    The volume Affirmative Actions after the NRRP collects the proceedings of the seminar held on March 8, 2024. It builds on discussions that began in 2022 through an initiative by the University of Brescia and the University of Verona, under the patronage of the LLC – Labour Law Community and the IEN – Italian Equality Network, focusing on key issues in gender-sensitive labor law. The scientific discussion accompanying the seminar focuses on a specific issue: the neutralization of positive actions, which are now applied not just in favor of women but also to support the underrepresented sex. This shift calls for a reevaluation of the foundational values behind differential treatment, in order to assess how recent legislative changes align with their original rationale and structure. The in-depth analyses presented in the volume, which expand upon the discussions held in Brescia, include Cristina Alessi's reexamination of the concept of positive actions between domestic and EU law: principles and application tools. Laura Calafà explores the use of gender preference in public competitions, analyzing its principles, rules, and inherent paradoxes in light of the objectives set by the Italian NRRP. Also, within the NRRP framework, Madia D’Onghia investigates the system of gender-based incentives in public administration. Contributions by Barbara Pezzini and Thomas Casadei further enrich the discussion by offering insights from the perspectives of constitutional law and legal philosophy. The volume concludes with Marzia Barbera's reflections on the debates surrounding the complex theoretical and practical challenges of the present: “accepting the challenge posed by the conservative reinterpretation of equality as mere formal equality. Just like justice, equality has many faces, some of which are distorted masks shaped by ideology. What lies ahead is, first and foremost, an effort to unveil these distortions. That we can face this challenge together, I believe, is an invaluable source of strength”

    A labour law analysis of Article 18-ter of the Italian Immigration Act, by Laura Calafà The author offers an interpretation of the new protection permit for migrants who are victims of labour exploitation and caporalato attentive to labour law sensitive to the fundamental rights of persons. After an introduction dedicated to the worst forms of labour (at a national and international level), she focuses on the method of labour law research applied to the emersion and protection of the migrant workers, outlining a perimeter of disciplinary interest that is broader and different from the traditional one. Particular attention is dedicated to the interpretation of the law that provides among the requirements for the recognition of the permit the existence of «situations of violence or abuse or otherwise exploitation». The systematic interpretation offered takes into account the operation of the referral system at the national level, the dedicated subjects among which are the labour inspectors and the so-called street union that operates in a complex context of public-private relations at the local level, that level at which the so-called multi-agency method of operation supported by dedicated operating instructions is operated

    Collective autonomy and the EU Gender pay gap Directive, by Laura Calafà e Marco Peruzzi The essay addresses the issue of the national implementation of directive 2023/970/EU, highlighting the peculiarities of the Italian context with regard to the relationship between the national pay system and the evaluation system required by the directive. The topic is examined with particular attention to the collective bargaining dynamics of equal pay, whose logic has been anticipated by past doctrine, updated to the implementation of the directive by 7 June 2026. Specific attention is given to gender-sensitive collective bargaining processes and the functioning of joint evaluation under the directive. The conclusions outline a roadmap for implementation, with reference to both the private and public sectors

    For a multidimensional approach to labour exploitation, by Laura Calafà The essay addresses the theoretical issue of labour exploitation in labour law starting from the pyramid drawn up by the European Union Agency for Fundamental Rights (FRA) to graphically represent the phenomenon of labour exploitation. At the bottom of the pyramid are represented the least severe forms of exploitation, while the top of the pyramid represents the slavery. After recalling the facts that have most recently showed the issue of labour law exploitation in Italy (the attacks on migrant workers in agriculture in the Plain of Gioia Tauro, in Rosarno), the essay focuses on its multiple regulatory dimensions (International law, EU law and domestic law, with particular regard to Criminal law). The issue of labour law exploitation not only has multiple regulatory dimensions, but also theoretical ones. The economic exploitation of labour is a large part of the theory of surplus value, while considerations related to materialist feminism underline how empowerment is a central topic. The theoretical approach to fundamental human rights, moreover, leads to a limiting response to the private powers of employers in dialectical relation with the Marxist theory of exploitation. The labour exploitation in its multiple dimensions can be expressed with the term intersectional exploitation.     La riflessione sulla città gender sensitive nell’Annuario del CDS dedicato all’Urbanistica nel 2025 include un dialogo dedicato alla città tra Elena Granata, autrice di Il senso delle donne per la città (Torino 2023) e Laura Calafà, giurista del lavoro, che dal 2000, anno di pubblicazione della l. 53 intitolata Disposizioni per il sostegno della maternità e della paternità, per il diritto alla cura e alla formazione e per il coordinamento dei tempi delle città, si occupa di strumenti di conciliazione vita e lavoro in prospettiva giuridica. Sono diversi i metodi di ricerca e gli approcci al tema nei due diversi ambiti disciplinari. Per alimentare un confronto attento alla dimensione gender sensitive della città, le A. hanno deciso di rispondere a tre questioni distinte che segnalano lo sguardo del diritto e dell’urbanistica, in successione, ma con un identico obiettivo quello attento all’impianto antimaggioritario coerente con la logica antidiscriminatoria applicata in ogni contesto. Ci si è interrogate sul soggetto nell’urbanistica e nel diritto, sulla declinazione della questione del coordinamento dei tempi della città e sul rapporto tra teoria e pratica in discipline attente alla dimensione della realtà della città in cui si coniugano tempi e spazi e non solo architetture teoriche o diritti formali delle persone e delle comunità (rectius: collettività, più o meno organizzate)
