umano (esempio: sangue, sperma, tessuti, organi, etc). Nel testo che segue
ci si chiede se il concetto di non patrimonialità del corpo umano
possa esser applicato o meno ai campioni biologici umani.
Seppure le motivazioni alla base della non commercializzazione del
corpo umano siano note, esse meritano una spiegazione filosofica al fine
di cogliere la dimensione della questione, così come le sue eccezioni
ed eventualmente il suo rifiuto. Detto in altro modo, bisogna capire se é
giusto o meno dare un prezzo ai campioni biologici umani. Di quale
giustizia si parla allora? E quale valore giuridico attribuire agli elementi
contingenti (e dunque sociologici) di un principio filosofico quale il rispetto
della dignità umana

No religion is recognized by the State. Secularism
is liberal in so far as it recognizes any kind of religious expression
in the private sphere, nevertheless it controls it
or even prohibits it in the public domain. The struggle for
secularism was elaborated under the III Republic (1875-
1940) and, since then, it has become a symbol of the
French Republic. Nowadays, Muslim religion is in tension
with the legal limitations of religious sign’s bearing in
public areas. In addition, Muslim communitarianism is
perceived as a threat to the values of the Republic. The
question is how to modernize French secularism? The
Concordat in force in Alsace-Moselle could be a source
of inspiration
Catholic Reflections for an Updated Donum Vitae Instruction: A New Catholic Challenge in a Post–Christian Europe
No full textOn February 22, 1987, the Congregation for the Doctrine of the Faith published the Donum Vitae Instruction. Twenty years later, on February 22, 2007, Pope Benedict XVI asked for an update of this Instruction. According to the Donum Vitae Instruction of 1987, the principle of the holiness of life imposes respect for human persons from the very beginning of human life. In these past 20 years, new medical techniques have raised fresh ethical issues that are to be addressed by the Roman Catholic Church Magisterium. The Roman Catholic Church, in its update of the Instruction planned for 2007, will have to explain how civil law is to be regulated according to the fundamental norms of the moral law. The moral message of the new Donum Vitae (just as in the 1987 version) will be to affirm the substance of human justice: respect for human life, as expressed in the resolve not to infringe on, or to protect such life. Even in a post-Christian Europe, this theological message can be understood if it is true that Europe is marked by the principle of the absolute protection of human life
