbeing. This highlights a quality that we can expect most materials of the future to demand: the ability to be dynamic!
