    Lo sfruttamento dei lavoratori nelle catene di appalto

    Il contributo presenta le conclusioni della prima fase della ricerca sulle catene di appalto (subcontracting chains), coordinata dalla Confederazione europea dei sindacati (CES). I sei casistudio svolti hanno mostrato come, nei settori esaminati (l'agroalimentare, le costruzioni, i trasporti e l'industria dell'abbigliamento), l'appalto sia divenuto "il" business model, ossia la normale strategia da adottare per diminuire il costo del lavoro e aumentare i profitti, soprattutto quando si partecipa a mercati globali altamente competitivi. Nel contributo vengono illustrate le forme legali e illegali di sfruttamento lavorativo che hanno luogo nelle catene di appalto e vengono evidenziate le difficoltà dei lavoratori di organizzarsi collettivamente a causa della frammentazione del ciclo produttivo.The article presents the conclusions of the first phase of the research on subcontracting chains, coordinated by the European Trade Union Confederation (ETUC). The six case studies carried out showed how, in the sectors examined (agrifood, construction, transport and garment industry), subcontracting has become "the" business model, i.e. the normal strategy to be adopted to lower labour costs and increase profits, especially when participating in highly competitive global markets. The article illustrates the legal and illegal forms of labour exploitation that take place in subcontracting chains, and the division of the workers' community and the consequent difficulties in organising collective action that the fragmentation of the production cycle implies

    Exchange Rate Volatility and FDI in the EMU Neighborhood Countries

    The purpose of this paper is to analyze the role of exchange rate volatility in explaining the evolution of FDI inflows in the EMU neighbourhood countries. Examining the question in the framework of an empirical model that considers the major macroeconomic determinants of FDI, the results of the paper suggest that the effect of exchange rate volatility on FDI crucially depends on a country’s degree of openness. In fact, while exchange rate volatility has positive or null effect for relatively closed economies, it has a negative impact on economies with a high level of openness. This result is particularly relevant for transition economies (Emerging Europe and CIS) and is robust to the use of different econometric specifications and measures of exchange rate volatility

    Questo studio intende analizzare la normativa di contrasto all’infiltrazione mafiosa in chiave giuslavoristica. In particolare, si cercheranno di mettere in evidenza intrecci e col-lisioni tra alcuni istituti propri del diritto del lavoro e la normativa in esame, nonché le ricadute che la stessa determina sulla forza lavoro. A questo fine, saranno analizzate tre misure: la documentazione antimafia, la Rete del lavoro agricolo di qualità e il subappalto. Dallo studio emergerà un paradosso tra la progressiva liberalizzazione della regolazione dei mercati e la spinta verso risposte (meramente) repressive, che risultano scarsamente coordinate con la disciplina giuslavoristica. La proposta è quella di leggere la disciplina di contrasto all’infiltrazione mafiosa secondo una prospettiva più attenta al bilanciamento di tutti i diversi interessi in giocoThis study aims to analyze the regulatory framework for combating mafia infiltration from a labor law perspective. Specifically, it seeks to highlight intersections and conflicts between certain labor law institutions and the relevant regulations, as well as their impact on the workforce. To this end, three measures will be examined: anti-mafia documentation, the Quality Agricultural Work Network, and subcontracting. The analysis reveals a paradox between the progressive liberalization of market regulation and the reliance on (merely) repressive responses, which are poorly aligned with labor law provisions. The study proposes a reading of anti-mafia regulations that better balances the diverse interests at stake

    La proposta di direttiva UE sul salario minimo adeguato

    Il 28 ottobre 2020, la Commissione europea ha pubblicato la proposta di direttiva relativa a salari minimi adeguati nell’Unione europea: Com(2020)682. Il saggio si sofferma sul contesto in cui tale proposta viene adottata, sulle difficoltà che potrebbero sorgere nell’iter legislativo e sul suo contenuto. In particolare, gli Autori evidenziano come la proposta di direttiva in esame corregga le politiche di austerity perseguite dalla Commissione e sia diretta a sostenere la contrattazione collettiva settoriale o intersettoriale al fine di garantire salari adeguati a tutti i lavoratori. L’impatto della proposta di direttiva all’interno del nostro paese e sui recenti progetti di legge sul salario minimo viene altresì attentamente esaminato.THE PROPOSAL OF EU DIRECTIVE ON ADEQUATE MINIMUM WAGE. Absract: On 28 October 2020, the EU Commission has published the proposal of the directive on adequate minimum wages: Com(2020)682. The essay examines the context in which the proposal has been adopted, the difficulties that could arise during the legal procedure for its approval and its content. In particular, the Authors highlight that the proposal corrects the austerity policies pursued by the Commission, and aims at supporting collective bargaining at sectoral and inter-sectoral level in order to guarantee adequate wages to all workers. The impact of the proposal of directive in our country and on the recent law proposal on minimum wage is also carefully examined
