There has been a controversial issue regarding rape prosecution in Islamic legal system as the rape victim would be either charged with zin? (illegal sexual intercourse) because of her confession or qadhf (false accusation) as a result of her failure to bring four male eyewitnesses. This paper aims at investigating the fundamental rights of rape victims provided in Islamic law. This will include legal rights to be defended fairly, exemption of punishment, adequate compensation, and other essential rights. Islamic parameter of these contracts, there is not to be determination
of return or possible arrangement for these that may lead to
guaranteeing the return of any partners in mush?rakah and
mu??rabah. Conventional bond usually offers a fixed income
determination for their bond structures and issuance. This raises
issue as to whether the ?uk?k equity based structure may have the
same implication. This is where the tan?zul may play its role to give
effect in ?uk?k structuring using mush?rakah, mu??rabah and
wak?lah bi al istithmar contracts to offer a similar feature of fixed
income instrument. This paper attempts to ascertain the status of
tan?zul in equity based ?uk?k from the Shariah perspective. The
paper will analyze the use of the concept of tan?zul in ?uk?k
structures and its implications on the validity of the equity based

Insurance Protection Benefits Scheme (TIPS) merupakan produk baru
bagi skim perlindungan pelanggan kewangan yang ditawarkan oleh
Perbadanan Insurans Deposit Malaysia (PIDM). Secara umumnya,
peserta pengendali takaful atau institusi kewangan Islam untuk
mendapat perlindungan akan membayar premium kepada PIDM apabila
berlaku kegagalan membuat bayaran tuntutan kepada peserta. Konsep
kafalah bi al-ajr masih dipertikaikan oleh sebahagian ulama semasa
lebih-lebih lagi penggunaannya sebagai konsep kepada perlindungan
deposit. Metodologi kajian ini adalah bersifat kajian kepustakaan
dengan menganalisis kesesuaian praktis semasa yang diamalkan oleh
PIDM yang menggunakan al-kafalah bi al-ajr sebagai konsep utama
untuk skim TIPS berdasarkan beberapa pandangan fuqaha silam dan
kontemporari mengenai konsep berkenaan. Berdasarkan analisis yang
dijalankan, kajian ini mendapati terdapat keperluan untuk menyemak
semula konsep al-kafalah bi al-ajr yang diaplikasikan dalam skim
TIPS di samping mencadangkan beberapa konsep lain
