    About the Employment Practices of the Missouri Department of Mental Health (MODMH) – #Michael Ayele (a.k.a) W – #Title VII of the 1964 and 1991 Civil Rights Act

    In October 2021, there were 5276 (five thousand two hundred and seventy-six) employees working for the MODMH. Of those, 3752 (three thousand seven hundred and fifty-two) employees were women and 1502 (one thousand five hundred and two) employees were men. While 64% (sixty four percent) of the MODMH employees identified as Caucasians, 31% (thirty one percent) identified as Black. Michael A. Ayele (a.k.a) W was previously employed for the MODMH. He has in 2013 filed a charge of employment discrimination with the Equal Employment Opportunity Commission (EEOC) against the MODMH. The charge of employment discrimination filed by Michael A. Ayele (a.k.a) W with the EEOC was previously assigned Case No.: 28E – 2014 – 00485C. The charge of employment discrimination filed by Michael A. Ayele (a.k.a) W with the EEOC has been subject of intense scrutiny for various reasons. Michael A. Ayele (a.k.a) W has recently been informed by his former employers that 9 (nine) charges of employment discrimination have been filed against the MODMH between January 01st 2010 and December 17th 2021. Of those, the MODMH opted to engage in the alternative dispute resolution (ADR) program offered by the EEOC on 4 (four) separate occasions. They also declined to engage in the ADR program offered by the EEOC on 5 (five) separate occasions. As of this writing, it remains unclear for the Association for the Advancement of Civil Liberties (AACL) why the MODMH opted to engage in certain ADR sessions offered by the EEOC, while refusing to do so for others. The AACL unequivocally denounces discrimination on the bases of gender, racial background, sexual orientation, national origin and religious affiliation. The AACL also unequivocally denounces discrimination against people with disabilities (PWD). The AACL has decided to publish this information to members of the general public because of the language used by the EEOC to describe their processing of Charge No.: 28E – 2014 – 00485C and also because of the EEOC frequent reference to this charge of discrimination. The AACL has effectively put the EEOC on notice that given their processing of Charge No.: 28E – 2014 – 00485C, they have forfeited their rights to represent Missouri State employees who [1] have opposed discriminatory practices in the service of healthcare pursuant to the Health Insurance Portability and Accountability Act (HIPAA); [2] have been subjected to racially motivated internal investigations (and were afterwards cleared of that investigation); [3] have been fired from their jobs as retaliation; [4] have been arrested for demanding the payment of their salary for the job they have performed.     The Association for the Advancement of Civil Liberties (AACL) has obtained limited responsive documents concerning the suicide of Catherine Daisy Coleman, which took place on August 04th 2020. Among documents that were disclosed to the AACL are contracts concluded between the Missouri Department of Mental Health (MODMH) and Missouri Girls Town: a facility, where Catherine Daisy Coleman is reported to have stayed in for a period of 90 (ninety) days before her permanent departure to the State of Colorado from the State of Missouri. According to the MODMH, Missouri Girls Town is a “time-limited placement resource for children requiring active coordinated and professional intervention in a highly structured environment by virtue of a demonstrated inability to function in any less restrictive setting. Children requiring residential treatment services exhibit a severe mental illness and/or persistent mental disorder as diagnosed according to the DSM-IV. These children may be unable to function consistently in an open, public school setting, may present a chronic runaway risk, and may present a history of showing rage, including physical aggression toward self and others.” Michael Ayele (a.k.a) W was a previous employee of the MODMH. He is also an alumnus of Westminster College (Fulton, MO). As an alumnus of Westminster College, who has previously worked for the Fulton State Hospital (a component of the MODMH), Michael Ayele (a.k.a) W doesn’t know if the MODMH accept as a matter of fact the reality that sexual assault could lead a woman who has gone through the ordeal to commit suicide. Michael Ayele (a.k.a) W also doesn't know if the personal health information (PHI) of an individual similarly situated to Catherine Daisy Coleman would reflect that risk. Michael Ayele (a.k.a) W is very much a proponent of reviewing the personal health information (PHI) of Catherine Daisy Coleman. Michael Ayele (a.k.a) W is very much concerned about the circumstances which led Catherine Daisy Coleman to leave the State of Missouri for the State of Colorado. Michael Ayele (a.k.a) W is also concerned about the things Catherine Daisy Coleman is reported to have gone through in the State of Colorado before her suicide on August 04th 2020. As of this writing, it remains unclear for Michael Ayele (a.k.a) W what the obligations of the MODMH pursuant to the Americans with Disabilities Act (ADA) and the Health Insurance Portability & Accountability Act (HIPAA) actually are. The MODMH were extremely vague to Sunshine requests submitted on the subject of [1] whether they have in the past disclosed the PHI of an individual in circumstances, where discrimination was at play (for the purpose of remedying the discrimination); [2] whether they were in the past required to disclose the PHI of an individual either to the Equal Employment Opportunity Commission (EEOC) and/or the courts (for the purpose of remedying the discrimination). As a matter of principle, the AACL unequivocally denounces violence committed against women irrespective of their racial backgrounds, their sexual orientations, their national origins, their religious affiliations and/or their disability status. The AACL has recently expressed grave concerns about women being put in circumstances encouraging the commission of suicide after having reported an incident of sexual harassment/sexual assault/rape to the authorities. The AACL unequivocally denounces malicious efforts to place women in circumstances encouraging the commission of suicide as a form of retaliation for having reported an incident of sexual harassment/sexual assault/rape.     Michael A. Ayele (a.k.a) W was a former employee of the Fulton State Hospital (FSH): a state agency, which is a component of the Missouri Department of Mental Health (MODMH). Between October 26th 2013 and November 20th 2013, Michael A. Ayele (a.k.a) W was subject of an internal state investigation after a complaint of “employee misconduct” was filed against him. In a letter hand-delivered to him on (or around) November 21st 2013, the-then Chief Operating Officer (COO) of the FSH informed Michael A. Ayele (a.k.a) W that he was “cleared” of any and all wrongdoing related to the October 26th 2013 complaint filed against him. As a former employee of the MODMH (FSH), Michael A. Ayele (a.k.a) W has initiated contact with his former employers as well as the Equal Employment Opportunity Commission (EEOC) to obtain pertinent information about the complaint filed against him on October 26th 2013. Michael A. Ayele (a.k.a) W has also initiated contact with his former employers as well as the EEOC to obtain information about the investigation he was supposedly “cleared” of on (or around) November 21st 2013. Unfortunately, however, Michael A. Ayele (a.k.a) W has thus far been unsuccessful to obtain these records either from his former employers and/or the EEOC. In the judgement of the Association for the Advancement of Civil Liberties (AACL), the decision of the MODMH to withhold these records were not consistent with their obligations pursuant to Title VII of the 1964 and 1991 Civil Rights Act. The decision of the MODMH to withhold these records were not consistent with (the letter and spirit of) Missouri state laws including but not limited to Missouri Sunshine Law (Section 630.140, RSMO) as well as Missouri Senate Bill 26 (Section 590.030 & Section 590.502, RSMO). Missouri Revised Statutes (RSMO) Section 590.502 specifically states for instance that law enforcement officers (who have passed a criminal background check with the Department of Justice Federal Bureau of Investigation) who “reasonably believe he or she is under investigation which could lead to disciplinary action, demotion, dismissal, transfer of placement that could lead to economic loss” [1] shall be informed in writing of the existence and nature of the alleged violation and who will be conducting the investigation; [2] shall be provided a “written statement outlining the complaint;” [3] shall be informed that “he or she is being ordered to answer questions under threat of disciplinary action and that the (…) answers to the questions will not be used (…) in a criminal proceeding;” [4] shall be “questioned by up to two investigators and shall be informed of the name and rank of each questioning officer.” For the reasons mentioned above, the AACL regrets the decision of the MODMH to withhold records of Michael A. Ayele (a.k.a) W employment with the FSH between October 26th 2013 and November 21st 2013. Fulton State Hospital (FSH) is located approximately 2 (two) miles away from Westminster College (Fulton, MO). Michael A. Ayele (a.k.a) W has been an alumnus of Westminster College (Fulton, MO) since Saturday, December 31st 2016. Michael A. Ayele (a.k.a) W is exploring all legal avenues to obtain these records and other (just and appropriate) legal relief. Michael A. Ayele (a.k.a) W has absolutely no regrets whatsoever about not filing a complaint with the judicial branch of the U.S government (the courts) pursuant to Title VII of the 1964 and 1991 Civil Rights Act with a “Right to Sue” letter. Ayele (a.k.a) W has never sought nor solicited the approbation and validation of anyone to publish his correspondence with the United States (U.S) government on the January 30th 2022 suicide of Cheslie Corrinne Kryst ; unknown others with supposed ties to the University of Missouri, Saint Louis (UMSL) have redistributed his written content on this issue in a manner that was inconsistent with DataCite Commons guidelines. Indeed, Michael A. Ayele (a.k.a) W was very much annoyed upon learning that these unknown others (who were very much eager to link themselves to him) had watered down his written publications about Cheslie Corrinne Kryst. Michael A. Ayele (a.k.a) W would like to take this opportunity to reiterate that he has never agreed to a binding written agreement with the UMSL or others affiliated with them (or anyone else) to have his written publications about Cheslie Corrinne Kryst redistributed. According to information posted on the website of DataCite Commons, journal articles published or added on the European Organization for Nuclear Research (CERN) – Zenodo, Figshare, Open Science Framework (OSF) and ORCID “maximize their usefulness (…) for the entire research and scholarly communications community” when the data is not modified “so as to make it false, incomplete, defamatory, or misleading.” Michael A. Ayele (a.k.a) W had started to publish some of his correspondence with the U.S government about the January 30th 2022 suicide of Cheslie Corrinne Kryst because of a commitment he had made that he would disseminate any and all responsive U.S government records (within their possession) to members of the general public / representatives of the media at no financial expense to them. To the best of his ability, Michael A.     The Association for the Advancement of Civil Liberties (AACL) regrets to inform members of the general public and representatives of the media (who may follow its work) that unknown others were very much eager to repurpose and debase the written content of Michael Ayele (a.k.a) W on various Internet Search Engines (ISE) such as AOL, Bing/MSN and Yahoo following his decision to publish on the Internet Archive records related to [1] statements made by the National Council on Disability (NCD) (in their January 30th 2018 report) recognizing that (i) “affirmative and effective consent” is being taught to college/university students of the United States of America (U.S.A) during the course of their Freshmen year, (ii) college/university students are informed about “healthy sexual relationships” during the course of their 1st (first) year of post-secondary academic education; [2] the strong likelihood that Brock Allen Turner was informed what constitutes “affirmative and effective consent” when he was a freshman undergraduate student of student of Stanford University (located in the State of California) during Calendar Years 2014 – 2015 (particularly given the statements made by the NCD in their January 30th 2018 report); [3] Brock Allen Turner (i) January 10th 2015 sexual harassment of a female student who was also attending Stanford University even though he had likely been informed what constitutes “affirmative and effective consent” in the month of September 2014; (ii) January 18th 2015 arrest for the sexual assault he perpetrated on Chanel Miller behind a dumpster on the campus of Stanford University while she was unconscious even though he has likely been informed what constitutes “affirmative and effective consent” sometime in the months of August/September 2014; (iii) being on (or around) March 30th 2016 found guilty of sexually assaulting and sexually penetrating Chanel Miller while she was unconscious; (iv) being on (or around) June 02nd 2016 sentenced to 6 (six) months of county jail for the sexual assault he perpetrated on Chanel Miller; (v) being released from the Santa Clara County on (or around) September 02nd 2016 after serving 90 (ninety) days of the 6 months sentence imposed upon him on (or around) June 02nd 2016 for the sexual assault of Chanel Miller on the campus of Stanford University.At the time Michael A. Ayele (a.k.a) W started to publish some of his written content on the many double standards he has had to bear witness to, Michael A. Ayele (a.k.a) W had not signed any binding agreement that subjected his written content on the Internet Archive to evaluation, examination and unsolicited comments intended to “summarize” what the work is about. In other words, Michael A. Ayele (a.k.a) W has never agreed to take on the role of the “Student” for his published works on the Internet Archive while the so-called “web” took on the role of “Professor.” Likewise, Michael A. Ayele (a.k.a) W has never agreed to take on the role of “Plaintiff” and/or “Defendant” for his published works on the Internet Archive while the so-called “web” took on the role of “Judge, Jury and Executioner.” More importantly, Michael A. Ayele (a.k.a) W had begun to publish some of his correspondence with agents of the U.S government on the biggest news story of Calendar Year 2016 (i.e: Brock Allen Turner 90 day incarceration at the Santa Clara County Jail located in the State of California) as well as some of his recollections of the last few weeks he spent in the United States of America (U.S.A) before permanently leaving the country in the month of July 2016 because of a commitment he had made that he would disseminate any and all responsive U.S government records (within their possession) to members of the general public / representatives of the media at no financial expense to them. Ayele (a.k.a) W is a Bachelor of Arts (B.A) Degree graduate of Westminster College (located in Fulton, Missouri) who was in January 2010 informed what constitutes “affirmative and effective consent” in healthy sexual relations after being told about the April 05th 1986 rape and murder of Jeanne Ann Clery. Via email dated March 07th 2022, the Department of Justice (DOJ) Federal Bureau of Investigation (FBI) have informed Michael A. Ayele (a.k.a) W that (his alma mater) Westminster College (Fulton, Missouri) had extended an invitation to their then Director William Webster to “deliver the 1987 Commencement Address on Sunday, May 17, 1987 at 2:30 P.M.” The invitation extended by Westminster College on August 29th 1986 came approximately five (5) months after the April 05th 1986 rape and murder of Jeanne Ann Clery on the campus of Lehigh University (located in the State of Pennsylvania). In another email dated November 12th 2020, the FBI had informed Michael A. As you may be aware, Michael A. Ayele (a.k.a) W had created the Health Insurance Portability and Accountability (HIPAA) tag for the first time on his WordPress website in reference to the inconsistent legislative actions that were taken following the August 04th 2020 suicide of Catherine Daisy Coleman and the September 12th 2012 suicide of Audrie Taylor Pott. Ayele (a.k.a) W that the provisions of HIPAA enable current/former healthcare workers to express written objections to a specific course of medical treatment a patient is subjected to if the current/former healthcare worker believes the treatment to be discriminatory and/or racist and/or sexist in nature. Ayele (a.k.a) W was very much concerned upon reading about the August 04th 2020 suicide of Catherine Daisy Coleman because he was in Calendar Year 2013 a public employee of the MODMH (FSH). As a former employee of the MODMH (FSH), it remains unclear to Michael A. Ayele (a.k.a) W whether or not his former employers acknowledge as a matter of reality the fact that sexual assault is a factor increasing the risk of suicide. It also remains unclear to Michael A. Ayele (a.k.a) W if the Personal Health Information (PHI) of Catherine Daisy Coleman reflected this risk. According to a January 30th 2018 report published by the National Council on Disability (NCD), [1] “affirmative and effective consent” is being taught to college/university students of the United States of America (U.S.A) during the course of their Freshmen year; [2] college/university students are informed about “healthy sexual relationships” during the course of their 1st year of post-secondary academic education; [3] twenty percent (20%) of women were sexually assaulted in a college/university setting by the time they had reached their Senior Year in Calendar Year 2005; [4] thirty two (32%) of women with a disability were sexually assaulted during Calendar Year 2014 and 2015 in a college/university setting; [5] sexual assault is a “deeply personal violation,” which leaves “physical and emotional impacts that change the lives of victims;” [6] sexual assault causes “long term physical, psychological and emotional effects, including depression, post-traumatic stress, thoughts of suicides and sleep disorders.” Via email, the former employers of Michael A. Ayele (a.k.a) W (i.e.: the MODMH) have refused to deny that Catherine Daisy Coleman was a patient of Missouri Girls Town following the January 08th 2012 sexual assault she was a victim of (only confirming that Missouri Girls Town is indeed a contractual partner of the MODMH). The terms and conditions of the contractual agreements concluded between the MODMH and Missouri Girls Town recognize that Missouri Girls Town is a “time-limited placement resource for children requiring active coordinated and professional intervention in a highly structured environment by virtue of a demonstrated inability to function in any less restrictive setting. Children requiring residential treatment services exhibit a severe mental illness and/or persistent mental disorder as diagnosed according to the DSM-IV. These children may be unable to function consistently in an open, public school setting, may present a chronic runaway risk, and may present a history of showing rage, including physical aggression toward self and others.” Michael A. Ayele (a.k.a) W was concerned upon learning about the August 04th 2020 suicide of Catherine Daisy Coleman because he was in Calendar Year 2013 an employee of the MODMH (FSH). It is the judgment of Michael A. Ayele (a.k.a) W that the criminal charges filed by the State of Missouri on (or around) January 09th 2014 (which had been assigned Case No.: Kind CR00011) failed to seriously take into consideration the damage that had been inflicted on the physical and mental well-being of Catherine Daisy Coleman on (or around) January 08th 2012. Michael Ayele (a.k.a) W has used his advocacy skills to have his former employers as well as their contractual partners acknowledge the reality that sexual violence is a factor increasing the risk of suicide for the purpose of preventing in the future similar suicides such as the one committed by Catherine Daisy Coleman on (or around) August 04th 2020. Unfortunately, however, it remains unclear for Michael Ayele (a.k.a) W what the obligations of the MODMH pursuant to the Americans with Disabilities Act (ADA) and the Health Insurance Portability &amp; Accountability Act (HIPAA) actually are. The MODMH were extremely vague to Sunshine requests submitted on the subject of [1] whether they have in the past disclosed the PHI of an individual in circumstances, where discrimination was at play (for the purpose of remedying the discrimination); [2] whether they were in the past required to disclose the PHI of an individual either to the Equal Employment Opportunity Commission (EEOC) and/or the courts (for the purpose of remedying the discrimination).     Following a Sunshine request for records, the Missouri Department of Mental Health (MODMH) have disclosed the affiliation agreement concluded between the Fulton State Hospital (FSH) and Westminster College (Fulton, Missouri). Michael Ayele (a.k.a) W is the founding member of the Association for the Advancement of Civil Liberties (AACL). He is an alumnus of Westminster College (Fulton, Missouri). He is also a former employee of the MODMH (FSH). For your information (FYI), the FSH is located approximately two miles away from Westminster College (Fulton, Missouri). As you may be aware, the Joint Commission had on April 23rd 2014 informed Michael A. Ayele (a.k.a) W that 21 (twenty-one) written complaints were filed with them against the Fulton State Hospital (FSH) between April 24th 2011 and April 23rd 2014. These 21 complaints were filed against the FSH between April 24th 2011 and April 23rd 2014 for various reasons, which include but are not limited to the environment of care, the provision of care and the medication management there. In other words, once every two (2) months or so (between April 2011 and April 2014), a complaint or two were being filed with the Joint Commission against the FSH. For your information (FYI), the FSH is an agency component of the Missouri Department of Mental Health (MODMH) and via e-mail dated May 06th 2021, the MODMH have refused to deny that 21 complaints had been filed against the FSH between April 24th 2011 and April 23rd 2014.
