    This paper examines the legal link between the individual right to pension benefits and the five-year limitation period for payment of social security contributions. The Author proposes a critique of the recent case law of the Italian Supreme Court which denied this link, consequently denying workers the right to obtain public coverage of contribution gaps caused by employer omissions. Taking its cue from a recent ruling of a Tribunal, the article explores the soundness and the implications of the hypothesis of postponing the deadline for payment of social security contributions until the end of the employment relationship. Such an idea would mitigate the injustices created by the aforementioned Supreme Court ruling. However, according to the Author, it would have excessively burdensome implications for employers. In order to achieve a balance between pension rights, the protection of entrepreneurs in their relations with the social security administration and the protection of the latter's finances, it seems preferable to restore the legal significance of the five-year limitation period as a limit of public coverage against social security contribution omissions. The recent cancellation of this protection should be submitted to the Constitutional Court for review

    Criticising Court of Cassation caselaw which denies the worker’s right to obtain amendments at I.N.P.S.’s cost of employer’s omissions of compulsory contributions for pensions, this paper argues the existence of a full right of the worker to the correct updating of his position in public data-base of due contributions. According to the author, this right can be recognised not only at retirement age, but already from the ini-tial establishment of each employment relationship, which is followed by an immediate obligation of the employer to pay pension’s contributions. In addition to systemic and value-based arguments, also ac-cording to the relevant caselaw of the Italian Constitutional Court, this paper is based on a specific con-struction of Article 27, paragraph 2, Royal Decree Law no. 636/1939 as modified in 1972

    This paper critically examines the case law of Italian Supreme Court of Cassation that denies quasi dependant workers the application of the legal protection issuing public coverage of contributions’ omissions caused by principals who do not pay pension’s compulsory contributions due to INPS (which is the main Italian social security authority). This protection is set out in Article 2116 of the Italian Civil Code, for the case of insolvency and of undeclared work. According to the author, this case law is based on a construction that is inconsistent with the textual tenor of the law and, moreover, it does not take into account the similarity of factual conditions between quasi dependant workers and employees, to whom this legal protection applies

    Il saggio esamina il rilievo dell’informazione nel triangolo di rapporti giuridici di previdenza sociale tra lavoratore, datore ed ente previdenziale. In questo ambito amministrativo, l’avvento del fattore tecnologico deve essere valutato assai favorevolmente: la recente telematizzazione degli archivi contributivi di molti degli enti favorisce una più rapida ed efficace circolazione delle informazioni, nell’interesse dei singoli lavoratori ed anche della collettività. In particolare, il presente scritto analizza la posizione giuridica soggettiva del lavoratore nei confronti degli enti previdenziali, i quali hanno l’obbligo della corretta conservazione e messa a disposizione anche telematica dei dati contributivi relativi alle carriere individuali. In proposito viene argomentata una responsabilità di tipo lato sensu contrattuale in caso di danni sofferti a causa di erronee informazioni comunicate dall’ente previdenziale al cittadino. Tale tipo di responsabilità deve ritenersi ravvisabile anche al di fuori dell’ipotesi espressamente prevista dall’art. 54 della l. n. 88/1989

    El interés del trabajador en el ingreso de sus cuotas a la seguridad social en el sistema de protección social italiano

    El art. 2116 del Código Civil italiano establece que las prestaciones sociales «se deben al trabajador, incluso cuando el empleador no haya ingresado de forma regular las cuotas debidas a la Seguridad Social», siempre que dicha deuda no se haya extinguido por prescripción. Este artículo enfatiza el nexo jurídico entre esta cobertura asistencial pública “automática” y el plazo de extinción por prescripción de las cotizaciones a la Seguridad Social en el sistema italiano de protección social. En dicho nexo, establecido por el legislador, se puede constatar una función de incentivo a la vigilancia del trabajador sobre la integridad de su posición contributiva respecto a las futuras prestaciones de la Seguridad Social. Para incentivar las denuncias de omisión contributiva, hay que distinguir claramente entre el derecho a la libertad de expresión del trabajador y el derecho de denuncia ante las autoridades de vigilancia, al que no hay que imponer los límites de ejercicio propios del primero. Es importante, sobre todo, la eficacia disuasoria de la tutela legal contra cualquier reacción de represalia del empleador

    This paper analyses recent regulatory developments in the area of sustainable investments, i.e. consistent with respect to so-called ESG factors, particularly with regard to supplementary pensions. In the first part of the paper, an overview of the complex European and national regulatory stratification is offered. The adoption of socio-environmental criteria is merely an option for institutional investors, it being understood that these variables must in any case be included in the prudential assessment of risks inherent in financial markets. There is a high degree of detail on the information transparency obligations that must also be fulfilled by private pension funds in this regard. In the second part of the paper, the prohibition introduced by Law No. 220/2021 on the financing of companies involved in the trade of anti-personnel mines and cluster munitions is examined. This prohibition came into force in 2025, following instructions issued by the supervisory authorities applies to all Italian institutional investors. It imposes a delicate investigation and advisory activity on the individual stocks and bonds in the portfolio of each pension fund, as well as on the securities whose purchase is planned. The Italian law has set out a balancing of values whereby the prospects of a financial return on retirement savings are balanced against the public interest in discouraging the trade in such nefarious devices. In conclusion, it appears that, for the proper implementation of this law and, more generally, for the effective implementation of investment policies based on eco-social criteria, it is essential to strengthen the formal and informal dialogue between the portfolio manager and the directional bodies of each pension fund

    This essay highlights the different rationales of the legal disciplines applicable to private and public work as regards the limitation period for claims concerning the payment of social security contributions. In the case of employers in the private sector, the legislation provides for an incentive encouraging workers to report failure to pay contributions to public authorities. A different purpose is implied by public employment laws, according to which the employee is not subject to a deadline for reporting incomplete social security contribution files, which now can be regularized by public employers with greater ease on the basis of art. 19 of Legislative Decree no. 4/2019 (on the other hand, this new provision could also be seen as one allowing more claims by social security authorities for the payment of old compulsory contributions)

    El presente artículo examina, en primer lugar, la disciplina jurídica que regula los requisitos por razón de edad y años cotizados necesarios para la jubilación en Italia. En particular analiza la principal novedad introducida con el Decreto Ley n.o 4/2019, es decir, la jubilación anticipada a “cuota 100” que requiere al menos 38 años de cotización y 62 años de edad, siempre que se obtengan como máximo en 2021. Se trata de una reducción de 5 años de edad respecto a los anteriores requisitos de jubilación. Esta intervención legislativa de 2019, asimismo, ha suspendido hasta 2026 la consideración jurídica de la esperanza de vida que aumentaba de forma automática los requisitos de jubilación (establecido con una importante normativa de 2010-2011). La opinión del autor es que estas recientes ventajas para la jubilación son un privilegio incoherente respecto a la evolución del sistema de pensiones italiano de las últimas décadas. En segundo lugar, el presente trabajo contextualiza el citado marco jurídico, mediante los principales datos económicos y demográficos que caracterizan el sistema de pensiones italiano. A la luz de dichos datos estadísticos, el autor opina que el sistema italiano sufre una serie de desequilibrios que ponen en peligro la viabilidad económica y social a medio-largo plazo. El desequilibrio más grave es el generacional, ya que pone en desventaja a los trabajadores más jóvenes

    L’articolo approfondisce il nesso giuridico tra la copertura previdenziale cosiddetta automatica ex art. 2116 c.c. e il termine quinquennale di prescrizione dei contributi pensionistici. In tale nesso viene ravvisata una funzione d’incentivo alla sorveglianza del lavoratore sull’integrità della sua posizione previdenziale ai fini delle prestazioni d’invalidità, vecchiaia e superstiti. Per favorire le denunce d’omissione contributiva e quindi l’emersione delle condotte datoriali illegittime, è importante individuare un ampio margine di legittimità delle rimostranze dei lavoratori: all’esercizio del diritto di effettuare segnalazioni e richieste d’intervento alle autorità di vigilanza ispettiva, secondo l’opinione preferibile non sono applicabili i limiti di continenza formale e verità sostanziale propri del diritto di pubblica critica. Parimenti importante è l’esistenza nell’ordinamento di efficaci tutele contro le eventuali reazioni ritorsive datoriali. In particolare, resta cruciale la funzione strumentale che, ai fini dell’effettiva fruizione dei diritti in costanza di rapporto lavorativo, hanno i limiti giuridici al licenziamento con il relativo apparato rimediale. Quest’ultimo è stato rafforzato dalla l. n. 179/2017 sul c.d. whistleblowing e soprattutto dall’importante pronuncia della Consulta n. 194/2018 sulle indennità risarcitorie in caso di licenziamento illegittimo di lavoratori assunti in base al d.lgs. n. 23/2015.This essay explores the link between the so-called automatic social benefits coverage pursuant to the first paragraph of Article 2116 of the Italian Civil Code and the five-year limitation period for the payment of compulsory contributions of social security. The function of this legal link can be seen as one encouraging the employee to supervise the completeness of payments registered in his social security contributions account for the purposes of invalidity, old age and survivors benefits. In order to encourage the allegations of failure to pay contributions and, therefore, the emergence of illegal employer conducts, it is important to identify a wide margin of legitimacy for workers’ complaints: the limits (linguistic self-restraint and substantial truth) applicable to individual right of public criticism should not apply to the right to make reports and requests for intervention to public authorities. Equally important is the existence of effective protections in the legal system against any retaliatory reactions by employers. For the purposes of effective fruition of the rights arising from the employment relationship, the legal limits to dismissal remain crucial. Protections against unlawful dismissal were strengthened by law no. 179/2017 on whistleblowing and, above all, by the ruling of the Italian Constitutional Court no. 194/2018 on monetary indemnities in the event of unlawful dismissal of workers hired in accordance to Legislative Decree no. 23/2015
