Conflict of law and the methodology of Tarjīẖ : a study in Islamic legal theory

    No full text
Islamic law never achieved unity but expressed itself in, at least, four surviving schools. More interestingly, contemporary Muslim communities are still divided among themselves on a number of issues related to their laws. This work describes how problem of legal conflicts have been tackled by Muslim jurists. It is an attempt to examine closely the phenomenon of conflict in Islamic law from the standpoint of usūl-al-fiqh or Islamic legal theory. In fact, much is heard nowadays of the contradiction in the body of Islamic law. Whilst in contrast, little is presented in terms of the methodology of removing this conflict. The present work therefore, attempts to redress this balance. The emphasis of the work will be concerned primarily with tarjīh methodology ; how to give preference to one piece of evidence or argument over the other when they conflict. Nevertheless, considerable concern is given to investigating the background to the conflict of law in the Shari'ah. This study of a neglected area in Islamic legal scholarship will be an important source of reference to students, both practising and theoretical jurists or to anyone who merely wishes to increase his knowledge of legal themes, particularly legal conflict. The very aim of the work is to argue that conflict is a natural and unavoidable consequence of legal study because legal conflict is only conflicting principles and arguments adduced by both the classical and modern jurists to reach what is actually intended by God in the target case. Therefore, conflicts are inevitable in most of the cases in fiqh owing to the variety of principles set out to deal with one piece of legal evidence, let alone with all the pieces of legal evidence in question. Tarjīh is therefore, an important and workable instrument in the re-examination of these conflicts and in arriving at the most accurate principle for establishing the law for as long as this is possible. It is hoped that the discovery of new facts and the increase of knowledge which results from the broadening and deepening of the research will positively contribute to the process of unification of Islamic law

Qur'anic narrative and Isra'iliyyat in Western scholarship and in classical exegesis

    No full text
The main subject of this thesis is twofold. On the one hand it analyses how the Qur'an presents stories, on the other hand it examines the classical Muslim commentators' response to the Qur'anic narration. In part one we remark that the theory that the Qur'an borrowed extensively from the Bible has clouded the vision of many Western scholars. They explained the Qur'anic narratives in accordance with their preconceptions; only a few emancipated themselves from this prejudice, but some of these scholars were sensitive to the literary qualities of the Qur'anic narrative. Adopting their general approach to the Qur'anic narrative we analyse the Qur'anic narrative of the 'golden calf' episode. Here we invite the reader to step into the textual world of the Qur'an in order to appreciate its otherness. At the same time we try to show the internal coherence among the verses (and also among the surahs) to remove the assumption of the incoherence of the Qur'an which has veiled much of its literary excellence from view. In addition, this study gives us an opportunity to appreciate one of the most neglected aspects of the Qur'anic narratives, namely the relationship between the oral recitation and the written characters of the Qur'an. The written text lacks the contextual richness provided by the oral dimension for it cannot convey intonation, emphasis, and so on, but the transcription of the spoken word displays the relationship of sound and meaning within the surahs or verses together with special emphasis upon phonological effects. The first chapter of part two is designed to provide a general overview of the notion of isrä'iliyyät, taking into account the opinions held by both Muslim and non- Muslim authorities. We raise two important questions regarding this technical term When did the technical term isra'iliyyät come into general use? Who first used it critically? To answer these questions we analyse the commentaries of eight exegetes together with some qisas works on the 'golden calf and 'heavenly table' episodes. It is clear that, in contrast to the view held by many Muslim and non-Muslim scholars, the technical usage of this term is a late development. Another important conclusion derived from our analysis of classical exegesis is that the commentators who use this term themselves depend on isra'iliyyät in several respects. In other words, their theory,is not in agreement with their practice. Furthermore, there are commentators who do not use the term isra'iliyyät and consistently seek to distance themselves from these reports. They also try to minimise the amount of these reports in their tafsir. According to this research, Ibn Atiyya was the first to pay more attention to the implausibility of this type of report, two centuries before Ibn Kathir's critical exegesis

Peer reviewe

Data ------- Hausa Visual Genome 1.0, a multimodal dataset consisting of text and images suitable for English-to-Hausa multimodal machine translation tasks and multimodal research. We follow the same selection of short English segments (captions) and the associated images from Visual Genome as the dataset Hindi Visual Genome 1.1 has. We automatically translated the English captions to Hausa and manually post-edited, taking the associated images into account. The training set contains 29K segments. Further 1K and 1.6K segments are provided in development and test sets, respectively, which follow the same (random) sampling from the original Hindi Visual Genome. Additionally, a challenge test set of 1400 segments is available for the multi-modal task. This challenge test set was created in Hindi Visual Genome by searching for (particularly) ambiguous English words based on the embedding similarity and manually selecting those where the image helps to resolve the ambiguity. Dataset Formats ----------------------- The multimodal dataset contains both text and images. The text parts of the dataset (train and test sets) are in simple tab-delimited plain text files. All the text files have seven columns as follows: Column1 - image_id Column2 - X Column3 - Y Column4 - Width Column5 - Height Column6 - English Text Column7 - Hausa Text The image part contains the full images with the corresponding image_id as the file name. No full text
Nigeria faces the dual challenge of harmful industrial emissions contributing to climate change and unreliable power supply, demanding urgent attention. This study focuses on optimizing a grid-connected photovoltaic (PV) system at the Department of Electrical Engineering, Ahmadu Bello University Zaria, Kaduna, Nigeria, with the goal of achieving economic and environmental sustainability. The study utilizes HOMER, a widely used optimization tool for renewable energy systems, to design and evaluate three distinct energy scenarios. The first scenario relies solely on grid power, resulting in high annual costs of 2,838,significantenvironmentaldegradation,andzerorenewableenergycontribution.ThesecondscenariointegratessolarPVwithgridpower,reducinggriddependencybutonlypartiallyaddressingcostandenvironmentalconcerns,withanannualenergycostof2,838, significant environmental degradation, and zero renewable energy contribution. The second scenario integrates solar PV with grid power, reducing grid dependency but only partially addressing cost and environmental concerns, with an annual energy cost of 2,714 and 1,867 kWh generated from solar PV. The third scenario demonstrates the most favourable outcomes, combining high solar PV generation with economic benefits. The system produces 29,684 kWh annually, selling 521worthofsurplusenergybacktothegrid,resultinginanetyearlyenergycostof521 worth of surplus energy back to the grid, resulting in a net yearly energy cost of 1,043. The initial installation cost is expected to be recovered within two years, offering potential savings of $20,000 over the system's 20-year lifespan. These findings show the viability of solar PV systems as a solution to Nigeria's energy challenges, underscoring the importance of balancing economic and environmental factors in energy system design. The study provides valuable insights for institutions and similar contexts looking to transition to more sustainable energy systems

An Automated Solar Panels Monitoring and Cleaning System: A Case Study of Kaduna Polytechnic, Nigeria.

    No full text
The use of Photo Voltaic (PV) panels for the generation of electricity has received a lot of attention from both industries and academia as a renewable energy source due to inadequate electricity from the grid, its low cost as well as environmental benefits. However, the ef?ciency of solar panels can be signi?cantly affected by major issues such as the accumulation of dust or dirt particles on their surfaces. Therefore, this study presents the design and construction of an automatic based PV monitoring and cleaning system. The system comprises electromechanical parts such as microcontroller, servo motor, submersible pump, voltage sensor, Light Dependent Resistor (LDR) sensor and metal frame. In addition, a modified Blynk application was integrated with the system to remotely monitor and control the performance of the panels. Several tests were carried out by using 150Watts panel installed in the Department of Electrical Engineering, Kaduna Polytechnic. The experimental results obtained shows that the output power of the panel decreases as the dust or dirt particles increases. However, the performance of the panel improved when the cleaning process was carried using the proposed methodology in terms of output voltage, current, and power levels with a value of 13.76%, 17.46%, and 33.61% respectively
