Through the investigation of a few (exemplary) fragments coming from the jurisprudential literature
between II and III century A.D., this article examines some peculiar features of language and
argumentation of the Roman jurists. In particular, the author dwells upon their (flexible, but) strict
terminology in describing cases, explaining and justifing the respective solutions, quoting and praising
– or causing a difference of opinions – the thought of other prudentes (especially through valuations of
veritas, elegantia or ratio with regard to previous interpretations and theories)

Questo contributo è dedicato al valore (e problema) della certezza del diritto nella cultura giuridica greca. L’assenza di giuristi e di un concetto di diritto, come distinto da altre funzioni sociali, rende difficile, ma non impossibile, questa ricerca. In particolare l’autore esamina il contributo del pensiero filosofico, tra Platone e Aristotele (e Teofrasto), anche in confronto con una prima fonte retorica (l’opera di Lisia).This paper focuses on the value (and problem) of legal certainty in the Greek legal culture. The absence of jurists and of a concept of law, as distinct from other social functions, makes this research difficult, but not impossible. In particular, the author examines the contribution of philosophical thought, between Plato and Aristotle (and Theophrastus), also in comparison with a first rhetorical source (the work of Lysias)

This paper focuses on some aspects of Roman jurisprudential literature
between II and III century B.C., in particular with reference to the largest diffusion of a
genus scribendi: the notae on previous texts of jurists (more or less far in the time). The
author examines the chief traits in this annotations (also with respect to other works, like
commentaries, libri ad, libri ex et cetera), their overall meaning in the history of Roman
legal science, their role in the literary production of various prudentes and the relations
between jurists annotated and annotators

Quest’articolo affronta le concezioni e il lessico della guerra nell’antica Grecia, e in particolare nel pensiero storico e filosofico del V e IV secolo a.C. (Erodoto, Tucidide, Platone, Aristotele etc.). L’autore studia soprattutto il significato (che nelle fonti non è sempre il medesimo) dei termini stásis e pólemos, le relazioni fra essi e i problemi politici e giuridici relativi alle nozioni di díkaios pólemos e di díkaia aitía (o arché) della guerra.This article examines the ideas and the lexicon of the war in the ancient Greece, especially in the historical and philosophical thought of the V and IV century b.C. (Herodotus, Thucydides, Plato, Aristotle etc.). The author studies mainly the meaning (which isn’t always the same in the sources) of the words stásis and pólemos, the relations between them and the political and juridical problems concerning the notions of díkaios pólemos and díkaia aitía (or arché) of war
Il fascino delle origini. I molti ‘inizi’ del diritto nell'Enchiridion di Pomponio
Questo contributo è dedicato ad alcuni aspetti problematici della storia del diritto romano, per come illustrata da Pomponio nell’Enchiridion (D. 1.2.2.2). In particolare l’autore esamina il modo nel quale Pomponio descrive le origini del diritto: prima di Romolo, nell’età dei re —con le loro prescrizioni, raccolte da Papirio— e poi delle XII Tavole (con la connessa interpretatio prudentium), al tempo dei Tripertita di Sesto Elio e poi dei tre giuristi (Publio Mucio, Bruto e Manilio) qui fundaverunt ius civile. Perché Pomponio parla di così tanti diversi momenti, tutti rappresentati come origini del diritto? La questione rimane aperta, ma è forse possibile formulare alcune ipotesi.This paper focuses on some problematic aspects of the history of Roman law, as illustrated by Pomponius in the Enchiridion (D. 1.2.2.2). Particularly the author examines the way in which Pomponius describes the origins of law: before Romulus, in the age of kings —with their statutes, collected by Papirius— and then of the XII Tables (with the connected interpretatio prudentium), at the time of Sextus Aelius’ Tripertita and then of three jurists (Publius Mucius, Brutus and Manilius) qui fundaverunt ius civile. Why does Pomponius speak of so many different moments, all represented as origins of law? The question remains open, but it is perhaps possible to formulate some hypotheses

Smad7 Antisense Oligonucleotide in Crohn’s Disease: A Re-Evaluation and Explanation for the Discordant Results of Clinical Trials
In Crohn’s disease (CD) and ulcerative colitis (UC), the major inflammatory bowel diseases (IBD) in human beings, the tissue-damaging inflammatory response is characterized by elevated levels of Suppressor of Mothers Against Decapentaplegic (Smad)7, an inhibitor of the immunosuppressive cytokine Transforming Growth Factor (TGF)-β1. Consistently, preclinical work in mouse models of IBD-like colitis showed that the knockdown of Smad7 with an antisense oligonucleotide (AS) attenuated the mucosal inflammation, thus paving the way for the development of an AS-containing pharmaceutical compound, named mongersen, for clinical use. The initial phase 1 and phase 2 studies showed that oral administration of mongersen was safe and effective in inducing clinical remission in active CD patients. However, subsequently, a large multicentered, randomized, double-blind, placebo-controlled, phase 3 trial was prematurely discontinued because of an interim analysis showing no effect of mongersen on the activity of CD. In this study we will discuss recent data showing that the majority of the batches of mongersen used in the phase 3 study were chemically different from those used in the previous clinical trials, with some of them being unable to knockdown Smad7 in cultured cells. The accumulating evidence highlights the need to maintain consistent manufacturing requirements for clinical AS, as well as the potential benefits of in vitro bioassays as a part of quality control. New clinical trials evaluating mongersen’s impact on IBD using chemically homogenous batches will be needed to ascertain the therapeutic efficacy of such a drug
