Tinjauan Yuridis Prinsip Kehati - Hatian Dalam Fintech Peer To Peer Lending Terhadap Pengguna Berdasarkan Hukum Positif Di Indonesia
Rapid developments in information technology, including in the field of
finance, have led to the emergence of Fintech with its Peer to Peer Lending services.
has brought significant impacts on society by providing tangible benefits,
but it does not rule out the possibility of risks arising in the
implementation of Fintech Peer to Peer Lending services. Therefore,
the principle of prudence is required in Fintech P2P Lending services.
This study aims to review the principle of prudence in Fintech P2P Lending services
by formulating regulations on the principle of prudence
in Fintech P2P Lending and the legal implications of not applying the principle
of prudence. The research method used is normative juridical with a
statute approach and conceptual approach. The regulation of the principle of prudence in Fintech P2P Lending services is regulated in Financial Services Authority Regulation (POJK) No.
10/POJK.05/2022 concerning LPBBTI as the legal basis for the implementation of
Peer to Peer Lending services. In addition, Bank Indonesia Regulation (PBI) No.
19/12/PBI/2017 concerning the Implementation of Financial Technology also regulates
the obligation to apply the principle of prudence. The implementation of
Fintech P2P Lending services must go through a testing mechanism to obtain
a business license through a regulatory sandbox based on POJK
No. 3 of 2024 concerning the Implementation of Financial Sector Technology Innovation
(ITSK). The legal implications for operators who do not apply the principle of prudence are administrative sanctions in the form of 3 (three) written warnings, business restrictions, and finally revocation of the business license.

Analisis Prinsip Kehati-hatian dalam Fintech Peer to Peer Lending terhadap Pengguna berdasarkan Hukum Positif di Indonesia
The rapid advancement of information technology, particularly within the financial sector through Financial Technology (Fintech) and Peer-to-Peer (P2P) Lending services, has significantly influenced society by delivering concrete benefits. Nonetheless, this progress also introduces inherent risks in its application. Consequently, the principle of prudence is crucial in the provision of P2P Lending services. This study aims to investigate the implementation of the prudential principle in Fintech P2P Lending by outlining its regulatory framework and examining the legal consequences arising from non-compliance with this principle. Employing a normative juridical methodology, the research utilizes both statutory and conceptual approaches. The prudential principle in P2P Lending services is governed by POJK No. 10/POJK.05/2022, which constitutes the legal basis for the operation of P2P Lending services. Additionally, PBI No. 19/12/PBI/2017 concerning the Implementation of Financial Technology mandates adherence to the prudential principle. Furthermore, Fintech P2P Lending providers must undergo a testing process within the Regulatory Sandbox to obtain a business license, as stipulated in POJK No. 3 of 2024 regarding the Implementation of Innovation in the Financial Technology Sector (ITSK). Legal repercussions for providers failing to comply with the prudential principle include administrative sanctions such as up to three written warnings, business operation restrictions, and ultimately, revocation of the business license.
Perkembangan pesat dalam bidang teknologi informasi, salah satunya dalam bidang keuangan yaitu dengan adanya Fintech dengan layanan Peer to Peer Lending, hal ini membawa dampak signifikan bagi masyarakat dengan membawa manfaat yang dapat dirasakan, namun tidak menutup kemungkinan munculnya risiko dalam penyelenggaraan layanan dalam Fintech Peer to Peer Lending, maka daripada itu diperlukannya prinsip kehati - hatian dalam layanan Fintech P2P Lending. Penelitian ini bertujuan untuk meninjau prinsip kehati - hatian dalam layanan Fintech P2P Lending, dengan merumuskan pengaturan prinsip kehati - hatian dalam Fintech P2P Lending dan implikasi hukum atas tidak diterapkannya prinsip kehati - hatian. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan (statute approach) dan konseptual (conceptual approach). Pengaturan atas prinsip kehati - hatian dalam layanan Fintech P2P Lending diatur pada POJK No. 10/POJK.05/2022 sebagai dasar hukum dalam penyelenggaraan layanan Fintech P2P Lending. selain itu, PBI No. 19/12/PBI/2017 juga mengatur terkait kewajiban penerapan prinsip kehati - hatian. Penyelenggaraan layanan Fintech P2P Lending haruslah melalui mekanisme pengujian untuk mendapatkan izin kegiatan usaha melalui Regulatory sandbox dengan berlandaskan pada POJK No. 3 Tahun 2024 tentang Penyelenggaraan Inovasi Teknologi Sektor Keuangan (ITSK). Implikasi hukum bagi penyelenggara yang tidak menerapkan prinsip kehati - hatian yaitu sanski administratif berupa surat peringatan tertulis sebanyak 3 (tiga) kali, pembatasan usaha, dan terkahir pencabutan izin usaha
