New procedure for electronic deliveries in administrative proceedings
Przedmiotem niniejszego opracowania jest problematyka znowelizowanej procedury doręczeń elektronicznych w postępowaniu administracyjnym jurysdykcyjnym regulowanym przepisami Kodeksu postępowania administracyjnego. Podstawowym celem badawczym nie było wyłącznie opisanie de lege lata trybów doręczeń indywidualnych z oznaczeniem ich wzajemnej hierarchii, lecz również wiele zagadnień związanych ze wzajemną relacją kodeksu i ustawy o doręczeniach elektronicznych. Oba akty normatywne wymagają bowiem współstosowania, a w ślad za tym oznaczenia, który z nich, w jakich wariantach sytuacyjnych kwalifikować będziemy jako lex generali. Zadania tego nie ułatwiają bynajmniej okoliczności, iż cech regulacji ramowej dopatrzeć się można w k.p.a., natomiast u.o.d.e. „modelowo” reguluje zasady komunikacji z udziałem podmiotów publicznych. Główną tezą zaprezentowaną w opracowywaniu jest konieczność systemowego interpretowania postanowień te ostatniej. Autorka stoi również na stanowisku, że określenia zakresu wyłączeń od stosowania ustawy nie ukształtowano prawidłowo. Poruszona problematyka nie była dotychczas przedmiotem opracowań artykułowych.The subject of this study is related to the new procedure of electronic deliveries in administrative jurisdictional proceedings regulated by the provisions of the Code of Administrative Procedure. The main research objective was not only to describe de lege lata the modes of individual deliveries with the indication of their mutual hierarchy, but also several issues related to the mutual relationship between the Code and the Act on electronic deliveries. Both normative acts require co-existence, and thus the determination of which of them, in which situational variants, will be qualified as lex generali. This task is by no means facilitated by the fact that the characteristics of the framework regulation can be found in the code, while the Act “model” regulates the rules of communication with the participation of public entities. The main thesis presented in the study is the need for systemic interpretation of the provisions of the latter. The author is also of the opinion that the definition of the scope of exclusions from the application of the Act was not designed correctly. The issues raised have not been the subject of articles so far

Both normative acts necessitate co-existence, and thus determining which of them and in which situational variants will be qualified as lex generali. This task is by no means facilitated by the fact that the characteristics of the framework regulation can be found in the Code, while the Act “model” regulates the rules of communication involving public entities. The paradigms for distinguishing between private law and public law
To conclude the above discussion it needs to be stressed that it is extremely important to try to find the borders between public law and private law. These borders should be searched for by way of improving the existing type models. The practical example of using the typology method in the Polish legal doctrine is the assessment of the character of property dispossession claim. The presented example clearly indicates the degree to which social sciences are interconnected. The change in social attitudes indirectly affects the general philosophy, which in turn reflects in legal philosophy. The change of a paradigm in legal philosophy, for example a switch from legal natural paradigm to positivist paradigm steadily reveals itself in the paradigm of dogmatic sciences, e.g. in the used methods of interpretation (and their respective value) and the division of more detailed sciences. Social sciences paradigms influence one another and are closely interconnected
