Compensation at the Intersection of Tort Law and International Human Rights Law
For human rights not to become empty letters, the respect and fulfilment of the right to remedy is instrumental to the victims’ recovery from past violations. Human rights abuses have found redress also before domestic courts. Yet litigation can move from the domestic to regional forum where the former does not provide the victim with adequate remedies. The aim of this chapter is to explain how the two systems may interact providing specific means to address and redress wrongful conducts constituting torts and human rights abuses. By exploring the theory of tort law and human rights, including their relationship and interactions, I first outline the interpretative principles on the right to remedy under international law and international human rights law. At the heart of the discussion is compensation as a form of reparation in the Council of Europe’s, Inter-American and African human rights systems respectively. I maintain that, while regional human rights courts can be used as compensatory instruments, perceived as tort law devices, the domestic enforcement of regional courts’ decisions remains nevertheless essential to the award of compensation and the effective realisation of individuals’ right to reparation

Tort damages for non-economic losses: methodological approaches for comparative analysis served by new technologies
This chapter explores the potentialities of new technologies in investigating non-pecuniary losses compensation and in the pursuit of horizontal and vertical equality, opening new paths in comparative analysis. Authors suggest a new approach to provide case-law analysis on personal injury compensation using Machine Learning techniques. This method applying analytics to massive amounts of case-law allows the identification of variables, bias, and trends for each head of damage also in terms of meta-legal formants. The proposed approach enables the identification of factors impacting on both liability and quantum of damages addressing new challenges for fundamental rights protection analysis
Causation Theories and Causation Rules
The present entry aims to offer a comparative analysis of the ways in which Western tort law systems address the many questions falling under the umbrella of causation. To this purpose, the paper first investigates the role that causation plays in the broader, trans-legal scientific debate over the chains of events that make up any social phenomenon. It then overviews the theories and rules embodying the Western response to causation problems in tort law, and examines who, in the West, actually make these theories and rules, against what cultural backgrounds, and through which technicalities
