Defendants-appellants Zim Container Service, Zim Israel Navigation Co., Ltd. and Shoham Maritime Services, Ltd. (collectively Zim ), appeal from a judgment entered on February 24, 1993 in the United States District Court for the Southern District of New York (Keenan, J.), awarding plaintiff-appellee Bally, Inc. damages in the amount of $48,819.73, plus pre-judgment interest at a rate of eight percent, for loss to a shipment of shoes and other leather goods shipped aboard the defendant-vessel M.V. ZIM AMERICA. The goods were shipped from Leghorn, Italy to New York in two sealed containers. When later opened at Bally\u27s warehouse in New Rochelle, New York, 65 cartons of goods were missing from one of the containers. After a bench trial, the district court issued findings of fact and conclusions of law in which it held that Bally had established delivery of the full shipment of goods to Zim and a shortage in the cargo at outturn, thereby proving a prima facie case for recovery under the Carriage of Goods by Sea Act, ( COGSA ), 46 U.S.C. App. §§ 1300-1315. Concluding that Bally has not demonstrated that the cartons were missing from the sealed container at outturn, we reverse and remand with instructions to dismiss the complaint

Disk Mass Limits and Lifetimes of Externally Irradiated Young Stellar Objects Embedded in the Orion Nebula
We present 1.3 mm wavelength interferometric observations of externally irradiated young stellar objects (proplyds) embedded within the Orion Nebula, including the three largest circumstellar disks seen in silhouette against the background nebular light. One field is centered on the 2" diameter edge-on disk 114-426. The second field is centered on the large teardrop-shaped object 182-413 (HST 10), which contains a very opaque 0.4" diameter edge-on disk. This field also contains four other proplyds, including the large pure silhouette 183-405 (HST 16). We derive upper bounds on the dust masses of these disks from the absence of continuum emission and upper bounds on the gas masses from the lack of CO emission. These limits imply circumstellar disk masses less than 0.015 M_⊙ for the observed sources and upper bounds on the column density of ^13CO of N(^13CO) < 1.4 x 10^15 cm^-2 averaged over the synthesized beam. Comparison with lower bounds on the dust content derived from the visibility of the circumstellar material in silhouette against the background nebular light and the extinction toward the embedded central star implies that ^13CO may be less abundant in these circumstellar environments than in normal molecular clouds. The nondetection statistics are combined with estimates of radiation-induced mass-loss rates to derive an upper bound on the UV irradiation time for these young stellar objects. The young stellar objects in the Orion Nebula that are still surrounded by circumstellar material have been exposed to external UV radiation for less than 10^5 yr and possibly for as little as 10^4 yr
Preliminary results from the small tree-high productivity initiative
Productivity in temperate tree crops such as apple has been lifted several-fold by research focusing on optimising a combination of canopy components including light relations, vigour control, tree architecture and crop load. This paper outlines the research behind the Small Tree-High Productivity Initiative (STHPI), which is focused on improving productivity of mango, avocado and macadamia. Preliminary results from work we are undertaking for each of the above canopy components in mango will be outlined. A rootstock screening trial to identify vigour-managing, high-productivity rootstocks is being undertaken, and we present a comparison of the best-performing low-medium vigour rootstock varieties compared with control 'Kensington Pride' (KP) rootstock at 6 months old. Comparisons between 'Keitt', 'NMBP 1243' and 'Calypso' scion cultivars with regard to tree diameter, height and canopy growth at different orchard densities and training systems will also be presented. Preliminary results from an orchard light-relations study indicate that mango yields continued to increase with light interception up to 50%, and reached a maximum of 20-30 t ha at 68% light interception in KP trees approximately 25 years old. In a crop load trial, inflorescence thinning in a 'Calypso' orchard did not significantly reduce yields when up to 90% of inflorescences were removed, but did when 95% of inflorescences were removed, as trees were unable to compensate by adjusting fruit set, size and yield. Inflorescence thinning beyond 80% increased the number of fruit set per panicle, and thinning up to and including 90% of inflorescences increased fruit weight from 340 g to >400 g per fruit. This project is still in its initial stages; however, early indications suggest there may be opportunities to improve early orchard yields through optimising light interception in an orchard's life, potentially through the use of higher densities, and that rootstocks and tree training methods, once identified, may help in the management of vigour. It is also hoped to obtain a better understanding of how crop load influences the balance between vegetative growth, flowering, fruiting, alternate bearing and fruit quality
