    In Bongiovanni v. Commissioner, the Second Circuit Court of Appeals applied a new interpretation of Section 357 to avoids taxing income recognized after the taxpayer transfers property to a corporation under a Section 351 exchange. However, this decision is ripe for review by the United States Supreme Court because it directly opposes Tax Court precedent and a similar Seventh Circuit case. This article recounts the background that led to Bongiovanni v. Commissioner, as well as examining cash versus accrual basis under Section 357(c) to decide whether the Bongiovanni decision actually comports with economic realities. In conclusion, the Comment concludes by recommending that Congress resolve the conflicting interpretations of Section 357

    Bone diseases associated with human immunodeficiency virus infection: pathogenesis, risk factors and clinical management

    Bone disorders such as osteopenia and osteoporosis have been recently reported in patients infected with the human immunodeficiency virus (HIV), but their etiology remains still unknown. The prevalence estimates vary widely among the different studies and can be affected by concomitant factors such as the overlapping of other possible conditions inducing bone loss as lypodystrophy, advanced HIV-disease, advanced age, low body weight or concomitant use of other drugs. All the reports at the moment available in the literature showed a higher than expected prevalence of reduced bone mineral density (BMD) in HIV-infected subjects both naïve and receiving potent antiretroviral therapy compared to healthy controls. This controversial can suggest a double role played by both antiretroviral drugs and HIV itself due to immune activation and/or cytokines disregulation. An improved understanding of the pathogenesis of bone disorders can result in better preventative and therapeutic measures. However, the clinical relevance and the risk of fractures remains undefined in HIV-population. The clinical management of osteopenia and osteoporosis in HIV-infected subjects is still being evaluated. Addressing potential underlying bone disease risk factors (e.g., smoking and alcohol intake, use of corticosteroids, advanced age, low body weight), evaluating calcium and vitamin D intake, and performing dual x-ray absorptiometry in HIV-infected individuals who have risk factors for bone disease can be important strategies to prevent osteopenia and osteoporosis in this population. The administration of bisphosphonates (e.g., alendronate), with calcium and vitamin D supplementation, may be a reasonable and effective option to treat osteoporosis in these subjects

    Il problema dei rapporti tra diritto e morale è, senza esagerazione alcuna, il problema fondamentale della filosofia del diritto. A dire il vero, questo problema ha attraversato la storia della riflessione critica sul diritto generalmente intesa, cioè anche della riflessione non condotta da filosofi (o filosofi del diritto) di professione: si pensi all’ovvio esempio dell’Antigone di Sofocle, che nella sua decisione di disobbedire a Creonte rappresenta vividamente – e tragicamente – il possibile conflitto tra obblighi giuridici e obblighi morali. Sui rapporti tra diritto e morale (o giustizia) si consuma la distinzione e contrapposizione tra positivismo e giusnaturalismo, cioè tra le due famiglie di filosofie del diritto che da alcuni secoli si contendono il campo della riflessione giusfilosofica. E la questione stessa della definizione del concetto di diritto viene spesso impostata come (o anche come) una questione di distinzione o di connessione tra diritto e morale. In questo contributo indicherò due possibili ordini di rapporti o di interazioni tra diritto e morale, che potrebbero essere sintetizzati nel seguente modo: le influenze della morale sul diritto, e le influenze del diritto sulla morale

    Glycerol-induced formation of the molten globule from acid-denatured cytochrome c: Implication for hierarchical folding

    At high concentration (98% or higher, v/v), glycerol induces collapse of acid-denatured cytochrome c into a compact state, the G(U) state, showing a molten globule character. The G(U) state possesses a nativelike a-helix structure but a tertiary conformation less packed with respect to the native state. The spectroscopic properties of the G(U) state closely resemble those of the molten globule stabilized by the organic solvent from the native protein (called the G(N) state), indicating that glycerol can stabilize the molten globule of cytochrome c either from the native or the acid-denatured protein. The G(U) and the G(N) states show spectroscopic (and, thus, structural) properties and stabilities comparable to those of molten globules stabilized by different effectors, despite the fact that the mechanisms involved in the molten globule formation may significantly differ. This implies in cytochrome c a hierarchy for the rupture (native-to-molten globule) or the formation (unfolded-to-molten globule) of intramolecular interactions leading to the stabilization of the molten globule state of the protein, independently from the effector responsible for the structural transition, in accord with the sequential model proposed by Englander and collaborators

    Context dependent effect of an herbivorous subterranean rodent on vegetation in relation to primary productivity

    Subterranean rodents could modify the environment becoming keystone species and/or ecosystem engineers. This role may be context dependent if the changes produced shift throughout the species range and are stronger under certain environmental conditions. Our objective was to analyze if the effect of Ctenomys mendocinus on vegetation cover is context dependent, specifically examining variations between areas with different levels of primary productivity. We compared the effect of C. mendocinus on plant cover among four contrasting environments and found that it depended on primary productivity in a predictable manner. In low productivity environments, the rodent significantly reduces vegetation cover, while it has no discernible effect in highly productive ones. These findings suggest that the effect of C. mendocinus on plant cover may be dependent on primary productivity level and highlights the importance of accounting for the underlying environmental factors that influence the intensity of C. mendocinus-plant interaction
