Il concetto di costituzione in Franco Modugno, fra positivismo giuridico e “giusnaturalismo"
Nel pensiero di Franco Modugno il problema costituzionale essenziale è quello relativo al suo fondamento. L’autore tiene conto della costruzione kelseniana ma se ne distacca, criticandone l’assenza di considerazione della realtà concreta e del contenuto del dato normativo. Lo stesso giudizio costituzionale mostra, al contrario, come il fatto e il diritto si incontrano e si raffrontano, determinando il significato della disposizione normativa. Franco Modugno, proprio a questo riguardo, prende a modello la sintesi hegeliana, sebbene egli ritenga un pregiudizio l’esclusiva statualità del diritto, ritenendo che i contenuti assiologici di un ordinamento siano pre-normativi ma non per questo meta-giuridici. Interessante è poi confrontare la concezione costituzionale di Franco Modugno con il giusnaturalismo. Al riguardo occorre innanzitutto essere consapevoli della difficoltà di accertare quali siano gli elementi caratterizzanti di questa corrente di pensiero, storicamente contrapposta al positivismo. In una prospettiva unitaria, sembra da accogliere la proposta di chi considera giusnaturalista ogni posizione teorica in cui si riconosca la domanda sul fondamento del diritto, la risposta riferita alla natura, comunque intesa e, infine, la forza vincolante di quest’ultima sull’attività normativa dell’uomo. Ebbene, per quanto in Franco Modugno sia presente la critica nei confronti di un certo giusnaturalismo e per quanto egli abbia espressamente negato l’idea del fondamento naturale o extrapositivo dei diritti inviolabili di cui all’art. 2 della Costituzione italiana, le tesi che ha sostenuto non appaiono in definitiva lontane dal giusnaturalismo. Oltre alla domanda sul fondamento dell’ordinamento giuridico, vi è infatti la difesa della possibilità razionale di trascendere l’ordinamento positivo e di ricercarne oltre la validità. Egli ha inoltre ritenuto che il potere di revisione costituzionale è condizionato dalle scelte assiologiche, irretrattabili anche da parte di maggioranze politiche. Ha poi affermato che l’attività ermeneutica è un momento di scelta fra possibili significati normativi, tutt’altro che arbitraria o indipendente dalla realtà e che l’interprete è vincolato a considerare la struttura assiologica immanente nell’ordinamento. In definitiva la stessa continua interazione fra essere e dover essere che Modugno ha costantemente sostenuto, risulta coerente con la concezione del diritto naturale secondo cui, nella dialettica fra Sollen e Sein, il referente ineliminabile è situato al livello del Sein, ossia dell’essere uomo, sia pure inteso non in senso ontologico ma in senso fenomenologico, come capacità della ragione umana di comunicare, persuadere, accettare, aderire e consentire e di ricavare, nella sintesi e nel giudizio, vere e concrete leggi universali o razionali.In the thought of Franco Modugno the constitutional problem is related to its essential foundation. The author takes account of Kelsen's construction, without accepting it, criticizing his lack of consideration of reality and the legal content of the data. His views on constitutional problems show, on the contrary, how facts and the law come together and are compared by determining the meaning of each legal provision. Modugno, precisely in this respect, models his approach on the Hegelian synthesis, although he accepts as a premise the exclusive nature of statehood, arguing that the contents of an axiological order are pre-normative but not for this reason meta-juridical. It is interesting to compare Modugno's constitutional conception with natural law. First, it is necessary to clarify the salient features of this current of thought, historically opposed to positivism. Nowcasting inflation using high frequency data
This paper proposes a methodology to nowcast and forecast inflation using data with sampling frequency higher than monthly. The nowcasting literature has been focused on GDP, typically using monthly indicators in order to produce an accurate estimate for the current and next quarter. This paper exploits data with weekly and daily frequency in order to produce more accurate estimates of inflation for the current and followings months. In particular, this paper uses the Weekly Oil Bulletin Price Statistics for the euro area, the Weekly Retail Gasoline and Diesel Prices for the US and daily World Market Prices of Raw Materials. The data are modeled as a trading day frequency factor model with missing observations in a state space representation. For the estimation we adopt the methodology exposed in Banbura and Modugno (2010). In contrast to other existing approaches, the methodology used in this paper has the advantage of modeling all data within a unified single framework that, nevertheless, allows one to produce forecasts of all variables involved. This offers the advantage of disentangling a model-based measure of ”news” from each data release and subsequently to assess its impact on the forecast revision. The paper provides an illustrative example of this procedure. Overall, the results show that these data improve forecast accuracy over models that exploit data available only at monthly frequency for both countries. Can lateral semicircular canal dysplasia play a role in the genesis of hyperacusis? - La displasia del canale semicircolare laterale può avere un ruolo nella genesi dell’iperacusia?
Hyperacusis can be a prominent and disabling symptom of superior semicircular canal dehiscence associated with autophony and the Tullio phenomenon. We report three clinical cases characterized by disabling hyperacusis in which semicircular canals dehiscence was excluded by temporal bone high-resolution computed tomography. The images disclosed lateral semicircular canal dysplasia, characterized by a small bony island, and dilatation of both the anterior and the posterior arms of the lateral semicircular canal. Cochleo-vestibular examinations (pure tone audiometry, infra-red videonystagmoscopy, vibration-induced nystagmus test, vestibular evoked myogenic potentials) will also be described. To verify the transtympanic ventilation tube effect, bilateral myringotomies tubes were performed in one patient but no long lasting subjective benefit was noted. Concerning the pathophysiology of this condition, we hypothesized that the increased volume of inner ear liquid can modify the micromechanical function of the cochlea and the labyrinthine hydrodynamics. In conclusion, in the case of specific symptoms, such as hyperacusis, it is important to consider the possibility of an inner ear morphological alteration involving the lateral canal and vestibule structures, as well as the existence of bony semicircular canal dehiscence

Superior semicircular canal dehiscence and enlarged vestibular aqueduct.
Superior semicircular canal dehiscence is a well described labyrinthine defect, detect in pediatric population too. We report a case of superior semicircular canal dehiscence, which radiological diagnosis was confirmed by multiplanar reformatted CT images, associated to omolateral enlarged vestibular aqueduct in a 16-year-old female who presented with congenital hearing loss without vestibular symptoms. Both inner ear malformations act as a third mobile window into the labyrinth and cochleo-vestibular symptoms can result from loud sounds or pressure changes. An early diagnosis should be strived for preserve inner ear functions
Do signs of natural plugging of superior semicircular canal dehiscence exist?
Our experience with 102 patients having superior semicircular canal dehiscence confirm that the clinical manifestations of the disease are very diverse; we also identified 3 patients who showed Meniere-like symptoms. Clinical examination during an acute vertigo attack of a patient with Meniere disease for several years and whom we subsequently diagnosed as having large superior semicircular canal dehiscence on the affected side allowed us to hypothesize that a natural plugging of the superior semicircular canal by the overhanging dura mater could be responsible for the recurrence of symptoms. Clinical and instrumental data were very similar to those recorded in 7 of 9 patients immediately after surgical plugging. The aim of the study was to understand which semiological and instrumental elements could be clinically useful, first in distinguishing Meniere disease from superior semicircular canal dehiscence and, secondly, in understanding if signs of natural plugging are presen

The geometry of Newton's law and rigid systems
summary:We start by formulating geometrically the Newton’s law for a classical free particle in terms of Riemannian geometry, as pattern for subsequent developments. For constrained systems we have intrinsic and extrinsic viewpoints, with respect to the environmental space. Multi–particle systems are modelled on -th products of the pattern model. We apply the above scheme to discrete rigid systems. We study the splitting of the tangent and cotangent environmental space into the three components of center of mass, of relative velocities and of the orthogonal subspace. This splitting yields the classical components of linear and angular momentum (which here arise from a purely geometric construction) and, moreover, a third non standard component. The third projection yields a new explicit formula for the reaction force in the nodes of the rigid constraint
